2024: Arrest on fraud charges

On December 3, 2024, the Dorogomilovsky Court of Moscow sent Vyacheslav Smirnov, the former general director of the federal state unitary enterprise (FSUE) ProtectionInfoTrans, to the pre-trial detention center. He appears in the criminal case against the ex-deputy head of the Ministry of Transport RFAlexey Semenov.

It is reported that Smirnov was charged under Part 4 of Art. 159 of the Criminal Code of the Russian Federation - fraud committed by an organized group or on an especially large scale. Such acts are punishable by imprisonment for up to 10 years with a fine of up to one million rubles or in the amount of the convict's salary or other income for a period of up to three years.

Details of the case as of the date of Smirnov's arrest have not been officially disclosed. It is known that on November 29, 2024, Semenov was sent to the pre-trial detention center, who is also charged with fraud on an especially large scale. As TAdviser discovered in April 2025, in one of the appeals decisions of the Moscow City Court, issued on the complaints of a lawyer for a chosen measure of restraint for the ex-general director of FSUE ProtectionInfoTrans Vyacheslav Smirnov, the circumstances of the criminal case are summarized, in which he himself was arrested, as well as the former Deputy Minister of Transport Alexei Semenov.

In a copy of the appeal decision published[2] in the database of courts of general jurisdiction of Moscow, it is said, in particular, that in the framework of the criminal case initiated on November 26, 2024, the circumstances of embezzlement of budget funds allocated in the period from 2014 to 2022 are investigated to ensure the functioning, technical and service maintenance of the equipment included in the system for collecting the results of technical monitoring and control (SS TMK). A state contract was concluded between the Ministry of Transport and FSUE ProtectionInfoTrans, involving its creation.

It follows from the same document that the materials of the criminal case recorded the testimony of witnesses claiming that this system was allegedly not used for the purposes and tasks for which it was created, while funds were allocated for its functioning. The witnesses in the case are employees of FSUE ProtectionInfoTrans, where Vyacheslav Smirnov worked during the events investigated in this case.

He was detained after questioning a number of witnesses who reported that the contract for the creation of the TMK SS system provided for the purchase of licenses for IBM products.

From the same document in the part where the position of the lawyer is given, it follows that Vyacheslav Smirnov does not admit guilt in what he is accused of. Immediately at the time of his arrest, he denied any involvement in "embezzlement of funds allocated for the purchase of IBM licenses, their renewal and subsequent maintenance."

In 2017, according to the results of the audit, the Accounts Chamber had comments related to the costs of systems for government contracts with FSUE ProtectionInfoTrans. So, for example, the auditors then came to the conclusion that the cost of individual licenses and products transferred to the Ministry of Transport as part of the work on the creation of SS TMK exceeded the cost of their acquisition by FSUE ProtectionInfoTrans by two or more times[3]

It is worth noting that at first the appeals of Alexei Semyonov and Vyacheslav Smirnov to the preventive measure he chose were considered separately, and in February 2025, together, within the framework of one court session[4].

As of April, the criminal investigation continues. According to the information in the database of courts of general jurisdiction of Moscow, earlier the term of the investigation was extended until April 26, 2025.
