Until recently, the ultimate owners of Gorbushkin Dvor were considered shareholders of Ugra Bank Alexei and Yuri Khotin. In June 2017, however, it became known about the sale of the shopping center to the shareholder of Pharmstandard Viktor Kharitonin. However, according to consultants who worked with both parties to the transaction, the de facto owners of the facility are still Khotina's father and son.

History

2024: Nationalization

On October 2, 2024, it became known that the Gorbushkin Dvor shopping center came under state control. The facility was nationalized in connection with the debts of Alexei Khotin, the former owner of the bankrupt bank Ugra.

The Gorbushkin Dvor shopping center with an area of about 60 thousand square meters is located next to the Bagrationovskaya metro station in Moscow. The owner of the object is JSC "Moscow Television Plant" Rubin "(MTZ), which is at the stage of bankruptcy. The shopping center traditionally specialized in the sale of household appliances and electronics. At the same time, MTZ Rubin is one of Khotin's assets.

According to Anton Filatov, chief real estate specialist of the Vedomosti newspaper, the Gorbushkin Dvor shopping center came under the control of the Federal Property Management Agency. In particular, the state-owned company Real Estate Management, owned by the department, announced a tender for the provision of services for MTZ Rubin. This, according to Filatov, confirms the transition of the object to state ownership. According to the public procurement website, as of the beginning of October 2024, Real Estate Management also manages the Sushchevsky business centers (10 thousand square meters) on Sushchevsky Val and Petrovsky (11.5 thousand square meters) on Nizhnaya Street.

The seizure of real estate in favor of the state is associated with compensation for damage in the case of the Rus-Oil oil company, also controlled by Khotin. Earlier, the Zamoskvoretsky court, at the suit of the Prosecutor General's Office, recovered from Khotin more than 192 billion rubles for tax evasion with the appeal to state income of shares and 100% of shares in the authorized capital of business entities included in the Rus-Oil group of companies. Then the transfer of the Four Seasons Hotel Moscow, the Fashion Season shopping gallery, the Cheryomushki shopping center and business center, and the Agat business center, owned by Khotin, began. 2023: Court orders demolition of third of "Gorbushky Dvor" space

The Moscow Arbitration Court partially satisfied the claim of the city mayor's office and the city property department (DGI) against MTZ Rubin JSC, which owns the Gorbushkin Dvor shopping center, to demolish unauthorized buildings. We are talking about the demolition of about a third of the area. This court decision became known on August 24, 2023.

As Kommersant writes with reference to the file cabinet of arbitration cases, the owner must demolish unauthorized buildings - 18 thousand square meters in the main building of the complex, part of the car wash for 1.2 thousand square meters and part of the parking lot for 1.3 thousand square meters. The court recognized the ownership rights of MTZ Rubin in these areas as absent.

A third of the areas of the "Gorbushky Dvor" can be demolished by a court decision

Now the city can demolish them, but the main creditor of the facility, Rosselkhozbank (RSHB), who initiated the bankruptcy of the owner of Gorbushchyny Dvor, MTZ Rubin, opposes. According to the bank, after reducing the area of the complex, the price of the asset may also decrease, which has negative consequences for the lender.

RSHB has a direct interest in satisfying financial claims, and the more space, according to Pavel Zhelnovod, partner of the law firm Nova Inc, "it will be possible to save, the more chances the bank will have for successful repayment of debt." The managing partner of RETEX Polina Zhilkina is confident that the market value of the object will be estimated based on the potential of the development, and not the area of the building. In 2017, the mayor's office allowed the construction of 383 thousand square meters. m of housing, of which 203 thousand square meters. m - on the site of the shopping center.

The tenants of Gorbushky Dvor, who are in the premises to be demolished, are unlikely to be able to recover losses from the owner of the facility, said Alexander Bolomatov, partner of the law firm YUST. If the tenants have not concluded lease agreements, then they will not be able to get a penalty, the head of Kuchembaev and Partners Almaz Kuchembaev summarizes.[2]
