2023: Attempt to sue SAP 330 million rubles
At the end of June 2023, it became known that the Russian manufacturer of electronics for civil aviation Azimut could not sue 330 million rubles from the German company SAP, which left Russia due to the current geopolitical situation. Moreover, the court satisfied SAP's counterclaim against the Russian enterprise.
Azimuth develops, serially manufactures and supplies communications, navigation, landing, surveillance and automation of air traffic control, as well as develops and implements projects for equipping and re-equipping airfields and flight control centers.
According to CNews, the company filed a lawsuit against SAP CIS LLC (Russian SAP structure) in the Moscow Arbitration Court on September 29, 2022. Initially, it was about claims in the amount of 330.1 million rubles, but then the figure decreased to 260.1 million rubles. Of these, 63.2 million rubles fell on the cost of purchased licenses for supporting previously purchased SAP software, and another 196.9 million rubles - on Azimut's expenses for the implementation and integration of this software, carried out by partners. In particular, we are talking about the SAP Hana DBMS, the SAP S/4Hana enterprise resource planning platform and other products.
However, SAP stated that licenses for use ON were bought by Azimut under sublicense agreements with partners in 2013. The defendants emphasized that the functioning of the software and the possibility of its use by Azimuth do not depend on receiving support services.
As a result, the court sided with SAP, rejecting Azimuth's demands. In addition, SAP's counterclaim for debt collection in the amount of 4.8 million rubles, as well as interest for the use of other people's funds in the amount of 523 thousand rubles, was satisfied. Thus, Azimut owed the opponent approximately 5.3 million rubles.[1]
