2022: Searches and criminal case of embezzlement of $50 million from Rusnano's daughter

Security officials on October 18, 2022 raided Oleg Dyachenko, a former member of the board of directors of the Cyprus-based Nanoenergo Fund Limited. Employees of the FSB and the Ministry of Internal Affairs took part in operational events. A source familiar with the case materials told Vedomosti about this. The information was confirmed by an interlocutor close to the Ministry of Internal Affairs, as well as an official representative of Rusnano. A criminal case was initiated against Dyachenko under Part 4 of Art. 160 of the Criminal Code (theft of someone else's property entrusted to the culprit, committed by a group of persons by prior conspiracy, by a person using his official position, on an especially large scale).

According to the interlocutors, the investigation suspects Dyachenko of embezzling $50 million from Rusnano's Luxembourg subsidiary, Fonds Rusnano Capital S.A., which was the co-founder of the Nanoenergo fund. Sberezheniya and Investiii Management Limited (a subsidiary of ZAO UK Sberinvest), where Dyachenko served as director, managed this fund.

In relation to Dyachenko, a preventive measure was chosen in the form of a recognizance not to leave, the interlocutors specified.

Nanoenergo's funds in the amount of $90 million were transferred through accounts opened at AKB Relight"" Bank of Cyprus and in violation of the foundation's constituent documents to the accounts of Composite Pipes OJSC, Rice High Technologies LLC, Sarmat LLC, Hydropower Technologies LLC and Coal Innovative Technologies LLC, a Rusnano representative said.

"The Rusnano team continues to work on the return of investments and compensation for damage caused to the company during the period of investment 2010-2020. The work is carried out in close cooperation with the FSB, the Ministry of Internal Affairs, the General Prosecutor's Office and other relevant ministries and departments," - said the representative of the company.

In addition to the situation with Dyachenko, Rusnano is taking active actions aimed at collecting funds from the participants in the transaction, including Bank of Cyprus as part of a civil process in Cyprus, the source added. "At present, the trial is at the stage of the evidence disclosure procedure, which should be completed in October 2022. After that, the court must appoint a meeting in order to determine the timing of the hearings on the merits and other procedural issues," the Rusnano representative assured.

Quotes

"The segment of Russian commercial data centers (already growing intensively) over the past couple of months of early 2014 showed an unprecedented jump. In my opinion, this is due to the flow to Russian data centers of companies that previously submitted accounting and corporate systems to foreign data centers for reasons of economy and security. But today the situation has changed. Western sanctions against Russia and the fight against offshore companies have led to risks of closing Western data centers for Russian companies. If this happens, companies could dramatically lose access to the most important commercial information and reporting. Everybody understands that. Today's events just made the situation obvious. In fact, the use of Western data centers by Russian companies has compromised their commercial security before. It is not known where the servers are actually located and who has access to them, for Russian clients of Western data centers there are no guarantees and liability within the framework of Russian legislation.
