History

2025: Known since the 90s, ARBYTE computers have been at the center of a dispute. Proceedings began due to trademarks

As TAdviser discovered, in December 2025, the manufacturer of computer equipment, Arbait LLC, filed Intellectual Rights Court a lawsuit Ilya Shinkaru[2]former chairman of the board of directors of Arbait Group JSC, which is the founder of Arbait LLC, as well as the City Arbitration Court Moscow with a lawsuit "Bytes"[3] LLC[4] about this is reflected in the open system "Electronic Justice." We are talking about claims regarding exclusive rights to the corporate name "Arbyte" and the use of trademarks "ARBYTE "/ARBYTE. As of the end of December, both lawsuits have already been accepted for proceedings and dates have been set for the first court hearings.

The appeal of Arbait LLC to the court was preceded by the distribution of a press release by Byte LLC stating that their company, positioned as a manufacturer and supplier of equipment and IT solutions, has become the "new copyright holder" of the ARBYTE trademark, and since 2025 its own production[5] equipment under this trademark has been launched[6].

The company is actively investing in research and development, and the ARBYTE trademark will be used to expand the range of products and services offered by Byte LLC, the statement said.

Among the company's competencies on the corporate website of Byte LLC, located at ar-byte.ru, is now given, among other things, "production of high-quality products of the ARBYTE® trademark." At the same time, at the same time, at the end of October, the company also posted a statement stating that allegedly "all goods manufactured or sold by Arbait LLC with the label ARBYTE/ARBYTE have signs of counterfeit products, since they are produced without the permission of the copyright holder"[7].

It is worth noting that the trademark is "tracing paper" from the English term trademark. In fact, this is a synonym for a trademark, but it is not enshrined in Russian legislation. In turn, the legal concept of a trademark is present in the Civil Code of the Russian Federation: this designation is a way to individualize the goods and services of a person to whom the exclusive right belongs.

According to the database of legal entities Kontur.Fokus, "LLC" Bayt "was formed in 2013. The only founder of the company as of 2025 is Ilya Luzhnyak. The revenue of Byte LLC in 2024 amounted to about 1.229 billion rubles, net profit - about 36.8 million rubles. The company is quite actively involved, including in public procurement of computer equipment. An analysis of participation in open tenders shows that among its largest state customers in terms of the volume of contracts: the Financial University under the Government of the Russian Federation, the Agency for Ensuring the Functioning of the Education System of the Yaroslavl Region, the Ministry of Education of the Omsk Region, the Ministry of Education of the Krasnoyarsk Territory, etc.

The ARBYTE technique has been presented and known on the market since the 90s. And in the database of legal entities Kontur.Focus "in the card of LLC" Arbait "is a record of the formation of the company in its original hypostasis in 1994. The revenue of Arbait LLC, according to the same database, in 2024 amounted to about 3.6 billion rubles, net profit - 161.3 million rubles.

The website of Arbait LLC contains data that for more than 30 years over 1,000 companies and organizations of Russia and the CIS countries have automated various aspects of their activities using hardware and software solutions ARBYTE. Among the customers are mechanical engineering companies, heavy industry, banks, financial groups, trade and production holdings, state-owned enterprises, research organizations, universities. The presence of solutions in the Russian Federation and in the CIS countries is carried out through a partner network.

Byte LLC refers to the open register of FIPS, where the ARBAIT/ARBYTE trademarks (certificates No. 208417, 349511, 770979) are registered in the Russian Federation for Ilya Shinkar. According to the FIPS register, in particular, trademark[8] has been listed by Ilya Shinkar since April 2023 after the transfer of exclusive rights to him by another individual - Dmitry Savchenko. And this trademark was previously transferred to Dmitry Savchenko from the company Arbait Computers CJSC. The latter was formed in 1995 and in 2019 was excluded from the Unified State Register of Legal Entities as an inactive legal entity. It is noteworthy that the postal address by trademark when transferring the rights to it to Ilya Shinkar in the FIPS register is the postal address of Arbait LLC.

The situation with trademark[9] looks similar in the FIPS register. And the trademark[10] was originally, since 2019, registered with Dmitry Savchenko and in 2023 passed to Ilya Shinkar. In this case, the address of Arbait LLC on Varshavskoye Shosse in Moscow is also indicated in the FIPS register for a postal message.

In addition, later, in July 2025, another application was received, No. 2025775023, for the registration of the ARBYTE trademark not just in the form of text, but with a logo, which as of 2025 is present on the corporate website of Arbyte LLC[11]. The applicant in this application published in the FIPS register is hidden, but Ilya Shinkar is mentioned in the address for the mail message.

Dmitry Savchenko, indicated in the certificates from the FIPS register, is known for the Sinto IT company, which was founded in Yaroslavl in 2005. Open sources reflect the history of close cooperation between Arbait and Cinto. For some time, the description of the Arbait company on public resources indicated that it has been "organizationally" included in the Cinto Group of Companies since 2015. At the end of 2025, there is no such entry on the Arbait corporate website. But on the Cinto website, the ARBYTE[12] products continue to be presented in the solutions catalog] and a corporate presentation from 2017 is available, which, among other things, contains the history of ARBYTE since the 90s[13]

According to the database of legal entities Kontur.Fokus, "Dmitry Savchenko was previously directly at the founders and general director of Shinto LLC. Ilya Shinkar was previously listed in the same company: since 2016, he has held the position of commercial director at Cinto, and since 2019 - manager. As of December 2025, "Cinto" has the only founder - JSC "Center," and the management company is listed as LLC "UK Trust" based in Yaroslavl. Dmitry Savchenko, according to the Unified State Register of Legal Entities, is a co-founder of a number of legal entities, including UK Trust LLC, where Ilya Shinkar, who heads UK Trust LLC as a director, has also owned a share in the authorized capital since 2023.

Returning to the already registered trademarks, Bayt LLC told TAdviser that they have the right to use them legally, referring to the corresponding current agreement with the copyright holder, Ilya Shinkar (IP Shinkar I.A.).

At the same time, as you can see, the story with Byte LLC and trademarks did not unfold immediately after the transfer of rights to them to Ilya Shinkar in 2023. This was preceded by the emergence of some disagreements at the top level of Arbait and the holding of the board of directors of Arbait Group JSC in 2025 by a court decision issued in August. The main owners of Arbait Group JSC then demanded a change of leadership and appealed to the Moscow Arbitration Court with a request to oblige the company's management to hold an extraordinary meeting of shareholders with the main issue on the agenda - early termination of the powers of the current board of directors and the election of a new composition[14]. As a result, Ilya Shinkar ceased to be the chairman of the board of directors of the company. And in the company LLC "Byte," according to TAdviser, there are immigrants from "Arbait."

Before filing lawsuits in court, as TAdviser was told in Arbait LLC, in November 2025, a claim letter was sent on behalf of their company to Byte LLC. It set out the position regarding the current situation. Thus, legal representatives of Arbait LLC refer to the fact that, in accordance with Art. 1473 of the Civil Code of the Russian Federation, a legal entity, which is a commercial organization, acts in civil circulation under its corporate name, which is determined in its constituent documents and is included in the Unified State Register of Legal Entities. The latter, in accordance with the same article of the Civil Code of the Russian Federation, has the exclusive right to use its corporate name as a means of individualization in any way that does not contradict the law, including in advertisements and advertisements, on goods or their packages. The exclusive right to the corporate name arises from the moment of its inclusion in the Unified State Register of Legal Entities. Arbait LLC believes that the exclusive right to the corporate name arose back in 1994.

In a claim letter to Byte LLC, representatives of Arbait LLC demanded, among other things, to remove from the opponent's website statements about the signs of "counterfeit products" in relation to its goods and stop using the domain name ar-byte.ru. The latter, according to the Reg.ru domain database, was registered in April 2025.

Now Arbait LLC is ready to defend its position in the courts. Dmitry Poznyakov, who has been the general director of Arbait LLC since October 2025, told TAdviser that their company has already taken actions to protect its exclusive right to the corporate name and intends to challenge the registration of trademarks. The company is also interested in "eliminating any misleading of consumers." "We are for fair competition," he added.

Answering a question from TAdviser why trademarks were not previously registered to their company, Dmitry Poznyakov said that this was not necessary, since "there is a right to a corporate name, there is a reputation and recognition in the market."

In a letter to partners in this regard, Arbait LLC also emphasized that the presence of trademarks is not a duty, but the right of the company, and that the law does not oblige to register trademarks. At the same time, the company in October submitted to Rospatent a number of applications for trademarks reproducing the distinctive part of the corporate name.

According to information from Arbait LLC, in addition to the claim letter to the management of Byte LLC, a notice was also sent earlier about the refusal of the agreement on the transfer of the right to use technical documentation to Arbait LLC, concluded under the previous management of Arbait Group JSC.

As of the end of 2025, in addition to the already mentioned, other claims from Arbait LLC with different requirements were registered in the Electronic Justice system, including those filed with its former general director and Sinto LLC.

Byte LLC declined to answer additional TAdviser questions regarding the trademark topic.

TAdviser plans to monitor the progress of relevant litigation.
