2022: In the Saratov clinic, the patient died after esophageal damage with fibrogastroduodenoscopy

On November 9, 2022, the Investigation Department of the Investigative Committee of the Russian Federation announced the completion of the investigation of a criminal case opened against a medical worker under Part 2 of Art. 109 of the Criminal Code of the Russian Federation (causing death by negligence due to improper performance by a person of his professional duties).

The investigation established that on January 24, 2021, during the period from 09 hours 00 minutes to 12 hours 39 minutes, an endoscopist at a commercial clinic in Saratov, while performing medical manipulation, fibrogastroduodenoscopy (examination of the esophagus, stomach and duodenum using a flexible probe with a video camera) improperly fulfilled its professional duties, which resulted in the death of the patient a few days later.

After the forensic medical examination, the doctor's actions revealed a defect in the provision of medical care during the conduct, which consists in a direct causal relationship with an unfavorable outcome, expressed in the onset of the death of the victim.

The endoscopic doctor will appear in court, he faces up to three years in prison. Criminal case under Part 2 of Art. 109 of the Criminal Code of the Russian Federation sent to the Zavodskoy District Court. The name of the medical institution in which the medical procedure was carried out is not reported, as is the name of the accused doctor.^[1]
