2024: Creation of the federal system of biometric accounting of the Ministry of Internal Affairs on Elbrus processors led to a lawsuit
As TAdviser discovered in October 2024 NPO "STiS" of the Ministry of Internal Affairs of Russia , he won the court[1], in the appellate instance, over a company "Azimuth" that acted as the lead contractor in a major ROC project to create a ON federal biometric accounting information system (FISBU). The functional customer of the ROC was the GIAC of the Ministry of Internal Affairs of Russia.
The volume of the state contract between NPO STiS MINISTRY OF INTERNAL AFFAIRS Russia and Azimut, the conclusion of which dates back to July 2022, amounted to about 1.8 billion. rubles The dispute initially arose against the background of the fact that the NPO "STiS" of the Ministry of Internal Affairs of Russia was not satisfied with how the work on the first stage of the ROC was carried out. He refused to pay for them and unilaterally terminated the state contract with Azimuth, and also demanded to pay penalties in the amount of about 9.5 million rubles and a fine of about 5.4 million rubles. Azimut did not agree with this, filed a counterclaim, and in December 2023 the court of first instance ruled in his favor. For more on starting litigation, see the block below.
But in the appellate instance, the NPO "STiS" of the Ministry of Internal Affairs of Russia was able to challenge the decision of the higher court. From the decision of the Ninth Arbitration Court of Appeal, published in the Electronic Justice system, it follows that the results of a new examination, the conduct of which was appointed by the court, were submitted to this consideration of the case. According to the expert opinion, the contractor significantly violated the terms of the work under the contract. Firstly, the requirements of two GOST RVs in terms of the provision of reporting materials were violated, and the deadlines for performing work under the contract were repeatedly violated.
In addition, the result of the work on the first stage of the project does not meet the requirements of the contract and two appendices to it. In particular, the performance of the SPO biometric processor for fingerprinting "Sonda" AFIS Enterprise Edition 9.1 on Elbrus processors (VLIW architecture) has not been confirmed and the performance of the SPO biometric processor FindFace on Elbrus processors has not been confirmed. And a significant fatal drawback has also been identified - the impossibility of using the VisionLabs Luna Platform biometric processor for face recognition on Elbrus processors.
Moreover, the contractor has repeatedly informed the customer about the unenforceability of the requirement to implement the biometric processor architecture exclusively based on the VLIW architecture, presenting documentary evidence from the vendors-developers of biometric processors and from the developers of the Elbrus processor: according to them, there is no technical ability to implement a biometric search engine by face image on processors with VLIW architecture.
But from the conclusions of the expert "CECI" it follows that the risk of inability to obtain the expected results of the work was not timely communicated by the contractor to the customer. For the first time, the possible risk of non-fulfillment of the Azimut contract became known in early November 2022, but he informed the NPO STiS of the Ministry of Internal Affairs of Russia about this only seven months later.
The results of the forensic examination and the materials of the case confirmed the inconsistency of the work performed with the terms of the contract, which does not allow the NPO STiS of the Ministry of Internal Affairs of Russia to use the result of the controversial work for its intended purpose, that is, there is no consumer value for it, the court ruling said. Accordingly, the court considered the unilateral refusal of the NPO "STiS" of the Ministry of Internal Affairs of Russia from the execution of the contract legitimate.
The Ninth Arbitration Court of Appeal found that Azimut had violated its obligations, and came to the conclusion that there were grounds for satisfying the requirements of the initial claim of NPO STiS of the Ministry of Internal Affairs of Russia in full. The company was ordered to pay a fine and penalties.
Azimut, in turn, does not agree with this outcome and in October filed a cassation appeal against the decision of the Ninth Arbitration Court of Appeal. The company also filed a petition to suspend the execution of the judicial act, which ordered it to pay a fine and penalties, until the end of the proceedings in the court of cassation. The court granted this petition.
And that's not all. In addition to the requirement to pay fines and penalties to NPO STiS, the Ministry of Internal Affairs of Russia also tried to achieve Azimuth's entry into the register of unscrupulous suppliers. But the FAS in 2023 refused to do this, and the NPO STiS of the Ministry of Internal Affairs of Russia went through two courts to cancel the decision of the antimonopolists. In October 2024, the Ninth Arbitration Court of Appeal ruled on this issue - not in favor of the NPO STiS of the Ministry of Internal Affairs of Russia[2].
From this decision, published in the Electronic Justice system, it follows that the competition for the right to conclude a state contract for the implementation of the ROC to create the FISBU was held in a closed form as part of the state defense order.
TAdviser sent a request to the Ministry of Internal Affairs in order to find out the further fate of the FISBU ROC, but at the time of publication of the material did not receive comments.
2023: Beginning of proceedings between STiS of the Ministry of Internal Affairs and Azimuth
In August 2023, NPO STiS MINISTRY OF INTERNAL AFFAIRS Russia filed a Moscow lawsuit with the City Arbitration Court to recover penalties from Azimut JSC under a state contract dated July 28, 2022 in the amount of about 9.5 million rubles and a fine of 5.4 million rubles. In turn, Azimut JSC filed a counterclaim against the NPO STiS of the Ministry of Internal Affairs of Russia to recognize the decision to unilaterally refuse to fulfill this contract as invalid and to recover funds in the amount of about 51.7 million rubles - as much as Azimut estimated its costs for the first stage of OCD.
The full price of the first stage of OCD was about 90 million rubles. The customer refused to accept and pay for the result of this stage and unilaterally refused to execute the contract, arguing that the result was handed over with shortcomings and violation of deadlines, according to the decision of the Moscow Arbitration Court of December 12, 2023[3]. According to the terms of the contract, the customer was entitled to conduct an examination of the work performed and terminate the contract only if the results of the examination confirm the violations that served as the basis for a unilateral refusal.
Azimut submitted to the court the results of the examination of its work on the first stage, which confirmed the absence of violations on its part. For the examination, the companies "Aquarius" and "Software Product" were involved. And the court concluded that, in accordance with the terms of the concluded contract, the customer has no right to terminate the contract.
The decision of the Arbitration Court of the city of Moscow also states that the customer subsequently recognized the very fact and validity of the appeal for an expert opinion to the companies "Aquarius" and "Software Product." In particular, at meetings as part of the consideration of the case in the FAS Russia on the inclusion of Azimut in the register of unscrupulous suppliers, the customer confirmed that these companies were chosen by him and Azimut together, are independent and qualified.
By the decision of the Arbitration Court of the city of Moscow of December 21, 2023, the initial claim was denied, and the counterclaims were satisfied in full.

Ministry of Internal Affairs creates a bank of biometric data of Russians and foreigners
At the end of September 2021, it became known about the creation by the Ministry of Internal Affairs (Ministry of Internal Affairs) of the Russian Federation of a bank of biometric data of Russians and foreign citizens. The project is planned to be implemented by a maximum of 2023.

The Ministry of Internal Affairs believes that the system should combine the resources of fingerprint and phonoscopic information, DNA analysis laboratories, complexes of biometric identity identification and fixing the movement of vehicles, as well as verification systems for operational reference, search and forensic accounts.
The department also says that thanks to the bank of biometric data, it will be possible to conduct a procedure for identifying individuals and unidentified bodies using fingerprint information, face images, as well as genomic information by interacting with the combined search federal genetic identification system.
Earlier in 2021, it became known that the Ministry of Digital Development decided in two years to increase the number of collected biometric data of Russians by more than 400 times - from the current 164,000 to 70 million. The issue will be resolved by "administrative measures," including making some public services inaccessible without passing biometrics.
Ministry of Digital Development also developed a draft government decree that proposes to collect biometric data from car sharing and taxi drivers for their identification. Before that, the department proposed to limit the number of companies that can access the Unified Biometric System (EBS), and introduce selection criteria. According to the bill prepared by the department, companies with a share of foreign shareholders of no more than 49% who have a license and ownership of cryptographic encryption tools will be able to gain access to the biometrics of Russians.[4]

Creation of a federal biometric accounting information system
On November 22, 2020, it became known about the creation by the Ministry of Internal Affairs of the Russian Federation of a centralized bank of biometric data of Russians and foreigners. The new system will allow you to establish the identities of people from fingerprints and face images.
According to TASS in the press service of the Ministry of Internal Affairs, it is planned to create a federal information system of biometric accounting as part of development work within three years - until 2023. During this time, software will be developed that is necessary for maintaining and using a centralized data bank of biometric parameters of citizens of the Russian Federation, foreign citizens and stateless persons.
It is assumed that the technology will allow identification of identity, as well as unidentified bodies from fingerprint information, face image and genomic information. The development will interact with the combined search federal genetic identification system.
For the first time, the idea of creating a common information system with biometric data of citizens was expressed by Interior Minister Vladimir Kolokoltsev in 2014. Then he spoke about the need to combine the resources of fingerprint and phonoscopic information, laboratories of DNA analysis, complexes of biometric identity identification and recording the movement of vehicles.
In February 2020, the general director of the Russian Biometric Society Danila Nikolaev told RBC that the Ministry of Internal Affairs is preparing recognition of criminals not only by face, but also by voice, iris, tattoos and, possibly, gait. Then the ministry planned to introduce the system by the end of 2021, but did not specify where it would get a database with DNA analyzes of suspects. A RBC source said that the ministry asked for several billion rubles to develop the project.[5][6]
Recognizing criminals by iris, voice and tattoos
Moscow cameras will recognize criminals by the iris of the eye, voice and tattoos. Danila Nikolaev, General Director of the Russian Biometric Society, told RBC about the development of the corresponding system. The Ministry of Internal Affairs confirmed this information to the publication.

The Ministry of Internal Affairs also showed interest in recognizing the criminal by gait, but has not yet included this in the list of characteristics for FISBU, Nikolaev noted. A RBC source close to the Ministry of Internal Affairs said that the ministry is already testing various forms of recognition, in particular, by gait.
According to Danila Nikolaev, FISBU is planned to be integrated with other systems of the Ministry of Internal Affairs. For example, criminologists will collect all traces of the suspect (fingerprints, hair, saliva) at the crime scene and upload the data to the current system, if it finds matches, it will send the corresponding data to the cameras so that they find it.
The system is created as part of the Safe City program. Its creation will be financed from the budget of the capital, the approximate cost of the project is several billion rubles.
Alexey Kadeishvili, technical director of another Vokord facial recognition solution developer, says that human recognition systems do not allow producing an accurate result - it will only help narrow down the circle of suspects and find the most likely matches.
Body recognition is a promising area for additional identification of the suspect, said Dmitry Morozov, one of the founders of the 3DiVi development company.
Now video surveillance systems can understand the height and silhouette of a person by default, as an additional factor that works when the face is not visible, "he explained.[7] |
