2020: Finland adopted the law on prohibition of telecommunication equipment for safety reasons

On December 7, 2020 the parliament of Finland approved the law which will allow the authorities to prohibit use of the equipment of telecommunication networks in case of existence of "serious reasons to suspect that use of technology threatens national security or national defense".

Finland, unlike the neighboring Sweden, did not prohibit any supplier on the basis of the country of origin and did not mention specifically prohibition of use of the equipment of Huawei or ZTE. The new Finnish law assumes regulation of use of telecommunication equipment in crucial parts of network through which there pass flows of network traffic. Provisions of the Finnish law can extend concerning the network equipment installed and used before entry into force of new rules. The law provides payment of compensations in case of the order to exclude the equipment of this or that supplier from infrastructure.

Nokia and the Swedish Ericsson are prime vendors of the equipment in Finland, however it is known that telecom operators of Elisa and DNA Oyj used the parts delivered to Huawei for deployment of 5G networks in the country.

According to the recommendations of the European Union for the 27 member states provided in January, 2020, the countries can "limit or exclude" so-called high-risk suppliers of a 5G, such as Huawei, from the main parts of the telecommunication network.

Commenting on restrictions of the EU, Huawei said:

Unfortunately, the international discussion about network security is concentrated only on the Chinese suppliers, but we know that vulnerabilities can be found in the equipment of all producers. However in the Finnish legislation more realistic approach is used, special attention is paid to the equipment, but not suppliers.[1]
