2023: Appointment as Deputy Director of TFCMI, Saratov Region

Former head of the Ministry of Health of the Saratov region Natalya Mazina, who was prosecuted for falsified ultrasound scanners, moved to the Territorial Compulsory Medical Insurance Fund (TFCMI) of the region. The press service of the latter reported this to the Versiya-Saratov news agency in February 2023. At the same time, it is not specified what tasks are assigned to Mazina in the TFOS.

Earlier, a criminal case was opened against Natalia Mazina, according to which the official allegedly from December 2018 to January 2019, due to personal interest, ignored the acceptance of 18 falsified ultrasound devices with substandard sensors intended for regional medical institutions.

The investigation of the case against the ex-minister ended in February 2021. In November of the same year, the Frunze District Court of Saratov acquitted Mazina and recognized her right to rehabilitation. During the consideration of the case, the court also found that the delivered ultrasound devices have a full set of documents that confirm the compliance of medical equipment with the current registration certificates. In addition, the previously identified violations of the terms of the contract did not interfere with the acceptance of equipment.

The prosecutor's office of the Saratov region did not agree with the acquittal and in November of the same year filed an appeal. The Saratov Regional Court in February 2022 agreed with the decision of the Frunze court and upheld the verdict. At the same time, the supervisory authority sent a complaint to two decisions of the courts at once in cassation. In September 2022, the First Cassation Court of General Jurisdiction in Saratov upheld the current acquittal.[3]

Conducting searches in connection with the case of abuse of office

In December 2019, the press service of the Ministry of Health, citing Mazina, reported that a search was also carried out in her apartment by law enforcement officers. During it, title documents for objects of property were seized. According to the press service, the searches are related to the investigation of a criminal case on abuse of power by an unidentified circle of persons of the regional Ministry of Health when purchasing equipment for children's clinics.

Earlier, the regional prosecutor's office reported that within the framework of the state program in 2018, the ministry concluded a state contract for the supply of four medical devices for a total amount of more than 33 million rubles. However, medical equipment was delivered that did not meet the terms of the contract and the requirements of GOST, since it was cheaper. But officials not only did not take any measures, but also transferred money under the contract[4] out[5] of[6].

Abuse of office charge

In October 2020, the department for the investigation of especially important cases of the Investigative Directorate of the Investigative Committee of the Russian Federation in the Saratov Region, the ex-head of the regional Ministry of Health, charged Natalya Mazina with abuse of office committed by a person holding a public position in a constituent entity of the Russian Federation (part 2 of article 285 of the Criminal Code of the Russian Federation).

According to the investigation, in the period from October to November 2018, the Ministry of Health of the Saratov Region signed three state contracts for the supply of 18 ultrasound scanners for medical institutions in the region. In December 2018 - January 2019, at the time of their acceptance in hospitals, the minister was informed about the non-compliance of the delivered ultrasonic devices with the registration certificate issued by Roszdravnadzor and, accordingly, the terms of the state contract. At the same time, the operation of medical equipment in Russia is possible only in strict accordance with the registration certificate issued for a specific model of the medical device.

At the same time, the investigation believes that Natalya Mazina, guided by "the desire to fulfill the state program by any means and avoid claims from the management regarding the conclusion of a state contract with an unscrupulous supplier," did not order as a state customer to refuse to accept falsified ultrasound devices by issuing appropriate organizational and administrative documents.

The Minister of Health organized payment for inappropriate quality equipment, causing damage to the budget of the Saratov region in the amount of more than 53 million rubles.

Since April 2020, Natalya Mazina is not the Minister of Health of the Saratov Region, she was appointed chief physician of the regional clinical hospital. In October 2020, she was dismissed from this position.[7]

Seizure of ultrasound devices in Saratov in the case of abuse of office

On May 17, 2021, it became known that two ultrasound machines were seized from the children's department of the Saratov city interdistrict polyclinic No. 1, which are material evidence in the criminal case of ex-Minister of Health of the region Natalia Mazina.

The first court hearing in the criminal case of Natalia Mazina will be held on May 20 at the Frunze District Court of Saratov.

Dismissal of charges in the case of abuse of office

The Frunzensky District Court on November 12, 2021 acquitted the ex-Minister of Health of the Saratov Region Natalya Mazina.

The Investigative Directorate of the Investigative Committee of the Russian Federation charged her with abuse of power in the purchase of medical equipment. The forensic examination confirmed the performance of the equipment, and the claims against it were removed after the software update. The ex-head of the Ministry of Health recognized the right to rehabilitation and compensation for harm. The verdict has not yet entered into force.

The reason for initiating a criminal case was the purchase by the Ministry of Health of ultrasound devices from the company SMS Technologies LLC in 2018-2019. According to the investigation, the equipment did not respond to the registration certificate issued by Roszdravnadzor, which the accused was aware of. Law enforcement officers declared medical equipment counterfeit, forbade doctors to use it and counted the damage to the state in the amount of 53.2 million rubles.

During the litigation, the SMS Technologies company provided a full package of documents for its ultrasound devices. There was all the necessary documentation, as the court established, and the Ministry of Health. The devices that became the subject of the proceedings, only 18 pieces, worked properly. The only nuance was the marking of the sensors, which did not coincide with the names of the same sensors displayed on the monitor. This fact did not affect the quality of work and the accuracy of the research for which the technique is intended. Moreover, the frequency range of the sensors turned out to be wider than was prescribed in the terms of the contract. That is, the devices purchased by the Ministry of Health could give more than expected from them. As the press service of the Frunzensky District Court explains, the same facts were confirmed by the examination carried out during the consideration of the case. All that is required for medical equipment, the experts concluded, is a software update. Ultrasound devices intended for children's clinics do not threaten the life and health of patients.

Nevertheless, the discrepancies with the sensors turned out to be enough for the investigation to declare the production equipment of the St. Petersburg plant NIPK Electron CJSC counterfeit and prohibit access to it for everyone, even the engineers of the manufacturing company, who were ready to come and reprogram the devices to eliminate the discrepancies. Doctors were forced to work with old equipment, the new one was idle, the investigation was ongoing.

The company SMS Technologies LLC, against the background of such loud statements, was also not in the best position. At the end of 2019, the equipment supplier said that a campaign to discredit him had begun and sent complaints about this to the RF IC and the Prosecutor General's Office. The company also appealed to federal expert institutions to check the devices. The conclusions of the specialists confirmed that the delivered equipment is of high quality and passed the required registration.

The criminal case opened by the Investigative Directorate of the Investigative Committee of the Russian Federation in the Saratov Region was initially initiated on the identified facts, without specific defendants. The fact that Natalya Mazina became the suspect was announced by the investigation only on January 17, 2020. Law enforcement officers failed to remove the minister from office for the period of investigative actions in court, the Volzhsky District Court rejected the petition.

Now the Frunzensky District Court has concluded that the guilt of the head of the Ministry of Health in the story of ultrasound machines was not. During the consideration of the case, the software on the controversial technology was finally updated and it turned out that this was enough to remove all claims.

2022

Acquittal in the case of substitution of medical equipment for 53 million rubles

In February 2022, the former head of the Saratov Ministry of Health Natalya Mazina was acquitted in the case of the substitution of medical equipment for tens of millions of rubles. When considering the appeal submission of the prosecutor's office, the Saratov Regional Court found her not guilty of abuse of office and dismissed the submission.

As Natalia Mazina's lawyer Andrei Morozov told Interfax, the prosecutor's office must now apologize to his client for unjustified criminal prosecution. Mazina recognized the right to rehabilitation, as well as the right to compensation for harm in accordance with Art. 135, 136 of the Code of Criminal Procedure.

According to the prosecution, in 2019, the regional ministry purchased devices for ULTRASONOGRAPHY that could threaten the health of patients. Despite this, Mazina did not refuse to accept the devices and did not demand to Roszdravnadzor check their compliance with the standards, but paid 53.2 million rubles to the supplier. Thus, the minister damaged the regional budget, because the devices eventually had to be destroyed.

During the judicial investigation, it turned out that the supplier provided the customer with a full set of documents confirming that the ultrasound devices were produced by NIPK Electron CJSC, whose right to manufacture medical devices was confirmed by a registration certificate dated April 23, 2018.

The state prosecution requested that Mrs. Mazina be found guilty and sentenced to three years in prison in a general regime colony with deprivation of the right to hold positions in the state and municipal service for two years, the defense insisted on an acquittal. The trial court, and now the appeal, sided with the accused. The acquittal by February 2022 came into force.[9][10]

Keeping the acquittal in force by the cassation court

On September 8, 2022, information appeared that the First Court of Cassation of General Jurisdiction upheld the acquittal against the ex-Minister of Health of the Saratov Region Natalia Mazina, who tried to challenge the regional prosecutor's office. This was told by her lawyer Andrei Morozov.

As he stressed, the courts of three instances indicated Mazina's innocence. The prosecution can still appeal to the Supreme Court, but their chances of appealing the decision have "significantly decreased," the defender said.

The investigation of the case against the ex-minister was completed in February 2021. On November 12, 2021, the Frunze District Court of Saratov found the former official innocent of abuse of office and recognized her right to rehabilitation. According to Andrei Morozov, Natalya Mazina has not yet used this right.

At the same time, the supervisory authority sent a complaint to two decisions of the courts at once, which the cassation upheld in September 2022.[11]

Mazina was previously accused of abuse of office (part 2 of article 285 of the Criminal Code of the Russian Federation) when purchasing ultrasound devices for medical institutions in the region for a total of 53.2 million rubles. According to the investigating authorities, from October to November 2018, the regional Ministry of Health concluded 3 state contracts for the supply of 18 ultrasonic devices. As part of the acceptance of the equipment, Mazina was informed that it did not comply with the registration certificate issued by Roszdravnadzor and, accordingly, the terms of the state contract, that is, it cannot be operated. However, the court concluded that the supplier of medical equipment - "SMS technology" - during the delivery of the products presented a full set of documents confirming that the ultrasound devices were produced by NIPK Electron (his right to manufacture medical devices was confirmed by registration certificate).[12]
