2022: Detention on suspicion of bribery on an especially large scale

On December 26, 2022, the investigation sent a petition to the Dorogomilovsky Court of Moscow for the arrest of Alexander Matyushkin, deputy head of the digital transformation department of the Federal Air Transport Agency. This follows from the information posted on the court's website[1]The case includes part 6 of Art. 290 of the Criminal Code of the Russian Federation (taking a bribe in a particularly large amount), which provides for up to 15 years in prison.

This detention is not related to the provision of subsidies and measures of state support to airports and airlines, it is specified there. The Federal Air Transport Agency also denied reports that appeared in the media about searches of the head of the Federal Air Transport Agency Alexander Neradko.

According to the Aviatorshchina Telegram channel, Matyushkin came to the Federal Air Transport Agency just a month ago, and searches preceding the petition for his arrest also took place on December 26 in the offices of a number of other managers of the Federal Air Transport Agency in the agency's central office on Leningradsky Prospekt.

Another person involved in the case is Ivan Larionov, director of the IT company "5.25 Programs." A case was initiated against him on the grounds of a crime under Part 5 of Art. 291 of the Criminal Code of the Russian Federation (giving a bribe on an especially large scale)[3].

According to the Kommersant newspaper, the matter is related to the state contract of the Federal Air Transport Agency with the "5.25 Program" for the supply of technical means of information protection, concluded on December 12, 2022, in the amount of 22.8 million rubles.

2023

Extension of detention

In February 2023, the Dorogomilovsky District Court extended the term of detention as a preventive measure to Alexander Matyushkin and house arrest, the second person involved in this criminal case, businessman Ivan Larionov, who until mid-February was the director of the IT company "5.25 Programs." Records on the extension of the deadlines are both contained in the database of courts of general jurisdiction of Moscow.

At the time of publication, the Dorogomilovsky District Court could not clarify TAdviser the new term of detention of Alexander Matyushkin. But it is known that the new term of house arrest of Ivan Larionov is until April 24, 2023[4].

In the database of courts of general jurisdiction, there is also a record that Alexander Matyushkin filed an appeal against the extension of his detention in a pre-trial detention center. Her court has yet to consider.

Alexander Matyushkin tried to appeal the chosen preventive measure earlier, in mid-February. Then he and his defender asked to change her to house arrest. The court, however, left Matyushkin in custody.

In the appeal decision of the Moscow City Court on this matter of February 16, 2023, published in the database of Moscow courts, it is said that the active collection of evidence continues in the criminal case, not all persons involved in the commission of this crime have been established, and also, perhaps, not all evidence in the case of the investigation was found and seized. In addition, Alexander Matyushkin's involvement in other crimes is being checked, according[5] document[6].

Criminal Corruption Conviction

Invisible to the public was the sentencing of a corruption case against Alexander Matyushkin, who worked as deputy head of the digital transformation and support department of the Federal Air Transport Agency and was arrested in December 2022. As TAdviser found out, the case was heard in the Odintsovo City Court of the Moscow Region, which found Matyushkin guilty of four episodes of crimes under Art. 290 of the Criminal Code of the Russian Federation (taking a bribe), which, as it turned out, took place not only in the Federal Air Transport Agency, but also at one of his previous places of work - in the "Marine Rescue Service" (FSBI "Marine Rescue Service").

The verdict published[7] on the official website of the Odintsovo City Court of the Moscow Region provides not only the circumstances of the crimes, but also some interesting details of Alexander Matyushkin's career path in the Federal Air Transport Agency and the Marine Rescue Service.

At the Marine Rescue Service

So, from the verdict it follows that initially in the "Marine Rescue Service" Matyushkin was appointed deputy head of the administrative department, but then transferred to the post of head of the informatization department. In this position, he carried out general leadership of the department, including participating in the IT procurement of the institution.

The court states that then Matyushkin had a criminal intent to receive a bribe on a large scale for assistance in ensuring the participation and winning of the company in auctions for the provision of services for the development and operation of software in the form of 5% of the amount of contracts concluded. The verdict mentions Pallada LLC and its product Poisk-More. By prior agreement with the Pallas representative, whose name was not specified, Matyushkin participated in the formation of the terms of reference for the software of this company.

As a result, according to the results of public procurement, contracts were concluded with this company for services for ensuring the functioning, technical and methodological support of "Search-More" and services for providing virtual hosting and deploying "Search-More" on virtual server power. After transferring money under the agreements, Matyushkin received a bribe in cash in an envelope.

There was another corruption episode. The name of the IT company in this case is not specified in the verdict, but it is indicated that Matyushkin agreed on a large-scale bribe with a previously familiar director of the company. In relation to the latter, the case was separated into a separate proceeding, the verdict said. In this case, there was a purchase of services for providing access to software products and concerned the implementation of information security measures by Marine Rescue Service. The terms of reference for the purchase were added, including new services in order to increase the cost, the verdict said.

After the transfer of money under the contract, a bribe took place in this case. Before the transfer to Matyushkin, it was packed along with souvenirs, follows from the verdict.

The official portal of public procurement for search issues only one tender "Morspasservice" with the object of purchase "Provision of services for providing access to software products"[8], dated July 2022. Its initial price was about 6 million rubles. One application was submitted for the auction - from the Astrakhan-based company "5.25 Programs," which was recognized as the winner. The supply included antiviruses, cryptographic information protection tools, etc.

In Rosaviation

At some point in 2022, Matyushkin ended up in the Federal Air Transport Agency, formally not yet leaving the Marine Rescue Service. The verdict says that "in agreement with the head of the digital transformation and support department of the Federal Air Transport Agency, without registration of labor relations," he began to replace the post of deputy head of this department.

After gaining access to the planned purchases of the Federal Air Transport Agency, Matyushkin suggested that a company representative assist in ensuring participation and winning in the purchase of domestic software for a monetary reward of 10% of the amount of the concluded state contract.

The name of this company and the name of the representative are not given in the verdict. But on the official portal of public procurement for November 2022 there is a purchase of the Federal Air Transport Agency with the subject "Purchase of Russian software" with an initial price of about 21 million rubles[9].

The same initial price of the contract for the purchase of Russian software for the Federal Air Transport Agency appears in the verdict to Ivan Larionov, who at the time of the crime was a co-owner and director of the aforementioned company "5.25 Programs."

The case against Ivan Larionov was separated into a separate proceeding under Part 5 of Article 291 of the Criminal Code of the Russian Federation (bribery on an especially large scale). The Odintsovo City Court of the Moscow Region sentenced him a little earlier than Alexander Matyushkin, in September 2023[10].

Maxoft LLC was recognized as the winner in the aforementioned competition of the Federal Air Transport Agency. According to the verdict to Ivan Larionov[11], according to the license agreement concluded between IE Larionov IE and Maksoft, the latter was supplied by Larionov with software purchased from Red Soft. It was then delivered by Maksoft to the Federal Air Transport Agency as part of the execution of the state contract.

The verdict to Ivan Larionov also includes assistance from Matyushkin in ensuring the participation and winning of the company "5.25 Programs" in auctions of the Federal Air Transport Agency for the supply of technical means of information protection.

The amounts of bribes and the names of the persons from whom they were received are hidden in the verdict to Alexander Matyushkin. However, the verdict to Ivan Larionov indicates the amount of 4.45 million rubles taken from his personal funds as a bribe to the deputy head of the digital transformation and support department of the Federal Air Transport Agency for assistance in ensuring the participation and winning of the "5.25 Program" in auctions for the supply of technical means of information protection and the purchase of Russian software for the needs of the Federal Air Transport Agency.

The verdict to Alexander Matyushkin mentions that the money transferred to him as a bribe in one of the corruption episodes for which he was tried was packed in a polymer bag "together with souvenirs and vacuum-packed wobbles." Wobla is listed as one of the physical evidence. The court ordered her to be destroyed upon the entry into force of the sentence.

It is noteworthy that when Matyushkin had already officially resigned from the post of head of the information department of the Marine Rescue Service, by order of the head of the Federal Air Transport Agency, he was first appointed to the post of deputy head of the department for regulating freight transportation and dangerous goods of the department for traffic regulation and international cooperation. At the same time, "in agreement with the head of the digital transformation and support department of the Federal Air Transport Agency T.A. Kocherova," he continued to act as deputy head of the digital transformation and support department of the Federal Air Transport Agency, the verdict says.

Kocherova T.A. at that time was also a relatively new person in her post - she was appointed head of the digital transformation and support department in July 2022.

Later, by order of the head of the Federal Air Transport Agency, Matyushkin was appointed to the post of deputy head of the department for digital transformation and support of the department.

Sentence

Separately, for four episodes of crimes, the court sentenced Alexander Matyushkina to imprisonment for a period of 1 year 6 months, 2 years 5 months, 2 years 6 months and 3 years 6 months with deprivation of the right to hold positions in the civil service and in local authorities for different periods of time related to the exercise of organizational, administrative or administrative powers.

But according to the totality of the crimes, "by partial addition of punishments" imposed for each of them, the court sentenced Alexander Matyushkin to imprisonment for a period of 5 years in a maximum security penal colony. He was also deprived of the right to hold positions in the civil service and in local self-government bodies related to the exercise of organizational, administrative or administrative powers for 7 years.

The time of Matyushkin's detention until the sentence comes into force at the rate of one day for one day of imprisonment and the time of detention under house arrest at the rate of two days for one day of imprisonment is counted in the sentence.

Matyushkin entered into a pre-trial agreement, and the case was considered in a special order. When sentencing, the court took into account a number of circumstances mitigating Matyushkin's punishment for each of the crimes, including full recognition of his guilt and repentance for his deed, active assistance to the investigation of the crime, etc.

According to TAdviser, shortly after his arrest, December 31, 2022, Alexander Matyushkin was dismissed from his previous post.

As for Ivan Larionov, the court sentenced him to imprisonment for a period of 4 years conditionally with a probationary period of 3 years, taking into account a number of mitigating circumstances. Like Matyushkin, a pre-trial cooperation agreement was concluded with Larionov, and his case was also considered in a special order. He actively contributed to the disclosure and investigation of crimes and the exposure of other participants.

According to the database of legal entities Kontur.Fokus, "since February 2023 Larionov has no longer been a member of the founders of the" 5.25 Program, "and this company now has a different director.

From the verdict to Alexander Matyushkin it follows that as of October 2023, there was still an investigation into the criminal case against other persons.
