FSSP on TAdviser SummIT: Police officers began to pursue debtors in electronic form

The head of department of information technologies of the Federal Bailiff Service (FBS)Natalya Zvyagina, speaking at the TAdviser SummIT conference on May 31, 2016, told about perspectives of transition to forced execution in electronic form. She noted that she in this direction of FSSP works since 2009. It covers electronic document management in department, transition to electronic interdepartmental interaction, rendering state services and ensuring openness of FSSP.

Natalya Zvyagina explained that work of the court bailiff is in accepting the executive document, to request information on a property status of the debtor, to impose penalty then to collect and end enforcement proceeding.

At the first stage of this process there is an interaction to the bodies issuing documents such as courts,Ministry of Internal Affairs,FTS. Powers issue executive documents have in total 33 departments. On the next stage – at information requests about property – there is an interaction to banks,Rosreestr,traffic police, etc. When collecting there is an address, besides, to banks, registering bodies which impose ban on a property re-registration. At the same time at all stages the police officer should notify all parties of enforcement proceeding, turning on individuals.

Regarding transition to interdepartmental electronic document management as of the end of May the project is in a completion stage, necessary software products both at the level of departments of court ushers, and at the level of regions, and central office are implemented. Work on that instructions "on top" reached at once a local link is conducted. Until the end of 2016 this process is going to be debugged.

Normative and legal fixing of opportunities of obtaining electronic executive documents and pronouncement of electronic resolutions of the court usher and the unified formats of such documents became important achievement in 2014-2015, according to Zvyagina.

In 2015 the FSSP was adjusted by electronic document management on requests of court bailiffs and answers to them with several tens banks, including – through SIEI, electronic document management under resolutions of the court bailiff – with 13 banks, on obtaining by bank information on the course of enforcement proceeding – with 4 banks.

For 2015 60% of all enforcement proceedings are ended by electronic cash write-off in banks. The amount of the collected penalties for this period grew by 55%. The total quantity of the enforcement proceedings ended by the actual execution in comparison with the same period of last year increased by 2 million Besides, due to implementation of interdepartmental electronic interaction and transition to forced execution in electronic form it was also succeeded to reduce corruption risks, Natalya Zvyagina noted.

One of the highlights influencing transition to forced execution in electronic form is the possibility of the direction of notifications in electronic form to the parties of enforcement proceeding and to the bodies issuing executive documents. In a year of FSSP it is required to send about 360 million notifications. At the same time the money allocated to department is enough only for departure of 30 million custom notifications in a year. It often causes discontent of citizens, property or accounts of which is seized.

Believe in FSSP that also creation of a personal account on the website of the department at the time of initiation of enforcement proceeding where it will be able to trace all production process will help to solve this problem. About excitation the custom notification will be sent. The FSSP considers of sales opportunity of such project.

The director of information technology of FSSP also touched on separate issues of transition to forced execution in electronic form. To like those it referred, for example, unavailability of bodies of executive and judicial authority to this transition, problems of administration of budget revenues and interaction with the state information system about the state and municipal payments (GIS GMP), lack of the unique identifier of charge (UIC) in executive documents of courts, lack of the identifier of the payer in executive documents.

Among problems also - long terms of document storage of enforcement proceeding after its end and there are not enough storage resources.

TAdviser SummIT which passed on May 31, 2016 was visited by more than 240 people – heads and experts of the commercial and state organizations. Within the action more than 30 reports were submitted. Among speakers – representatives of the Ministry of Telecom and Mass Communications, Sberbank,Pension fund,Federal Treasury,Helicopters of Russia, etc. In the foyer of the summit there took place the exhibition of the IT companies.
