2024: Work to create a registry

Rostrud started creating a digital register of employers with identified cases of illegal employment. This was announced in August 2024 by the press service of the Ministry of Labor and Social Protection of Russia, submitting a draft relevant government decree.

According to Interfax, inclusion in the register will be carried out solely on the basis of a decision on an administrative offense. This applies to cases of evasion from the execution or improper execution of an employment contract, as well as the conclusion of a civil law contract instead of an employment contract.

Rostrud creates a digital register of employers with illegal employment

The register will contain open information about the name of the company or full name of an individual entrepreneur, TIN, the date of inclusion in the register and the basis for this - the number and date of the decision in the case of an administrative offense. Access to this data will be provided for all citizens on the official website of Rostrud.

The formation of a list of unscrupulous employers is planned to be carried out on the basis of decisions on administrative offenses that entered into force from the beginning of 2025. The employer's stay in the register will be one year from the date of the last established violation. After this period, if there are no repeated violations, the registry will be automatically excluded.

It is possible to early exclude from the register in case of cancellation of the decision in the case of an administrative offense that had previously entered into legal force. This will ensure the fairness and relevance of the information presented in the register.

The Ministry of Labor emphasizes that the creation of a register of violators of labor legislation is aimed at increasing the transparency of the labor market and the availability of information about employers. It is expected that this will allow applicants to assess the integrity of a potential employer in advance and make a balanced decision on employment.[1]
