2025: Transition of GIS operator status from the Ministry of Economic Development to the Ministry of Digital Development

On February 19, 2025, a draft decree of the Government of the Russian Federation was published, according to which the powers of the GIS operator "Rulemaking" are transferred from the Ministry of Economic Development to the Ministry of Digital Development. At the same time, the Ministry of Economic Development and Trade, as well as the Ministry of Justice of Russia, will act as functional customers.

In accordance with the decree, the Ministry of Digital Development becomes the operator of the state information system "National Unified Environment for Interaction of Participants in the Rule-Making Process" (GIS "Rule-Making"): the department is responsible for the development, commissioning and actual operation of the platform, as well as for storing the information contained in its databases. In turn, the Ministry of Economic Development and the Ministry of Justice will describe the functional requirements (description of the target state) of the GIS.

"Functional requirements" refers to proposals for the terms of reference, including requirements for the structure of the information system as a whole, requirements for functions (tasks) performed by the system, as well as proposals for other technical documentation. The adoption of the draft resolution will not require the allocation of additional funds from the federal budget and will not affect the achievement of the goals of state programs of the Russian Federation.

Mikhail Bocharov, Deputy General Director for Science of SiSoft Development JSC, notes that the transfer of the functions of the GIS operator Rulemaking to the Ministry of Digital Development Engineering will have a positive effect.

The logic of this decision is understandable. In the era of digitalization of all industries, first of all, civil servants can best perform the functions of a GIS operator. Some functions, such as an electronic signature, can be replaced by other types of confirmation. This will not affect the quality of the GIS and interdepartmental interaction, says Bocharov.[1]

Procedure for digitalization of legislative activities

The Russian government is expanding initiatives to digitalize legislative activities in order to speed up document processing and increase efficiency. One of the directions is the introduction of the state information system "National Unified Environment for Interaction of Participants in the Rule-Making Process" (GIS "Rule-Making"). This was announced on December 23, 2024 by the Deputy Prime Minister - Head of the Government Apparatus Dmitry Grigorenko.

According to him, digitalization of legislative activities is a priority task. The use of digital systems makes it possible to quickly respond to changes in the economic and social spheres, which helps to respond to specific requests from citizens and businesses.

GIS "Rulemaking" and the auto-negotiation mechanism: how the digitalization of legislative activities takes place in Russia

GIS "Rulemaking" is a single electronic workspace for all participants in the process of developing legal acts using domestic software. The platform allows you to attract co-authors and experts, automatically record changes in texts and wording. As of the end of December 2024, GIS will be used in five federal ministries, and in 2025 the government intends to introduce it everywhere.

Grigorenko said that in 2024 the State Duma adopted 564 federal laws. At the same time, the government sent more than 1.1 thousand official reviews and conclusions to the initiatives of deputies, senators and regions, which is 12% higher than in 2023. The average period for the preparation of these documents by federal ministries and departments has been almost halved (by 45%) - from 39 to 22 days. Such a significant improvement has been achieved by improving the quality of planning and executive discipline of ministries, including through the introduction of digital tools. Since 2023, an auto-negotiation mechanism has been in effect at the site of the government apparatus in the preparation of by-laws. This system in 2024 made it possible to reduce the number of violations of the deadlines for the adoption of by-laws to 0.3% of the total. For comparison: in 2023, the indicator was 2.5%, and in 2022 it exceeded 17%.[2]

Start-up of the system for commercial operation

On October 1, 2024, the Russian government officially launched the state information system "Rulemaking," which will be used to accelerate the development and coordination of bills and regulations. The new tool will ensure that several participants work simultaneously on draft laws in real time, which will significantly increase the efficiency of the legislative process.

According to Kommersant, four key ministries of the economic bloc - the Ministry of Finance, the Ministry of Energy, the Ministry of Natural Resources and the Ministry of Economy - will be the first to take part in the experiment. The latter will also act as the system operator. According to the government, the new system will automate many processes related to the preparation and discussion of documents, including tracking deadlines, preparing tables of disagreement and automatic routing of documents. These changes will eliminate the need to exchange paper correspondence and significantly reduce the timing of project approval.

According to representatives of the government apparatus, the system will not change the current procedures, but will only provide departments with more convenient tools for working with legal documents. GIS Rulemaking is expected to reduce the average time for preparing regulations by 30%, which is approximately 120 days. This is especially true, given that the current deadlines for the preparation of one regulatory legal act can reach 328 days, while up to six departments usually participate in its development.

The functionality of the system will include the preparation of federal laws, reviews, amendments, government acts and departmental documents. All documents will be automatically uploaded to the unified register of federal regulations available on the website pravo.gov.ru. In the future, it is planned to integrate the system with the platform for assessing the regulatory impact on the regulation.gov.ru. By 2030, the system should become the main tool for developing regulatory legal acts at all levels of government, including regional and municipal bodies.[3]

2023: System Testing

The Ministry of Economic Development of the Russian Federation has begun pilot testing of the state information system (GIS) "Rulemaking," which should become a single environment for interaction between all participants in the preparation of legal acts. This became known in mid-June 2023.

Lev Gershanok, director of the legal department of the Ministry of Economy, told Kommersant that the new platform will make it possible to simultaneously work on the document at once to all interested departments. This algorithm will not replace humans, but will reduce costs and simplify "mechanical" work, he said.

Pilot testing of GIS "Rulemaking" has begun

The representative of the Ministry of Economic Development, in addition to working together with the text of legal acts, the platform provides for the automatic formation of tables for accounting for comments and disagreements.

The main difference between this platform and the regulation.gov.ru portal, where draft legal acts are published for public discussion by June 2023, is its closure. The new system - GIS "Rulemaking" - is intended only for those who take part in the development of future laws, that is, for officials and expert organizations.

According to the draft resolution, GIS "Rulemaking" will be integrated with portals of regulation.gov.ru, open data, pravo.gov.ru, with the state electronic document management platform GosEDO, as well as by decision of the operator - with other systems and resources. In "Rulemaking," the creator of the draft act can involve co-authors in the development of the document, coordinate it with the authorities and then send it to the regulation.gov.ru. The new GIS will ensure the passage of the full life cycle of the draft legal act.

It is assumed that in August 2023 other federal departments will join the testing of the GIS "Rulemaking[4]

2022: The beginning of the creation of the system for 286.6 million rubles

On August 22, 2022, it became known about the creation by the Ministry of Economic Development of the Russian Federation of a new state information system, which should become a single environment for interaction between all participants in the rule-making process in the preparation of legislative decisions. The platform was called "Rulemaking," it is planned to spend 286.6 million rubles on its development.

The relevant materials on the public procurement website were noticed by Sheets"." According to the publication, in accordance with the contract, which involves four stages, GIS "Rulemaking" should be created by September 30, 2023. Financing of the work will be carried out at the expense of the federal budget.

As follows from the technical assignment, the need to create a new system is explained by the fact that so far the exchange of paper documents remains the main way of interaction between departments during conciliation procedures by August 2022, which "significantly lengthens the total period for preparing NPA projects." Execution of documents on paper does not allow all participants in the rule-making process to work with their current versions and make adjustments, since changes to one participant become available to another only when the project developer NPA sends him a new version.

It is noted that the regulation.gov.ru website, which is the main source of information on the preparation and adoption of NPA projects by government agencies, is not suitable and does not allow proper traceability, working with versions and joint editing of documents, is explained in the materials of public procurement.

"Rulemaking" will be integrated with the current systems - regulation.gov.ru, pravo.gov.ru and others, a representative of the Ministry of Economy told Vedomosti. The new GIS will be compatible with the Linux family of operating GIS. The system will also have its own text editor, according to the ministry.[5]
