2019

SAP seized from ABC Consulting 22 million rubles for overdue partner installment and cloud services

In October, 2019 the Arbitration court of Moscow made the positive decision on the claim of SAP CIS to ABC Consulting. In it the Russian office of the German software developer required from the partner to pay the amount about 22 million rubles including overdue payment for the rendered services and percent.

Follows from the published court's decision that SAP rendered to ABC Consulting services in the agreement within the affiliate program of PartnerEdge which is initially signed in 2008. In 2013 the program included a portfolio of cloud services of SAP, and with the same year the additional agreement on On Demand services was signed with ABC Consulting (on demand).

Claims at SAP CIS arose because ABC Consulting did not pay annual partner contributions for 2016-2018 and services of SAP Cloud Service for end users for the total amount of 18.4 million rubles.

According to court, the pre-judicial order of the dispute resolution was observed by the parties. However ABC Consulting of the requirement of the claimant did not perform, the claim is left without answer.

The court directed to pay ABC Consulting the amount required SAP CIS and interests in the amount of 3.76 million rubles.

SAP CIS preferred not to comment on trial with the partner. In Norbita (the company in structure in Lanit Group) where ABC Consulting in 2019 entered as new division, told TAdviser that the parties conduct negotiations on peaceful completion of a dispute and hope to reach the settlement agreement in the nearest future.

Entry into NORBIT

On October 16, 2019 the NORBIT company (enters into LANIT group) announced TAdviser completion of process of consolidation with ABC Consulting – the company specializing in personnel consulting, implementation, support and development of personnel management systems based on SAP SuccessFactors. The company was included into staff of NORBIT as division.

The owner of Lanit Philip Gens possesses 40% of ABC Consulting since January, 2018. Other shares are distributed as follows:

• 24.5% - Ryabov Maxim Yuryevich, the CEO of ABC Consulting
• 24.5% Engelgardt Mikhail Kirillovich, partner of ABC Consulting
• 6% - Smykov Tikhon Demidovich, the CEO of Inventive Retail Group president on business concerns of Lanit group
• 5% - Sitnikov Denis Viktorovich, the vice president for investments of Lanit group.

Behind ABC Consulting shoulders a considerable part of all SAP implementations of SuccessFactors in Russia and the CIS.
