2013 - 2015: Criminal case

In June 2013, the prosecutor's office reported on the establishment of a criminal case against the chairman of the RSO-Alania committee on communications and information technology Soslan Dzansolov, suspecting him of abuse of office, as well as the general director of Macrobit, Aslanbek Mairamukaev. The latter, in particular, was charged with a crime under Part 3 of Art. 159.4 of the Criminal Code of the Russian Federation (fraud in the field of entrepreneurial activity, committed on an especially large scale).

As law enforcement agencies then stated, Mairamukaev stole more than 11 million rubles. when fulfilling a state contract with the IT Committee of the RSO-Alania for the development of electronic services. For about this amount in December 2012, the committee concluded four state contracts with Macrobit as part of the implementation of the republican target program "Development of the information society in the republic for 2012-2014."

Under the terms of these contracts, Macrobit was supposed to develop electronic services for sending requests when providing 59 state services by local government agencies, as well as 40 electronic services for sending information at the disposal of state bodies and local governments of North Ossetia. The Committee signed acts of acceptance of the work performed, on the basis of which Macrobit transferred funds. At the same time, according to the Ministry of Telecom and Mass Communications, in the republic for test and productive operation, the committee registered only 4 electronic services.

At the end of 2013, the general director of Macrobit appealed to the public reception office of the commissioner under the head of the RSO-Alania for the protection of the rights of entrepreneurs, asking human rights defenders to take measures against the actions of law enforcement agencies of the RSO-Alania, which, according to Aslanbek Mayramukaev, illegally opened a criminal case against him.

"The works were performed by me within the prescribed ten-day period. The work was accepted by the customer, about which an act of acceptance was drawn up. However, the investigation, without establishing the fact of the service provided by me, believes that the work was not completed by me and the money was stolen, which is not true. I ask you to take measures, "- said in the appeal of Aslanbek Mairamukaev

Following the discussion, the expert group sent an address letter to the Presidential Commissioner for the Protection of the Rights of Entrepreneurs, as well as to the Prosecutor's Office of the RSO-Alania with a request to check the facts set out in the applicant's appeal and assess the current situation.

In January 2015, the Commissioner for the Protection of the Rights of Entrepreneurs in RSO-Alania announced that the criminal case against the general director of Macrobit was terminated.

"For the period of the investigation, all equipment was seized, information about the initiation of a criminal case against its head was published on the websites of official departments and the media. These actions caused not only harm to business reputation, but also to the activities of a small business entity, "the Commissioner for the Protection of the Rights of Entrepreneurs in RSO-Alania said in a statement

At the same time, there were no official reports on the fate of the criminal case against the chairman of the RSO-Alania committee on communications and information technology.

2023

Arrest in the case of public procurement at inflated prices

In early August 2023, the Samara Zheleznodorozhny District Court arrested Aslanbek Mairamukaev, Deputy Minister of Health of the Samara Region, for a month, who is accused of fraud by an organized group or on an especially large scale (part 4 of article 159 of the Criminal Code of the Russian Federation two episodes).

The defender of Mayramukaev Andrei Karnomazov told Kommersant about the election of such a preventive measure. At the same time, he provided additional information. According to the newspaper, Aslanbek Mairamukaev was detained on August 3, 2023. As the press service of the regional headquarters clarified then, the investigation in the regional Ministry of Health is connected with the criminal case of the deputy chief physician of one of the hospitals.

Kommersant writes that we are talking about the criminal case of the former deputy chief physician of the Samara Regional Hospital named after Seredavin Alexei Oshurkov. He entered into government contracts with Diel at an inflated price (more than 50% higher than the market price), the investigation said. A criminal case has been initiated against Alexei Oshkurkov under Part 4 of Art. 159 of the Criminal Code of the Russian Federation (fraud).

In early August 2023, the deputy head of the Duma Committee on Andrei Lugovoi Security said that for two years he appealed to the prosecutor's office with requests to investigate corruption schemes in which the leaders of the Samara Ministry of Health were allegedly involved. He called the department's staff a "medical cartel" and said the scheme was based on fraud in the supply of medical equipment, medicines and supplies. Entire medical clans, both from government agencies and from business, participated in the chain of embezzlement of budget funds and deception in procurement, Lugovoy said. Another deputy, Alexander Khinshtein, in August 2023 also announced "an unprecedented level of corruption in the leadership of the Samara region."[1]

Charge of taking a bribe of 15 million rubles

The Investigative Department of the TFR in the Samara Region opened a new criminal case against the regional deputy minister of health - the head of the department of pharmacy "of medical equipment and logistics Aslanbek Mairamukaev. We are talking about the commission of a crime under Part 6 of Art. 290 of the Criminal Code of the Russian Federation (taking a bribe on an especially large scale). The press service of the department announced this on August 24, 2023.

According to investigators, in 2022, Aslanbek Mayramukaev demanded that the director of the organization transfer a bribe to him in the amount of 15 million for organizing the conclusion of contracts for the supply of medical equipment totaling more than 147 million rubles.

In 2023, the director of this organization, acting within the framework of a previously reached agreement, handed over to the suspect through a third party part of the bribe in the amount of 8 million.

Then, in the summer of 2023, the director of the organization, acting already within the framework of the operational-search measure "Operational Experiment," taking the conspiracy measures proposed by the suspects, handed him the rest of the bribe in the amount of 7 million rubles through other persons.

By the end of August 2024, investigative actions aimed at establishing all the circumstances of the crime are being carried out in the criminal case. The progress and results of the investigation of the criminal case are under the control of the head of the Investigation Department, reported in the TFR in the Samara region.

Aslanbek Mairamukaev's lawyer Andrei Karnomazov told Kommersant that he had not received any official information on the new case: "I don't know who the investigator is. No one called, called, interrogated or presented. It fell like snow on its head today [August 24, 2023[2]

2024: Sentence - 9.5 years in a maximum security colony

On July 2, 2024, the Oktyabrsky District Court of Samara sentenced the former Deputy Minister of Health of the Samara Region Aslanbek Mairamukaev, sentencing him to 9.5 years in prison in a maximum security colony for receiving a bribe on an especially large scale.

According to TASS, in addition to imprisonment, the ex-official was fined 45 million rubles in state income. The Investigation Department of the Investigative Committee for the Samara Region reported that the court found Aslanbek Mairamukaev guilty of receiving a bribe from the director of DM-Group in the amount of 15 million rubles.

The prosecutor's office of the Samara region found that in the period from January to August 2023, the former deputy minister of health received illegal remuneration for patronage and assistance in concluding state contracts for the supply of medical equipment.

The investigation found out that in 2022 Aslanbek Mayramukaev demanded a bribe of 15 million rubles from the director of the organization for concluding contracts for the supply of medical equipment totaling more than 147 million rubles. In 2023, the director of the company transferred 8 million rubles to the official through an intermediary.

The remaining part of the bribe in the amount of 7 million rubles was transferred in the summer of 2023 as part of the operational-search measure "Operational Experiment." After that, on August 4, 2023, Aslanbek Mairamukaev was arrested.

According to part 6 of article 290 of the Criminal Code of Russia, the court sentenced the convict to 9 years and 6 months in prison with serving a sentence in a maximum security penal colony, as well as a fine of 45 million rubles in state income, the Investigation Department of the Investigative Committee for the Samara Region reported.[3]
