Cancelled purchase
Rosatom could not buy software of Microsoft within the tender with the maximum price about 2.4 billion rubles, follows from the protocol published on the official portal of state procurements[1] of March. Any application because of what it was recognized cancelled was not submitted for participation in a tender which was announced earlier by structure of Rosatom - "Atomkomplekt"-.
At the time of the publication in Rosatom did not comment on TAdviser whether the organization is going to announce the tender again to make some changes to the tender documentation.
The dependence of Rosatom on Microsoft becomes stronger. The Russian software makers ask the head of corporation to take measures
On March 13 the association of software developers (ARPP) "Domestic software" sent the letter to the CEO of Rosatom Alexey Likhachev the letter in which it asks to change the tender documentation of recently announced tenders for purchase of the software so that domestic developers of software could take part in them. TAdviser studied this letter signed by the chief executive of ARPP Renat Lashin. Its copy was also sent to Competence center on import substitution of ICT.
In February, 2020 structure of Rosatom - "Atomkomplekt" - announced the tender for purchase of the software of Microsoft for "subsidiaries" of state corporation for 2.4 billion rubles. Licenses for the office software, the Microsoft Azure platform and other cloud solutions are purchased. Software is purchased for ensuring activity about 73 thousand jobs.
ARPP studied the tender documentation. Renat Lashin in the letter notes that ARPP predicts non-performance by Rosatom of tasks of implementation of the national projects and the import substitution program designated by the president and also significant risks of decrease in security of objects of critical infrastructure. The purchased software intends, including for the enterprises of Rosatom making and enriching uranium is underlined in the letter.
Also the association noticed existence of barriers on the admission of the Russian developers to participation in auctions. We consider the designated position dominating, it does not correspond to the principles of fair competition and does not allow the domestic IT companies even to propose any alternative solutions, said in the letter. |
Besides, Lashin continues, the "consecutive growth" of purchasing amount by Rosatom of foreign software for the last 10 years revealed on the basis of the analysis of open auctions allows to draw a conclusion on strengthening of dependence of state corporation on solutions of Microsoft, processing and data storage of nuclear sector outside Russia that is inadmissible in the conditions of the developed geopolitical situation.
The chief executive of ARPP draw Alexey Likhachev's attention that the Russian software products can ensure comfortable, reliable and safe functioning with confidential data on objects of critical infrastructure.
According to the tasks of import substitution program implementation delivered by the Russian President Putin V.V., we suggest to consider the possibility of review of technical specifications to the announced electronic auctions for the purpose of change of conditions of participation and a possibility of application to the Russian software makers, said in the letter. |
ARPP also asks to designate a current status and the taken measures within "The uniform digital strategy" of state corporation, the developed initiatives of formation of plans of transition to use of domestic technologies and also to notify ARPP on results of studying of a possibility of application of the Russian products from the register of software.
Rosatom did not answer TAdviser whether are ready to change the tender documentation in already announced tenders, but said that questions of compatibility, stability and stability of functioning always are in focus of attention of state corporation.

He added that in 2020 in Rosatom the big import substitution program started. Work goes according to the plan. At the same time the main focuses of attention of Rosatom are engineering software and software of an industrial class today.
Rosatom will buy software of Microsoft for 2.4 billion rubles
In March, 2020 it became known of the tender of Rosatom for purchase of the software of Microsoft for total amount about 2.4 billion rubles. However the American company has no license for delivery of software of the Russian state corporation.
In a conversation with Vedomosti the partner of Nafko law firm Pavel Ikkert told, Microsoft will have to obtain the license from Bureau of the industry and security of the U.S. Department of Commerce which is engaged in licensing and protection of interests of the USA by export deliveries of technologies and hi-tech products, including to the enterprises of dual purpose. In the license the distributor representing the interests of the American company in Russia should be specified, each distributor should obtain the license separately, he explained.
According to the consultant of O2 Consulting Vlad Borisov, Bureau of the industry and security toughened rules of export control therefore Microsoft can face additional checks when obtaining the license for deliveries to Rosatom, terms of its issue can be increased.
The edition reminds that the agreement between Microsoft and Croc (delivered to Rosatom software for 1.8 billion rubles) expired in 2019. Besides, software to Rosatom was delivered by Softline at which the term of the corresponding license expired at the end of 2018. However, in the 2019th Softline continued to deliver software products to affiliated enterprises of state corporation among which — the Novosibirsk Chemical Concentrates Plant (NZHK) which bought software for 1.5 million rubles.
According to the representative of Rosatom Andrey Ivanov, "subsidiaries" of state corporation can conduct procurement out of the agreement signed on all Rosatom. At the same time Softline did not notify Rosatom on obtaining the license, he added.
If violation from Microsoft which provided software to the customer without license is proved, then the penalty which size depends on the cost of transactions can be imposed on the company, Pavel Ikkert believes.[2]
2016
Delivery of software licenses of Microsoft within two lots for the enterprises of Rosatom.[3]
On December 19, 2016 the tender committee of Rosatom defined the winner of open auction on acquisition of licenses and technical support services of the software of Microsoft within the corporate agreement of Enterprise Agreement Subscriptions.[4].
Three companies - Comparex, Lanit and Croc took part in a final part of an auction. At the same time the smallest in price application (1.777 billion rubles) was submitted by Croc, having reduced the initial cost of purchase by 27 million rubles. This company was also announced by the winner.
Within the agreement, licenses of Microsoft should be delivered in Rosatom and also in 81 child organizations of state corporation. Among these companies there are most mass needs for software products and services have the Rosenergoatom enterprises (the initial cost of the agreement - 785.4 million rubles), NIAEP (136 million rubles) and Greenatom (124.8 million rubles).
The rights to OS Windows, office applications DBMS SQL Server, programs Visio Project, SharePoint and others are a part of the purchased solutions.
The initial cost of purchase is 1.8 billion rubles
Licenses should be delivered within 20 days from signature date of the agreement. The term of their action includes 3 annual periods. Payment of every period happens separately.
In documentation of the customer it is specified that the software of Microsoft completely covers functioning of jobs of employees in the organizations of Rosatom and also is the principal program component in DPCs. Softwares of Microsoft are bought only for use in interaction with already available solutions of the enterprises incompatible with software products of other producers. For example, Rosatom for fulfillment of requirements on data protection uses software of Secret Net and Antivirus of Kaspersky for Windows OS.
Besides, Rosatom specified three characteristics of similar solutions which will not allow state corporation to carry out necessary tasks, in case of their purchase. According to representatives of Rosatom it:
1. Low support of the last standards of text and other documents from Microsoft that complicates opening of these documents and work with them.
2. Different formatting of documents that besides complicates work with them.
3. As a part of these packets there is no e-mail client similar to Outlook.
The previous tender for delivery of licenses of Microsoft (2014 - 2016) was won by I-Teco company. Then the cost of the agreement was about 800 million rubles.
Similar purchases
According to TAdviser, the purchase announced by Rosatom is one of the largest purchases of licenses of Microsoft among state institutions and the companies with state participation in recent years.
In 2016 the largest acquisition of software products of Microsoft was recorded in tender of Rosseti. In it the collective participant as a part of companies "Softline Trade" (leader) and Lanit which taking into account the procedure of rebidding, offered the smallest price of the contract - 2.033 billion rubles became the winner. For 1.2 billion rubles of the license of Microsoft at the end of December bought Rostelecom, as the supplier Comparex acts here.
In 2015 the most expensive tenders for acquisition of products of the American software corporation were announced by VTB Bank (the starting price of the contract - 1.537 billion rubles, the price according to the results of an auction - 1.142 billion rubles), Transneft (the starting price of the contract - 1.423 billion rubles, the price according to the results of an auction - 1.401 billion rubles) and Rosselkhozbank (the starting price - 872 million rubles, the price according to the results of purchase - 859 million rubles).
In 2014 purchases of licenses of Microsoft were even more modest. The right to be called the largest purchase of 2014 belongs to the tender of the Ministry of Internal Affairs of the Russian Federation with the starting price of 470 million rubles in which victory was won by LANIT-Integration company, having suggested to satisfy terms of the contract for 456 million rubles.
2015
In October, 2015 Rosatom held open auction on delivery of the software and technical support of the software of Microsoft. The maximum price of the purchase consisting of three lots was more than 71 million rubles.
According to technical documentation of state corporation licenses for products SQL Server, Core Infrastructure Server Project Professional Visio Professional Exchange Server SharePoint Server Project Server Lync Server Windows, Office and also licenses for services of remote desktops were required Windows Server.
The software was required for needs as the Rosatom State Corporation, and for the enterprises entering into structure of state corporation. Validity period of licenses includes two periods: from signature date of the delivery-acceptance certificate on December 31, 2015; from January 1, 2016 to December 31, 2016.
On the first two lots the beginning of an auction is planned for December 3, 2015 Software to the third lot – for November 19, 2015.
Purchase results
According to the results of purchase 4 agreements - 2 are signed with Croc company and 2 with Firm[5].
