2022: Eviction of the center from the premises in Orel at the request of residents
As it became known in early December 2022, the court evicted the Fresenius dialysis center from the premises in Orel at the request of residents. By decision of the Sovetsky District Court, the clinic is obliged to leave the premises, which it has been occupying since 2020.
According to the applicants and the court, Fresenius violated various building norms, while the company insists on inconsistencies in forensic examinations, is confident in compliance with all the rules and that the decision is biased, since the deputy chairman of the district court is one of the owners of a residential building.
The case "On bringing the premises to their original state" has been considered in court since 2020. The main claims of homeowners are that, in their opinion, the equipment and sewer system of the dialysis center are installed with violations of fire protection requirements, other building codes and regulations, and repair work led to damage to common property.
In addition, the statement stated that the placement on the ground floor of an apartment building of a medical organization conducting hemodialysis contradicts the "Temporary methodological recommendations for the placement, arrangement and equipment of High Medical Technology Centers" and the order of the Ministry of Health of the Russian Federation No. 254 of August 13, 2022 "On improving the organization of dialysis assistance to the population of the Russian Federation."
The final decision in favor of the plaintiffs was made in February 2022, later Fresenius repeatedly tried to unsuccessfully challenge it in an appeal to the regional court, and in November filed a cassation appeal - there is no decision on it yet.
Fresenius Nefrokea and two other defendants in the case - the owners of the premises where the clinic was located under the lease agreement - note in the complaints that all legislative norms were observed during the construction, except for this, the tenants had previously been refused (including in the appellate instance) to challenge the legality of the construction. Two examinations carried out in the case, the defendants believe, contradict each other, so another one must be carried out. In addition, the clinic drew attention to the fact that the deputy chairman of the Soviet District Court, where the case is taking place, is one of the owners of the house, so the decision must be canceled.[1]

Fresenius was not included in the 2017 list. The case is scheduled for August 1, 2017.
In addition to the Commission for the development of a territorial program of compulsory medical insurance, the court also attracted the government of the Omsk region as a co-defendant in the case. The territorial compulsory medical insurance TFCMI of the Omsk region and the regional Ministry of Health were involved in the case as third parties, according to the published court ruling.
The reason for the claim was the fact that the private dialysis center "Fresenius Medical Kea Omsk" did not receive volumes for the provision of medical care under the compulsory medical insurance program in a day hospital for 2017.
