2021: Complaint about discriminatory terms of the Diya City design tender

The Ministry of Digital Affairs of Ukraine was accused of a dishonest tender for the purchase of services worth 4 million UAH. This became known on November 22, 2021.

The state-owned enterprise Diya (founded by the Ministry of Digital Affairs of Ukraine - approx. TAdviser editorial board) ordered marketing management services for Diya City (a special legal regime for Ukrainian IT companies) worth UAH 4.08 million. The corresponding tender was held on November 12, 2021 on the Prozorro platform, the winner was the Fedorov Kom company, which had previously been engaged in design for Dії.

However, one of the potential participants complained about the discriminatory conditions of the tender, and the Ministry of Digital Affairs was accused of "sawing" 4 million UAH with an already familiar company. To this, the department replied that it needed quality services and an authoritative name of the performer.

Fedorov Kom was tasked with creating brand strategy and design for the Diya City legal regime. Also, the winner of the tender should create a project presentation and a script for a video about the special mode.

Regarding the cost of creative services, we note that this purchase was not for budget funds, but for the funds received by GP Diya from commercial activities, the department said.

At the same time, Shea Stretejis complained about unfair terms of the tender regarding the availability of international awards. According to this firm, the requirements are discriminatory, and they artificially narrow the circle of potential participants, but do not affect the ability or inability of the participant to fulfill the terms of the contract.

The Ministry of Digital Affairs refused to remove the conditions for international awards, citing the need for sufficient qualification of the participant.

Regarding LLC ASR Shi Stretejis, which filed a complaint against discriminatory conditions, we note that the website of the LLC indicates that the company is engaged in consulting in the field of reputation management, and does not provide the design services necessary in this case. Therefore, the Ministry of Digital Affairs did not cooperate with this company, - explained[1].
