The court arrested the property of the drug manufacturer "Marbiopharm"
On June 4, 2024, the Moscow Arbitration Court partially satisfied the application of the Penza Region Prosecutor's Office and arrested the movable and immovable property of Marbiofarm JSC. The decision was made in the framework of the bankruptcy case of JSC MPPDK Biotek, which owns 97.77% of Marbiopharma shares. Read more here.
Boris Spiegel sentenced to 11 years in strict regime for bribes
On January 25, 2024, the Izmailovsky Court of Moscow sentenced Boris Shpigel, former chairman of the board of directors of the Biotek group of companies, to 11 years in prison with a sentence in a maximum security prison. He was found guilty of giving a particularly large bribe (part 5 of article 291 of the Criminal Code). The entrepreneur did not admit his guilt. Read more here.
2023: Introduction of observation
In March 2023, the Moscow Arbitration Court introduced a monitoring procedure at Biotek. Among the creditors of one of the largest pharmaceutical holdings in the Russian Federation are Ellara, Promomed DM and Vostokinvestproekt, Bank St. Petersburg and Federal Tax Service Inspectorate No. 13 for the city of Moscow.
The court considered the claim of the supplier of drugs "Ellara" on the bankruptcy of "Biotek" from the end of October 2022. During this time, Promomed DM, IFNS No. 13, Vostokinvestproekt LLC, and St. Petersburg Bank entered the register of creditors.
Biotek's debt to Ellara, confirmed by the court, amounted to 15 million rubles, taking into account the penalty. At the end of 2022, this debt was bought by the Biopharm company, which in 2009-2015 belonged to Biotek.
The court proved the affiliation of Biotek and Biopharm, and the applicant does not refute this fact, this is indicated in the court's ruling on the replacement of the plaintiff. Such a replacement is possible, but in practice, companies affiliated with the debtor are not allowed to determine the candidacy of the arbitration manager, so the court has the right to do it itself "through random choice." Moreover, managers proposed by the court and an affiliated company should not be a single self-regulatory organization.
A petition for the procedural succession of Ellara to Biopharm was filed in December 2022, and a month earlier, key changes took place in the Biotek leadership. Instead of Yulia Boltneva, Oleg Chirkov was appointed president of the company, the management staff was replenished with the chairman of the board of directors Grigory Levitsky and the first vice-president of Biotek Sergey Guriev.

Ban on trade operations and transit of resources in Ukraine
In February 2021, Ukraine imposed sanctions against several Russian manufacturers of medical equipment and medicines. Among them are Biotek LLC, Pharmacist Plus JSC (Rostov pharmaceutical supplier), Hemojenix LLC (produces consumables for plasmapheresis and cytoplasmapheresis, as well as blood containers).
This is evidenced by the appendices to the decree of President of Ukraine Volodymyr Zelensky "On the application and introduction of amendments to personal special economic and other restrictive measures (sanctions)."
The sanctions imposed by the National Security and Defense Council (NSDC) of Ukraine, among other things, prohibit companies that fall under them from performing trade operations and transit of resources in Ukraine for three years. In addition, they canceled licenses and rights to intellectual property. They are also prohibited from withdrawing capital outside Ukraine.
Restrictive measures include a ban on transportation across the territory of Ukraine, suspension of the fulfillment of economic and financial obligations, a ban on the issuance of cash on cards of foreign countries.
The Ministry of Foreign Affairs of Ukraine was instructed to inform the competent authorities of the European Union, the United States and other states about the application of sanctions and raise the issue of introducing similar restrictive measures before them.
Hemojenix suggested that the imposition of sanctions against the company may be associated with the supply of products to the Crimea. Hemojenix does not cooperate with Ukrainian enterprises, so the sanctions will not affect the company's business, it said.
Earlier in Ukraine, several dozen types of Russian drugs were banned, including Gastropharm, Glycine, Immunofan, Panavir and Semax[2][3][4][5]
