Biography

Born December 5, 1967.

From August 1990 to November 1991 he worked in the Financial Department of the Executive Committee of the Krasnodar Regional Council of People's Deputies.

In 1991, he was appointed deputy head of the budget department of the Department for Finance, Budget and Control of the Krasnodar Territory.

Since February 1994, he worked as the head of the department for financing law enforcement agencies and the office of the Department for Finance, Budget and Control of the Krasnodar Territory.

Since May 1995, he replaced the post of Deputy Director General of the Department for Finance, Budget and Control of the Krasnodar Territory.

In April 2001, he was appointed head of the Federal Treasury Office for the Krasnodar Territory.

2010: Deputy Head of the Federal Treasury

Since October 2010, he was appointed Deputy Head of the Federal Treasury, responsible for the development and operation of information systems of the department.

Two information systems of the Federal Treasury - ASFK and Electronic Budget - were included in the list of the most expensive systems of the federal government prepared by TAdviser in 2016.

Expenses for the development and operation of ASFK in 2015 amounted to 3.2 billion rubles, in 2016 - 3.7 billion.

2017

Unexpected vacation with an open date

Since May 15, 2017, Sergei Guralnikov, according to TAdviser, has been "on vacation with an open date," i.e. without a certain date of return to work.

The vacation is unplanned - on May 10-11, Guralnikov invited his colleagues to come to Krasnodar and take part in the All-Russian meeting of the Treasury on the development of information systems, which takes place on May 17-19.

Sergei Guralnikov, according to the program, was supposed to act as the key speaker of the event on the first day and end the meeting on the third day. According to TAdviser, instead of him, the head of the information systems department of the Federal Treasury Valery Kansuzyan, appointed to this post in April 2017, was sent to speak in Krasnodar.

As of May 15, TAdviser sources found it difficult to say what Guralnikov's unexpected vacation was connected with. When asked if this could indicate the upcoming dismissal, one of the interlocutors said: "according to my information, everything is much worse."

Guralnikov's mobile phone was turned off from Friday, May 12. Messages sent to him in messengers, as of the end of the day on May 15, had the status of unread. In the reception, the official could not shed light on the situation.

Detention

On May 18, 2017, three TAdviser sources familiar with Guralnikov reported that the official had been detained by law enforcement. The detention, according to their information, took place on May 12.

One of the interlocutors heard that questions from law enforcement agencies could arise in connection with the affiliation between Guralnikov and some IT contractors of the Federal Treasury.

Requests sent by TAdviser to the Ministry of Internal Affairs, the UK and the FSB remained unanswered at the time of publication of the material. The official's reception is limited to information that he is on vacation. Guralnikov's mobile phone was turned on on May 18, but did not answer.

Two interlocutors of TAdviser also at the end of May 2017 reported that Sergei Pavlov, ex-head of the information systems department of the Federal Treasury, was detained together with Guralnikov.

Arrest on suspicion of damage fraud 8 million rubles

Sergei Guralnikov and Sergei Pavlov were arrested by order of the Moscow City Court on May 13, the Kommersant newspaper reported on May 31, 2017, citing TAdviser sources.[1]. The publication's own sources clarify that at the same time as the officials, the chairman of the board of directors of the Sirius IT company Roman Pavlov and its executive director Alexander Litvinov were detained.

All four are accused of violating Art. 159 part 4 of the Criminal Code of the Russian Federation (fraud committed by an organized group or on an especially large scale).

Officials and businessmen, as of May 31, are in jail, and their lawyers have filed appeals against the arrests.

According to one of Kommersant's interlocutors, law enforcement agencies could be interested in the fact that Roman Pavlov's firms won many state contracts from the Federal Treasury, where his brother Sergei Pavlov headed the information systems department.

According to SPARK-Interfax, companies controlled by Roman Pavlov and Alexander Litvinov or affiliated with them have received at least 195 million rubles from various departments of the Federal Treasury since 2011 under state contracts for the supply of computer equipment, equipment and its technical support.

According to its own data, Sirius's revenue in 2015 amounted to 2.6 billion rubles, having more than doubled since 2011.

Later, the press service of the Khoroshevsky Court of Moscow confirmed the arrest of two officials of the Federal Treasury and two leaders of Sirius, Interfax reported. The court said they were remanded in custody until mid-July 2017.

Officials are suspected of fraud worth 8 million rubles, it follows from the materials of the case, which the judge announced during the meeting on the complaint about the arrest of one of the defendants, RIA Novosti reported.

The volume of the IT budget, which was managed by Sergey Guralnikov and Sergey Pavlov in the Treasury, in 2016 amounted to 11.8 billion rubles.

Dismissal from the Treasury

On June 7, 2017, it became known about the resignation of Sergei Guralnikov from the Federal Treasury of the Ministry of Finance of the Russian Federation, where he served as deputy head.

As the Rambler News Service (RNS) reported with reference to the Federal Treasury, Sergei Guralnikov resigned of his own free will. The same was done earlier by the former head of the department's information systems department, Sergei Pavlov.

2018

The second case on suspicion of damage fraud 75 million rubles

On April 6, 2018, Ren TV reported that a second case had been opened against the former deputy head of the Federal Treasury, Sergei Guralnikov, on suspicion of large-scale fraud. Information about the new episode in the Guralnikov TAdviser case was confirmed by a law enforcement source.

According to the investigation, Sergei Guralnikov could have appropriated a significant part of the amount intended to pay for the services of the contractor under the state contract, the TV channel reports. In September 2012, the Federal Treasury held an open auction for the supply (including installation and adjustment) of equipment in order to modernize the subsystem of the departmental transport network (MTS) of FC, following which it signed a contract with Sirius. Under the terms of the contract, the company provided the department with equipment to create backup communication channels in the territorial treasury bodies.

According to Ren TV, the contractor had to transfer 91 million rubles for the provision of services under the state contract. However, according to the investigation, in December 2012, Guralnikov, together with his accomplices, transferred more than 160 million rubles to Sirius. Thus, about 75 million rubles were appropriated by attackers.[2]

According to the auction documents posted on the zakupki.gov.ru website, Sirius was the only participant in the tender, due to the fact that the applications of the other two applicants were rejected due to the inconsistency of their proposals with the requirements of the documentation and part 4 of article 41.8 No. 94-FZ "On placing orders for the supply of goods, performance of work, provision of services for state and municipal needs."

As follows from the procurement documents, the initial (maximum) price of the state contract was set at 166 million rubles. It was at this price that a state contract was concluded with Sirius as the only bidder.

The Contractor's responsibilities included: ensuring reliable data transmission, video conferencing and voice communication with controlled quality between FC facilities; provision of unified interfaces for connection of modern data transmission and telephone communication equipment of territorial bodies of the department; construction of a fully fault-tolerant configuration of the MTS in terms of the trunk channels of the Central Control System - UFK; Update the IPF management system with replacement of UFK routers creation of backup communication channels in the OFK through the networks of local telecom operators; replacement of telecom equipment in the UFK, withdrawn from support by the manufacturer.

The Investigative Committee was unable to respond to a TAdviser request at the time of publication of the material.

Attempts to leave the pre-trial detention center

In June 2018, the 13th, judging by the information on the website of the Moscow courts, the attempt by the defenders of Sergei Guralnikov to release him from the pre-trial detention center was unsuccessful. The appellate instance upheld the previous court decision to extend his detention until August 10, the Moscow City Court told TAdviser.

The decision to extend was made earlier in May at the request of the investigation. The term of Guralnikov's detention in the pre-trial detention center was extended for the fifth time. As of July 2018, an ex-official accused of violating Art. 159 part 4 of the Criminal Code of the Russian Federation (fraud committed by an organized group or on an especially large scale), has been in custody for more than a year.

The Moscow City Court also clarified that along with Guralnikov, the terms of detention were extended for other persons involved in the case with him: his colleague, head of the Federal Treasury Department, Sergei Pavlov, chairman of the board of directors of the Sirius IT company Roman Pavlov and its executive director Alexander Litvinov.

Earlier, the detention of Sergei Guralnikov in the pre-trial detention center was extended along with the extension of the period of the preliminary investigation in his criminal case.

Lawyers of Guralnikov and three persons passing with him in the case have repeatedly tried to challenge court decisions related to their detention until the completion of the preliminary investigation in the case, but to no avail. According to the court, there is sufficient reason to believe that, while at large, the accused may hide from the investigating and judicial authorities, or otherwise obstruct the proceedings in the case, follows from some court orders on the complaints of lawyers.

At the same time, judging by the information on the portal of the courts of general jurisdiction of Moscow, Guralnikov periodically connects new lawyers to appeal against court decisions to extend the term of detention. In April, for example, lawyer Andrei Korshunov tried to appeal the court's decision on the extension. In his profile on the website of the legal bureau "Pravkontrol" it is indicated that he worked in the prosecutor's office, in teaching, led the structural unit of the legal department of a "large international oil and gas company."

Among the lawyers also representing the interests of Guralnikov are Pavel Fabritsi and Alexander Makarov, partners of the Reznik, Gagarin and Partners bureau, follows from the file of cases on the website of the courts of general jurisdiction of Moscow. One of the founders of the bureau is the well-known lawyer Henry Resnick.

The Fabritsi page on the bureau's website says that he participated in the protection of members of the Russian government, senior officials of the Ministry of Defense and the State Customs Committee, and large Russian entrepreneurs.

Makarov's page also contains information about his representation of interests in the courts of "many public persons, in particular, the Minister of the Government of the Russian Federation, a famous Russian businessman and public figure, the head of one of the largest news agencies in Russia, well-known human rights activists, stars of Russian cinema, television and show business."

According to information from the website of the Moscow City Court, in 2012, Fabritsi and Makarov represented the interests of Ksenia Sobchak in court, when she appealed against the seizure by the investigation of a large amount of money as part of searches in the Bolotny case[3]. Her own lawyer in this case was Henry Resnick. Makarova and Fabritsi Sobchak attracted to the protection of their interests and when she was going to sue the Izvestia newspaper in 2013, judging by the data of the file cabinet of the Moscow City Court. And in 2006, Fabritsi defended Platon Lebedev, challenging the transfer of the convicted co-founder of Menatep Bank to Yamal.

The Reznik, Gagarin and Partners bureau could not answer TAdviser's questions about the Guralnikov case at the time of publication of the material. Andrei Korshunov was also unable to contact.

2019: Sergei Guralnikov left jail under house arrest

In 2018, an important change took place in the case of Sergei Guralnikov, who has been under arrest since 2017: after repeated attempts, the lawyers were finally able to convince the court to change the measure of restraint from detention in a pre-trial detention center to house arrest. In February 2019, the investigation petitioned to extend the term of house arrest until April, the Moscow City Court granted this petition.

Alexander Litvinov, as well as Sergei and Roman Pavlov, who are being held with Guralnikov in the case, were also transferred to house arrest. They also extended the terms of house arrest in February 2019.

Since then, there has been no movement in the case, according to information from the Basmanny Court and the Moscow City Court. The Moscow City Court told TAdviser that as of July 2019, the Guralnikov case had not yet been submitted for consideration on the merits, nor were there other court hearings in this case.

The representative of the Moscow City Court also noted that in some cases the investigation may change the measure of restraint without the participation of the court: for example, from house arrest to recognizance not to leave.

If earlier all these persons involved in the case were listed in the database of cases of Moscow courts in the status of accused, then with the transition to house arrest they appear there as "persons." A familiar TAdviser lawyer specializing in criminal law noted that this does not mean that they are cleared of charges if they continue to be under house arrest.

2023: Criminal trial. 130 volumes of documents and several boxes of material evidence

At the beginning of 2023, the court in the high-profile case of the former deputy head of the Federal Treasury Sergei Guralnikov, in 2010-2017. responsible for the development and operation of the department's information systems, entered an active phase. According to the database of courts of general jurisdiction in Moscow, in January and February, several meetings were held in the Tverskoy District Court, at which evidence was claimed.

The case of fraud in the Federal Treasury, we recall, was initiated back in 2017. The investigation on it was conducted for several years, follows from the documents published in the database of the courts of general jurisdiction of Moscow.

Sergei Guralnikov is involved in the case under the following articles of the Criminal Code of the Russian Federation: Art. 179, part 1 (coercion to make a transaction or to refuse to make it); Article 159, part 4 (fraud committed by an organized group or on an especially large scale); Article 285, part 3 (abuse of office, entailing grave consequences).

Alexander Litvinov is charged with Art. 159 part 4 of the Criminal Code of the Russian Federation (fraud committed by an organized group or on an especially large scale). The same article is present in the rest of the defendants. In addition to Art. 159 part 4 of the Criminal Code of the Russian Federation, Sergei Pavlov and Roman Pavlov also have Art. 285 part 1 of the Criminal Code of the Russian Federation (abuse of office), and the latter also - Art. 33 part 5 (complicity in a crime, complicity).

In relation to the accused, a preventive measure was chosen in the form of a recognizance not to leave the place and proper behavior, according to the appeal decision of the Moscow City Court of March 2022[4].

From there it follows that Sergei Guralnikov and Alexander Litvinov permanently live in Krasnodar. The Kommersant newspaper, citing its sources, wrote in 2019 that all four defendants - originally from Krasnodar[5].

The above appeal ruling states that the materials of the criminal case amount to 130 volumes, an average of 250 sheets - a total of 32.5 thousand sheets. And a large number of documents, several boxes with a total size of about 8-9 thousand sheets, which is 32-35 additional volumes of the case, were recognized as material evidence in the case. There are also several CDs and other information memory tools.

The term for familiarizing the accused with the materials of the criminal case was previously set on April 8, 2022. They and their defense asked the Moscow City Court to give them more time to familiarize themselves, which, however, the court refused them.

The defendants in the case then indicated that in addition to the large volume of the criminal case, its study is a laborious process, since "the prosecution is of an economic and technical nature, the case contains various tables, graphs, several examinations, as well as a large amount of figures and calculations, complex technical documentation."

The interests of Sergei Guralnikov and the rest of the accused in court are represented by lawyers with extensive experience. In the appeal decision of the Moscow City Court of March 2022, among them is mentioned the famous lawyer Henry Reznik, whose clients were many eminent persons. He is one of the founders of the Reznik, Gagarin and Partners law firm.

Among the defenders are Pavel Fabritsi and Alexander Makarov, partners of this bureau. On the Fabritsi page on the website of this organization, it is said that he participated in the protection of members of the government of the Russian Federation, senior officials of the Ministry of Defense and the State Customs Committee, large Russian entrepreneurs.

2024

Court decision on damages to the Federal Treasury

On January 30, 2024, the Savelovsky District Court satisfied the claims of the Moscow Prosecutor's Office against Sergei Guralnikov, Sergei Pavlov, Alexander Litvinov, Roman Pavlov for recovery jointly and severally in the income of the Russian Federation represented by the Federal Treasury in the amount of 68 million rubles in compensation for damage caused as a result of the crime. This was reported to TAdviser by the press service of the Savelovsky District Court.

The lawsuit from the Moscow Prosecutor's Office was filed in a civil case. At the same time, the Tver District Court is still considering a criminal case in which the above persons appear. Meetings in the criminal case have been going on for more than a year, from November 2022.

Complaint against court ruling on damages

As TAdviser found out, Sergei Guralnikov, Sergei Pavlov, Alexander Litvinov and Roman Pavlov filed appeals against the decision of the Savyolovsky District Court of Moscow in a civil case issued on January 30. The notice of the complaint of Sergei Guralnikov was published on May 7, 2024 in the database of courts of general jurisdiction in Moscow. The contested court decision issued at the suit of the Moscow Prosecutor's Office ordered the specified persons to pay 68 million rubles to the income of the Russian Federation in the person of the Federal Treasury "against compensation for damage caused as a result of the crime."

In the published text[6] of the decision of the Savyolovsky court details the circumstances of the criminal case, in which the prosecutor's office filed a civil claim for damages. It was initiated in May 2017 under Part 4 of Art. 159 of the Criminal Code of the Russian Federation on "embezzlement of someone else's property by deception committed using his official position, organized by a group, on an especially large scale."

At the time of the events that formed the basis of the criminal case, Sergei Guralnikov held the position of deputy head of the department in the Federal Treasury, and Sergey Pavlov - the head of the information systems department. Among their powers in these positions was the organizational support of work on centralized purchases of goods and services for the Federal Treasury. Alexander Litvinov was the general director of Sirius, and Roman Pavlov held the position of deputy general director at Sirius.

In the course of the preliminary investigation, it was established that Sergei Guralnikov and Sergey Pavlov, having received information about the need to modernize the subsystem of the departmental transport network of the Federal Treasury (hereinafter referred to as VTS FC) in 2012, decided to use this to their advantage. To implement the plan, Sergei Pavlov, possessing, by the nature of his position, information about the equipment that needs to be purchased to modernize the subsystem of the MTS FC, transmitted this information to Roman Pavlov and Alexander Litvinov. In October 2012, a supply agreement was concluded with Sirius for the necessary equipment, including its installation and configuration.

Later, according to the investigation, Alexander Litvinov signed a fictitious agreement and an act of work performed to analyze the condition of the MTS equipment, concluded with the Datak company, controlled by himself and Roman Pavlov. At the same time, these works were not actually performed.

An examination carried out later in the criminal case showed that the price indicated in the state contract, taking into account all the work, does not correspond to the market value of this equipment in prices valid in 2012. Also, according to the examination carried out by the FBU RFCSE under the Ministry of Justice of the Russian Federation, the work stipulated by the state contract on the installation of Ethernet modules as of November 7, 2013 was not completed: "the installation and configuration were carried out by the territorial bodies of the UFK."

In addition, there is a decision of the FAS based on the results of an unscheduled audit, which established that the auction, following which the state contract with Sirius was concluded, in terms of the content and execution of documentation, its approval, did not meet the requirements of the public procurement 44-FZ.

No later than December 25, 2012, Sirius and the Federal Treasury signed an act of acceptance of goods and work performed under the state contract, its execution was confirmed by Guralnikov's memorandum, which in aggregate was the basis for payment. Thus, the budget funds turned out to be "stolen by accomplices of the crime and distributed by them in shares unidentified by the investigation, which caused damage to the budget of the Russian Federation," the court says.

The defendants' objections to the amount of material damage declared by the prosecutor's office to compensation, and their arguments about the compliance of the price of the state contract concluded on October 15, 2012 with the market value of Sirius services as of 2012, were considered unfounded by the court and rejected.

At the same time, in 2023, by a decision of the Tverskoy District Court, the criminal case against the defendants, in which the prosecutor's office filed a claim for damages, was terminated due to the expiration of the statute of limitations for criminal prosecution. The defendants did not dispute this, agreed to terminate the criminal case on non-rehabilitating grounds, according to the decision of the Savyolovsky court.

At the same time, according to the database of courts of general jurisdiction of Moscow, in the Tverskoy District Court as of May 2024, the consideration of the criminal case under Part 3 of Art. 285 and Part 1 of Art. 179 of the Criminal Code of the Russian Federation, in which Sergei Guralnikov appears. Court hearings on it have been conducted since November 2022.

Sentence - 4.5 years in prison

On August 8, 2024, the verdict to Sergei Guralnikov was announced in the Tverskoy District Court of Moscow. TAdviser attended a court session and found out that the former deputy head of the Federal Treasury, who was responsible for IT in the department, was found guilty of committing crimes under Part 3 of Art. 285 (abuse of office) and Part 1 of Art. 179 of the Criminal Code of the Russian Federation (coercion to commit a transaction or to refuse to commit it).

Under Part 3 of Art. 285 of the Criminal Code of the Russian Federation, in particular, Sergei Guralnikov was sentenced to 4.5 years in prison with serving in a general regime correctional colony. He is also deprived of the right to hold positions in the state civil service related to the fulfillment of the powers of a government representative in the financial and budgetary sphere for a period of 3 years.

The preventive measure previously applied to Sergei Guralnikov in the form of detention from May 2017 to September 2018 is counted as punishment based on the calculation of one day for a day and a half in a general regime correctional colony, the period of detention under house arrest from September 2018 to April 2019 - two days in one day in a general regime correctional colony. According to TAdviser estimates, if the sentence remains unchanged, in fact, Sergei Guralnikov will have to spend about 2 years and 3 months in the colony.

Under Part 1 of Art. 179 of the Criminal Code of the Russian Federation, Sergei Guralnikov was fined 200 thousand rubles. Moreover, the court released him from this punishment due to the expiration of the statute of limitations for criminal prosecution.

Sergei Guralnikov and his defenders can appeal the verdict within 15 days.

Before the verdict entered into force, the preventive measure against Sergei Guralnikov in the form of a recognizance not to leave the place and proper behavior, under which he was until the verdict was announced, was changed to detention. The former deputy head of the Federal Treasury was taken into custody right in the courtroom.

Apparently, Sergei Guralnikov was ready for such a development of events and arrived at the court immediately with a large bag. Three lawyers attended the announcement of the verdict with him. One of them, Pavel Fabritsi, told TAdviser after the meeting that the defense considers the verdict illegal and unfair. After receiving the full text of the verdict, it is planned to appeal it.

The consideration of the case in the court in which the verdict was passed has been going on since October 2022. Earlier, we recall that Part 4 of Art. 159 of the Criminal Code (fraud), but the case on it was closed back in 2023 due to the expiration of the statute of limitations for criminal prosecution.

Awards

For many years of conscientious work in the financial system of the region, Sergei Guralnikov was thanked by the Head of the Administration of the Krasnodar Territory.

In addition, the official was awarded the commemorative medal "For Outstanding Contribution to the Development of the Kuban" II degree, the jubilee medal "200 years to the Ministry of Finance of the Russian Federation," a badge: "Excellence in financial work."

In 2007, by Decree of the President of the Russian Federation, for great merits in the formation and development of the treasury system of the Russian Federation, he was awarded the Medal of the Order of Merit for the Fatherland, II degree.
