Federal state information system of pricing in construction (TsS FSIS) - a system which promises serious changes to the construction market: it should change approach to pricing, first of all, on buildings which are paid by the budget.

The main goal of a FSIS of TsS – to save the budgetary funds allocated for capital construction.

A system was developed by BARS GROUP by request of Glavgosekspertiza of Russia.

Together with Ministry of Construction Russia and Glavgosekspertiza of Russia we not just automated earlier built processes, and actually from scratch created the instrument of monitoring of the prices in the construction sphere — the CEO of BARS GROUP said Timur Akhmerov.

Problems of a FSIS of TsS

Main objective of creation of a FSIS of TsS — information support of determination of estimated cost of the objects of capital construction financed with attraction of financial resources of the state budget and state corporations. A system is intended for ensuring openness of activity of state bodies and local government authorities, the state and municipal customers, contractors of government contracts in the investment and construction sphere.

According to the first deputy chief of Glavgosekspertiza of Russia on pricing Irina Lishchenko, development and deployment of a FSIS of TsS became a part of the multistage work directed to reforming of a system of pricing in the country. It is expected that its use of the construction market by participants will allow to increase its stability and competitiveness, will promote transparency and optimization of cost of construction at all stages of the investment and construction project.

As noted, TsS FSIS — one of the first public state information systems using the cryptographic protocol of data protection of TLS.

The planned system is, in fact, an electronic base of the prices in the construction market. In it up-to-date information about the prices of building materials, products and constructions, the mounted equipment, the cost of operation of machines and mechanisms, the pay level of work of builders through the whole country, but taking into account territorial specifics will be put. As the Minister of Construction, Housing and Utilities Mikhail Men explained, it is planned that countrywide there will be about 150 price zones.

It is about creation of the mechanism which will allow most authentically, it is transparent and to objectively count ceiling starting price (before competitive procedures – an editor's note) constructions of this or that object. The new mechanism will be focused, first of all, on customers of the objects which are built with attraction of budgetary funds, – Mikhail Men explained problems of a system.[1]

Monitoring of the prices of producers will be organized. Data will be updated every quarter. According to Ministry of Construction, about 6 thousand organizations will have to provide information.

The Ministry of Construction began to think over upgrade in this sphere since 2015, having considered that the operating system of pricing outdated and opaque. It represents a set of the techniques created in the 20th century, and their use became frequent a reason for overestimate of estimated cost of construction at a project definition phase. Instead of "a basic and index method" of calculation of estimates (when estimate standards using certain indexes are transferred to the current prices) "the resource method" which assumes permanent monitoring of cost of resources will be used.

Composition

According to technical specifications in documents of the announced competition, seven main subsystems should be a part of a FSIS of TsS:

• Subsystem "Qualifier of Construction Resources" (QCR)
• TsS FSIS portal
• Subsystem of Integration of a FSIS of TsS

The FSIS of TsS should be integrated with the existing state systems (for example, a Unified identification and authentication system, the Federal Information Address System, etc.).

As basic software for system development in documents of the technical project it is recommended to use the open source (taking into account requirements of the relevant order of the Ministry of Telecom and Mass Communications No. 305 of 8/19/2015).

TsS FSIS information security system

Certification of a FSIS of TsS for the second class of security according to the order of FSTEC of Russia of 2/11/2013 No. 17 is carried out.

The documentation kit on creation of the information security facility is developed:

• Model of threats of information processed in a FSIS of TsS and Model of the violator of information security of a FSIS of TsS.
• Technical specifications on TsS FSIS Information security system.

The Information security system is developed:

• Means of cryptographic protection of software "TLS VPN Continent" is used.
• Formation and check of UKEP is performed using software of "Jinn Client".
• Control of access rights is exercised using the solution BarsUP.AM certified by FSB of Russia.
• Evaluation tests by specialized laboratory are carried out and the certificate of compliance No. I – 06/17 is issued.
• The analysis of the TsS FSIS code and tests for penetrations is carried out.

According to BARS GROUP, for the first day of operation of a system the number of unique visitors of a system exceeded 1000 people, the number of viewings made over 13 thousand.

2019

The Ministry of Construction estimated the current filling of a FSIS of TsS

At the moment the state system of pricing in construction (TsS FSIS) is filled with data for 12%, but on pricing resources the situation is better. It was said in August, 2019 by the Deputy Minister of Construction, Housing and Utilities Dmitry Volkov, RIA Novosti writes.

"If to speak frankly, then the digit of 12-13% sounds. But a question in a calculation technique. We have in the qualifier more than 100 thousand construction resources on 85 regions. At the same time not all resources pricing, are also those which are used very little. If to consider only pricing resources, then them there about 30 thousand. If to consider from 100 thousand, then the FSIS of TsS is filled approximately for 12-13%. If to consider from 30 thousand — that, maybe, for 20%" — Volkov told.

Rules of monitoring of the prices of construction resources are changed

Changes are made to rules of monitoring of the prices of construction resources. The corresponding order of the Government of the Russian Federation (No. 604) is published on the website of the Cabinet of Ministers^[2].

Adoption of the specified resolution is one of the urgent actions directed to improvement of pricing in the construction industry and "painless" transition to the resource method of determination of estimated cost of construction based on results of the state monitoring of the prices of construction resources.

In particular, the resolution postpones placement date in a federal state information system of pricing in construction (TsS FSIS) of the estimate prices of the construction resources determined by the Ministry of Construction, Housing and Utilities of the Russian Federation based on monitoring since 2019 for 2022.

Changes also provide expansion of the list of sources of information necessary for formation of the estimate prices of construction resources, and participation of federal executive authorities, executive authorities of territorial subjects of the Russian Federation, the state corporations and companies with the state participation in the mechanism of determination of estimated cost of construction in rules of monitoring of the prices of construction resources.

It will allow to consider regional and industry specifics at determination of estimated cost of construction and to increase reliability of determination of estimated cost of construction.

In particular, the possibility of participation in monitoring of the prices of construction resources FOIVOV, executive authorities of territorial subjects of the Russian Federation, state corporations and the companies with the state participation is set.

Also as additional sources of information necessary for formation of the estimate prices of construction resources information obtained from territorial subjects of the Russian Federation and the proposal of wholesale suppliers of construction resources will be considered.

Besides, the document sets a procedure of payments of FAU "Glavgosekspertiza of Russia" and publication of indexes by the Ministry of Construction, Housing and Utilities of the Russian Federation. The possibility of direction FOIVAMI, by executive authorities of subjects, state corporations and the companies with the state participation of offers on development of new indexes necessary for the market is provided.

The resolution provides establishment FOIVAMI, executive authorities of territorial subjects of the Russian Federation, state corporations and the companies with the state participation of the average monthly amount of compensation of the working first discharge occupied in the construction industry.

The document also sets determinations of the concepts which are widely used by construction community, such as, "indexes of change of estimated cost of construction", "pricing construction resources", "resource and technology model", "the summary nomenclature of pricing resources", "lists of specialized pricing construction resources".

Besides, the Ministry of Construction, Housing and Utilities of the Russian Federation prepares for a statement the Method of calculation of indexes of change of estimated cost of construction which in details regulates rules of carrying out the tactical analysis, a procedure of payments of indexes and determination of the amount of compensation of the working first discharge occupied in the construction industry.

Start of a FSIS of TsS will demand a transient period

The Ministry of Construction developed a draft resolution of the government on transfer of full start of a FSIS of TsS for January 1, 2022. The document is placed for public discussion on the portal of drafts of regulatory legal acts. The procedure will last till February 8. The relevant resolution is published on the official site of the cabinet. It represents amendments in government decree No. 1452 "About monitoring of the prices of construction resources" of December 23, 2016.

As it appears from the document, for the next three years in pricing the transient period will be determined. The so-called resource and index method of calculation of cost of construction resources will be applied during this time. Approbation of resource model (using these FSIS of TsS) in Ministry of Construction is going to be begun since 2021, the representative of department explained in the comment to Kommersant.

Changes are also made to Rules of monitoring of the prices of construction resources, said in the message on the official site of the Cabinet of Ministers. In particular, "the possibility of monitoring of the prices of construction resources with participation of federal and regional executive authorities, state corporations and companies with the state participation is set", said in it.

From specific innovations the companies can note permission to address with the offer on removal from themselves of obligations for data transmission in TsS FSIS. It, in particular, will become possible after the termination of the related activity within calendar year, falls of annual revenues are lower than 10 million rubles (for producers), productions and (or) import of construction resources only for own needs.

2018

The FSIS "Pricing in construction" does not function

On December 13, 2018 it became known that auditors of Accounts Chamber came to a conclusion that the FSIS "Pricing in construction" created for the purpose of reforming in 2015-2018 of the system of pricing and estimate regulation in the field of construction does not function.

The Accounts Chamber reported that the FSIS of TsS for which in 2017-2018 about 400 million rubles are spent properly does not work and is not used. As of August 1, 2018 information into the system was entered only by 2160 legal entities, or about 26% of a total quantity of suppliers of information. In spite of the fact that a system was created, the necessary database about market prices of construction resources and works was not created. These data are required for updating of estimate standards, explained in Accounts Chamber.

"The BARS Group company is not responsible for filling of the mentioned databases. To publish the estimate prices in TsS FSIS, information from producers which was not still provided, unfortunately, at selling prices is necessary. Outputs about a failure of reform of pricing in construction are based not on functioning of a FSIS of TsS, and on incompleteness of base of market prices of construction resources. We quote the report of Accounts Chamber: "The system of determination of estimated cost of construction based on a "resource" method is not ready; the regulatory base necessary for reform implementation, in full is not created". representatives of BARS Group

The press service of BARS Group stated to CNews that the FSIS of TsS is put into commercial operation and completely also No. 1452 "About monitoring of the prices of construction resources" functions according to requirements of terms of reference and orders of the Government of the Russian Federation No. 959 "About a federal state information system of pricing in construction". It also conforms to requirements for information security according to the 17th order of FSTEC. The documentation on cybersecurity is coordinated by FSTEC and FSB. Since the beginning of start of a system 155 thousand unique visitors are recorded (data for December, 2018).^[3]

Glavgosekspertiza called new terms of start of a FSIS of TsS

The head of FAU "Glavgosekspertiza of Russia" Igor Manylov called new terms of transition to a resource method of pricing in construction. According to him, start of a FSIS of TsS is planned for the middle of the next year. Manylov explained the next postponement with "need of a transient period".

Transition to a resource method of pricing in construction is postponed for half a year. It was said by the chief of FAU "Glavgosekspertiza of Russia" Igor Manylov, Interfax writes. "This work goes, transition to a resource method is planned for the middle of the next year. In the main weight the packet of techniques is already accepted, but it is about correction in general of the model, about need of a transient period not to do it sharply" — Manylov told.

Medvedev charged to introduce penalties for failure to provide TsS given in a FSIS

The Government of the Russian Federation charged to Ministry of Construction, FAS and the Ministry of Economic Development to prepare in August, 2018 amendments to the Code of the Russian Federation on Administrative Offences about the administrative responsibility for failure to provide TsS given in a FSIS. The corresponding order was signed by the prime minister Dmitry Medvedev. The document is published on the official site of the cabinet.

According to the order, necessary amendments in the Code of Administrative Offences need to be prepared by December of this year. Their development is necessary for "stimulation of providing reliable information by legal entities about the cost of construction resources for the purpose of improvement of competition in the construction market".

What is interesting, the relevant bill is already prepared by Ministry of Construction at the end of last year and in February of the 2018th successfully underwent so-called "ORF procedure". The positive conclusion on the draft document issued the Ministry of Economic Development. According to given by amendments, legal entities for failure to provide given in a FSIS of TsS are threatened by a penalty from 50 to 80 thousand rubles. And in case of further violation — from 100 to 200 thousand rubles.

Start of the second queue of IAS of TsS

BARS GROUP, subsidiary company of "The national center of informatization" (enters into Rostec Group), in January and February, 2018 announced end of the next stage of development of the Information and analytical system of pricing in construction (IAS of TsS), having started in work of a subsystem of the second queue.

Thanks to the solution as construction passes pricing in such large-scale industry to the digital platform. In a system data on construction resources from all Russia will be processed - it is enormous information volume. The transparency of pricing in town planning will become the main effect of implementation — the deputy CEO of BARS GROUP company Rustem Ibragimov said.

The main task of IAS of TsS — activity automation of "Glavgosekspertiza of Russia" regarding pricing and estimate regulation. For this purpose suppliers and producers of services from all construction market of the country provide the information. In a system data on the salary, the price of materials, the equipment, products, constructions and also machines and mechanisms are processed. As a result the estimate prices of construction resources which are unloaded for public use in the Federal state information system of pricing in construction (TsS FSIS) form.

In subsystems of the second queue the integrated standards the prices of construction are calculated and resource and technology models are created. Also there the logistics module determining the cost of transportation of construction resources and a subsystem of integration which is responsible for information exchange with external systems, including TsS FSIS is switched on.

As of January, 2018, the first stage of systems already is in commercial operation. The subsystem of calculation of the estimate prices including database maintenance of construction resources, a storage device subsystem and also an administration subsystem in which user account control, is conducted by access and management of inline tunings functions.

In a FSIS of TsS the possibility of collecting and data processing about the salary, the price of materials, the equipment, products, constructions and also machines and mechanisms is implemented. As a result the estimate prices of construction resources which are placed in TsS FSIS form.

In subsystems of the second queue the integrated standards the prices of construction are calculated and resource and technology models are created. Also there the logistics module determining the cost of transportation of construction resources and a subsystem of integration which is responsible for information exchange with external systems, including TsS FSIS is switched on.

The subsystem of calculation of the enlarged standards of the price of construction provides development of the enlarged estimate standards, allows to perform calculations of cost of transportation of materials and the equipment taking into account cost-efficient routes of transportation of loads. The functionality of a subsystem allows to make local estimate calculations by a resource method, to import the estimates received during calculation in the formats XML, arp, xlsx. Besides, the possibility of automatic creation of object resource sheets and resource and technology models with allocation of costs according to sections and synchronization of data at their change is provided.

Can make cardinal amendments to work of a FSIS of TsS

Continue to find essential defects in a FSIS of TsS. The union of cost engineers suggested to include in the system only of the legal person with annual revenues not less than 100 million rubles, to bring into accord with each other codes of qualifiers of stroyresurs and not to forget about large regional suppliers of building materials^[4].

By September, 2018 i.e. until the system of pricing in construction works in the test mode, significant changes can be made to it. In particular, the Union of cost engineers directed a number of suggestions for improvement of a FSIS of TsS to the address of Ministry of Construction and Glavgosekspertiza.

So, by the rules existing now, price information legal persons with annual revenues should provide not less than 10 million rubles. Meanwhile, experts of the Union consider that such low threshold will lead to hit in the system of doubtful producers of building materials and suggest to increase the minimum revenue by 10 times — to 100 million rubles. Also in the Union suggest to introduce the requirement to specify not only a legal address of the company, but also direct street addresses of productions, finished goods warehouses.

Besides, experts pay attention to need of reduction in compliance of codes of qualifiers of stroyresurs. The matter is that in the new version (of September 29, 2017) not only new resources are added, but many names and codes of separate sections and groups, resources and unit of measure are changed. Actually previous edition cannot already be used. Also now during the work with these FSIS of TsS often there is a situation at which if the specific material resource is not made in the territory of the region, then the producer should be looked for in other regions, i.e. "to wander" on TsS FSIS. For the solution of this problem the Union of cost engineers suggests to include in a FSIS of TsS and large regional suppliers (dealers, the trade missions, etc.) providing delivery, a complete set, intermediate storage of materials and the equipment and working with producers directly.

Besides, as experts of the Union consider, the estimate prices according to all nomenclature of resources should be provided to TsS FSIS on all regions (by each region) irrespective of whether specific building material is imported from other territory or local material. For this purpose the Union suggests to set the rule by which the prices for different regions will be determined differently — depending on whether there is in the specific region a producer of the specified building materials or they should be delivered from other region.

2017

The bill of penalties for failure to provide TsS given in a FSIS

The Ministry of Construction published in December the amendments to the Code of the Russian Federation on Administrative Offences providing introduction of penalties for failure to provide data to the state information system of pricing in construction (TsS FSIS). The document is available on the portal of drafts of regulatory legal acts within the ORV procedure. Public discussion is going to be completed in the middle of January, 2018.

The bill enters new Article 9.5.2 into the Code of the Russian Federation on Administrative Offences. According to this regulation, failure to provide information in TsS FSIS for officials attracts a penalty from 10 to 20 thousand rubles. For legal — from 50 to 80 thousand rubles. The responsibility for violation of an order of providing data is slightly less: for officials — a penalty from 5 to 15 thousand rubles, for legal — from 30 to 50 thousand.

However in case of repeated failure to provide given in TsS FSIS after imposing of administrative punishment it is necessary to pay much more. A penalty for officials — from 30 to 50 thousand rubles, for legal — from 100 to 200 thousand. The right to make responsible under the new article of the Administrative Code, according to the bill, will receive bodies of regional construction supervision.

Earlier the operator of a FSIS of TsS FAU "Glavgosekspertiza of Russia" officially announced an exit order from the list of the legal persons obliged to enter data into the system. For this purpose the company needs to correct statutory documents, having removed the corresponding OKVED2 codes and to register changes in the USRLE. And then to file to the Ministry of Construction, Housing and Utilities of the Russian Federation a petition for an exception of the corresponding register. It is necessary to enclose the documents confirming failure from to the application connected with production and import of building materials of OKVED2 codes.

Meanwhile, in Ministry of Construction recognized existence of problems with determination of the estimate prices in construction. Department will create four working groups for correction of the corresponding methodology: in the field of costs for labor resources, for machines and mechanisms, for materials, products, constructions, the equipment and for cargo transportation. Writes TASS about it ^[5].

The first group will be headed by the director of support of the project documentation and examination ^[6] (the contractor of Kerchensky Bridge). The second and third — representatives of the Russian union of builders. The fourth — JSC Stroytransneftegaz. The Deputy Minister of Construction, Housing and Utilities Hamit Mavliyarov will supervise their work.

Implementation of Jinn-Client and "TLS VPN Continent"

Products of the company – Jinn-Client and "TLS VPN Continent" – are implemented in a federal state information system of pricing in construction. Thus, risks of falsification of signatures and documents in the information processes implemented in a system will be excluded, and all connections of users to a system will be protected using the Russian cryptoalgorithms.

As it was important to Glavgosekspertiza of Russia to provide to the operator of a system legitimate interaction with remote users on the Internet. It was for this purpose necessary to select the means of protecting which are conforming to requirements of the legislation in the field of data protection and having certificates of regulators – FSB and FSTEC of Russia.

Completely the products developed by Code of Security company for neutralization of relevant security risks of information "TLS VPN Continent" and Jinn-Client meet the imposed requirements. To software "TLS VPN Continent" it is intended for ensuring secure access of remote users to the TsS FSIS resources on public communication networks. To software of Jinn-Client it is intended for visualization of the document signed by the user, implementation of cryptographic functions of hashing, formation, check and gain of the electronic signature.

"TLS VPN continent" provides secure access of remote users to the TsS FSIS resources on public communication networks. The cybersecurity solution is a local proxy, it intercepts browser traffic to the protected Web servers and packs it into a https-tunnel thanks to what the user can work with any web browser.

As a result of product introduction "The code" the customer ensured safety not only legally significant interaction with users, but also a possibility of fulfillment of requirements on operation of means of cryptographic information protection.

Start of a system

On October 3, 2017 the BARS GROUP company announced start in commercial operation of the Federal state information system of pricing in construction (TsS FSIS). Start was preceded by the system testing period.

2016

The choice of the contractor for creation of a system

At the end of November, 2016 organization subordinated to Ministry of Construction – Glavgosekspertiza announced competition on creation for 105 million rubles of a federal state information system of pricing in construction (TsS FSIS).^[7]

Two companies – Croc Inc. (with the offer on the price – 102.5 million rubles) and the Kazan company "BARS GROUP" (103.5 million rubles) submitted applications for tender. Until the end of December the customer will have to select future contractor.

According to documents of state procurement, a system should be put into operation no later than September 30, 2017.

Government decree

In September, 2016 the government approved creation of a system: the prime minister Dmitry Medvedev signed the resolution on creation of a FSIS of TsS. The document is developed by the Ministry of Construction and Housing and Communal Services according to the law directed to improvement of a system of estimate regulation and pricing in construction reported in the Ministry of Construction, Housing and Utilities of the Russian Federation.

It is decided that Glavgosekspertiza will become operator of a FSIS.
