History
2023: Declared bankrupt by the Supreme Court of the Russian Federation
The Supreme Court of the Russian Federation upheld the bankruptcy of a large elevator manufacturer, the Karacharovsky Mechanical Plant, denying the former general director of the enterprise, Marat Tokhtiev, a complaint.
As Interfax reports with reference to the definition of the RF Armed Forces, "the grounds for reviewing the case" based on the results of the study of judicial acts and the arguments of the cassation appeal have not been established[1]
2022
On March 1, 2022, it became known that the Moscow Arbitration Court again declared the Karacharovsky Mechanical Plant bankrupt and opened a bankruptcy proceedings against it.
2021
The Moscow Arbitration Court on February 15, 2021, at the request of Vozrozhdenie, introduced a monitoring procedure for the plant, approved Alexander Ruzin as interim manager and included the bank's demand in the amount of 157.2 million rubles in the register of creditors. The Court of Appeal on April 28, 2021 upheld the decision.
On June 15, 2021, Vozrozhdenie Bank terminated the activities of the legal entity by reorganization in the form of accession to BM-Bank JSC, which from the date of reorganization becomes the successor of Vozrozhdenie "for all obligations against all its creditors and debtors, including obligations disputed by the parties."
2019-2020
A statement by Vozrozhdenie Bank about the bankruptcy of the Karacharovsky Mechanical Plant was filed with the court in July 2019. The court decided to leave it without consideration, citing the fact that the debtor enterprise is included in the list of backbone enterprises in the heavy engineering industry, the bankruptcy of which due to the COVID-19 pandemic has a moratorium.
The Ninth Arbitration Court of Appeal subsequently overturned the ruling of the Metropolitan Arbitration Court, stating that the moratorium is valid only in cases where the bankruptcy application is not accepted for proceedings before the moratorium is declared. In this case, a bankruptcy case was initiated back in 2019, and a moratorium was introduced in April 2020, the court of appeal noted. He sent the case for a new trial to the first instance. The cassation instance agreed with this approach in December 2020.
