Fine of $0.5 million for counterfeiting the country of origin of products for sale to government agencies

In mid-April 2019, Fortinet agreed to pay the US government $545 000 for counterfeiting the labeling of products intended for sale to government agencies. For seven years, an employee of the company forced contractors to change the country of origin of products on labels in order to then sell goods in accordance with the American federal law on public procurement.

The agreement between Fortinet and the US government notes that between January 2009 and fall 2016, a Fortinet employee responsible for supply chain control ordered other employees and contractors to hide the country of origin of the product or include the phrases "Developed in the USA and Canada" or "Collected in the USA" in the labeling. Thus, products with modified markings fell under the law on trade agreements, according to which goods purchased under government contracts must be manufactured or significantly changed in the United States or another country included in the special list. It is known that some of the products with modified markings were resold to the US government through distributors and subsequent intermediaries.

Fortinet fined counterfeiting country of origin of products for sale to government agencies

The trial in this case was initiated in January 2016, when a lawsuit against Fortinet was filed by Yuxin Jay Fang, a former logistics specialist who worked at Fortinet's Canadian office in Vancouver. Under the Unlawful Claims Act, which imposes liability on people and companies that are tricked into participating in government programs, individuals can file a lawsuit on their own behalf or on behalf of the government, which Fang took advantage of. He accused Fortinet, as well as its distributor Arrow Enterprise Computing Solutions, of counterfeiting product labeling - he found that some goods allegedly produced in the United States actually came from countries not included in the list of trade agreements law, including from Taiwan (until August 2009) and China.

Although Fortinet believes that some of the products in question may have actually complied with the trade agreement law, the actions of the compromised employee are considered a clear violation of the company's established policy. In response to the charges, Fortinet agreed to pay the government $400 000 and provide the US Marine Corps with additional equipment worth $145 000. The representative of Fortinet noted that the company is ready to cooperate with the government, ensuring a prompt and thorough investigation into this issue, but asks to note that this was an isolated incident related to the events of two years ago, when a former fraudulent employee acted contrary to the established company policy.

When Fortinet reported the incident, management immediately took the necessary action: the company conducted a thorough investigation of this issue, fired the employee and took additional security measures to prevent such problems in the future. An internal investigation was conducted with the assistance of a lawyer for another company; the compromised employee was on leave at that time. Once the investigation was completed and the employee's guilt proved, Fortinet fired him. According to a press release from the US Attorney's Office, Fortinet collaborated with law enforcement agencies and shared the results of an internal investigation into this issue.

2017

Cloud and Internet of Things revenue growth

In 2017, Fortinet's revenue increased by 17% compared to 2016 and reached $1.49 billion, which the American company explained by its focus on key areas of growth.

Annual net profit slightly decreased - from 32.2 to 31.4 million dollars. The decline occurred due to the fact that the manufacturer of information security solutions had to pay $63 million once due to tax reform in the United States.

Fortinet Revenue Dynamics

In 2017, the volume of orders received by Fortinet jumped 19% to $1.8 billion. Judging by this indicator, Fortinet is growing faster than all competitors, said Ken Xie, founder, chairman of the board of directors and CEO  of the company.

He named several main growth drivers Fortinet. First, this is a network security market that has strengthened the company's business in the field of software-defined WAN solutions and network products in general.

The company also helps to develop the trend of cloud security. Fortinet products are launched in the clouds of Microsoft Azure, Amazon Web Services (AWS), Google Cloud, IBM Cloud and Oracle Cloud, the chapter continues.

Another positive factor for Fortinet is the growing security needs associated with the Internet of things, said Ken Ksi.

North and South America remains Fortinet's largest market with a 42 percent share in turnover. The Asia-Pacific region and EMEA (Europe, Middle East, Africa) brought the company 20% and 38% of revenue, respectively.

As for clients, most of the revenues (41%) come from large corporations and telecommunications operators. Smaller companies account for 29% of revenue, and the indicator in the small and medium-sized business segment is 30%, according to the Fortinet financial report for 2017.[3]

The emergence of the Zero Thrust concept - the basis of the "Security Factory"

The emergence of numerous personal devices from which employees gain access to corporate information has led Fortinet to understand that the very concept of security needs to be changed. The ingress firewall cannot provide protection due to an uncontrolled increase in the number of network entry points. Therefore, no network element can be trusted by default. So the concept of Zero Thrust appeared, which became the ideological basis of the "Security Factory."

This Fortinet development provides a layered protection system. The first line is perimeter protection. The second is protecting everything inside the network. As a rule, a traditional company network has a flat topology, routers do not have security features, so malware is relatively freely distributed within the network. Segmentation allows you to localize and control threat centers, minimizing damage.

The work of the "Safety Factory" is based on three principles. The first principle is the breadth of coverage. Protection is not limited to a thin perimeter line and a set of individual devices. The administrator must monitor the entire environment, including APs, routers, endpoints, data centers, cloud, applications, and data. The necessary information should be presented in a single interface, allowing you to see and respond to the most complex threats. Using dynamic network segmentation capabilities, the Security Factory detects threats when they move from one segment to another.

The second principle is high performance. Modern networks are characterized by complexity, distribution and scale. To ensure their protection, especially within the framework of the ZeroThrust concept, a productive security system is needed. It is unacceptable to loosen protection on one site in order to ensure real-time operation on another. So, before emergence of FortinetInternal Segmentation Firewall it was difficult to provide necessary resources for protection of each segment for reasonable price therefore the concept of segmentation did not develop. Now this problem is solved: Fortinet security solutions provide the highest speed to process security events.

And the third principle is automation. The speed of threats in networks is increasing, and security systems must be able to respond to them on time. Therefore, they cannot provide for human participation at every step - the correlation of events and the determination of the level of risk must be automated. The "security factory" can dynamically isolate attacked devices, parts of network segments, update rules, set new policies, and remove malicious. ON It is also able to dynamically adapt to changes in network configuration, which eliminates not only the cost of time, but also the risk of error due to the fault of the human factor.

The "security factory" was created on the basis of existing products of the company, which, thanks to the new concept, received additional opportunities to work in a single complex. Its three main components are the firewall FortiGate, anti-spam FortiMail along with the sandbox FortiSandbox for checking suspicious investments, as well as software for protecting workstations and personal devices of users FortiClient. Web-Application Firewall, Internal Segmentation Firewall can also be used to protect segments and a variety of other systems.

Instead of buying security systems from various manufacturers, constantly administering them, controlling the regular receipt of updates and the timeliness of payment for their renewal, companies will build network security on the basis of a single platform - UTM devices.

Devices designed to perform different security functions arranged in the same platform are gaining popularity, and this trend will continue. Fortinet is the world leader in these systems.

  • A single device - a network that is simply integrated into any complex network performs all the functions of the classic model (Firewall, VPN, Anti-Virus, Anti-Spam (AntiSpam), Web filter)
  • The device itself (without using a PC) receives regular updates, which are worked on by a huge staff located in different parts of the world, which allows you to increase the speed of reaction to the manifestation of new threats.
  • All security policies are configured in a single, intuitive user application. The configuration does not require special knowledge and can be made even by an "advanced" user.
  • Basic Fortinet models cost a little money (up to 1000 €) while providing all the same functions as the "older brothers" systems. There is no trick here, they are simply designed for small networks (20-30 computers).

Fortinet management considers the main competitive advantages of its company to be its own development of those IB components that make up the functionality of modern UTM systems. In addition, citing data from independent research laboratories, it is reported that Fortinet software and hardware solutions are distinguished by leading TCO indicators among analogues. Fortinet is capable of performing its functions in enterprise and commercial data center IT environments virtualized with the world's most popular virtualization platforms.

A feature of Fortinet's offer is its licensing policy. The company sells devices and additional licenses for individual security modules, the cost of which is constant - it does not depend on the number of users, the number of mailboxes protected, or the number of computers protected.

True, the cost of licenses for different devices is different. Moreover, only the functionality that requires constant updates is licensed in the product - antivirus, spam filter, intrusion prevention and detection tools, while the firewall and VPN can be used for free.

Technologically, the company emphasizes the development of special hardware accelerators, which are based on specialized ASIC chips.

They are designed by company engineers to accelerate the most demanding protection tasks and improve their overall performance.

At the same time, the equipment itself can be used not only to perform security functions, but also simply to organize the network infrastructure: the company has products for both private users and the SOHO market, as well as for large enterprises and even for organizing the core of the provider network.

That is, Fortinet devices can be used not only as UTM to build a network infrastructure, but also as network routers and switches.

Customers can activate the license for protective mechanisms as necessary. If the main competitors, such as Cisco and Juniper, have products for building a network and a separate line for protection, then Fortinet actually supplies network equipment with built-in network security features in all nodes.[4]

We are pleased with the strong end of 2016, which showed our advanced technological achievements and revenue growth, "says Ken Xie, founder and CEO of the company, commenting on the financial statements. - Our comprehensive, powerful and automated security platform, Security Fabric, protects all elements of the network - from the Internet of Things to the clouds, differentiates Fortinet. The technological advantage, together with improved sales management, provided high results in the segments of medium and large businesses, and also gave us a good reserve for the future.
File:Aquote2.png

In 2016, Fortinet reorganized the division responsible for selling products to corporate customers. It was divided into two groups, one focusing on regional business and the other on global operations. Changes in the structure of the sales organization, as stated earlier in the management, led to management problems, but in the future they had a favorable effect on the company's performance.

Fortinet CFO Andrew Del Matto, speaking at a conference on the publication of the annual report, said that as a result of the reorganization, the company reduced administrative levels and jobs with intersecting functions, hoping to accelerate growth and increase financial transparency of the business.

According to Fortinet, most of the company's revenues are still formed by services, whose sales in 2016 amounted to $727.3 million compared to $532.5 million in 2015. Sales of products rose to $548.1 million from $476.7.[5]

Takeover of the company AccelOps

On June 9, 2016, Fortinet announced the takeover of AccelOps, a leading provider of network security monitoring and analysis. This is the next step in Fortinet's Adaptive Network Security strategy by improving the tracking and analysis of threat data from multi-vendor solutions.

AccelOps is a leading provider of scalable network security monitoring and analysis tools. The tools developed by AccelOps have contributed to a fundamental change in the concept of threat identification, prevention and management by combining network security monitoring and network performance analysis. Thanks to this, the company's products give an unprecedented complete idea of the state of the network. The virtual AccelOps tool tracks security, performance, and compliance metrics across local and virtualized infrastructures and provides a comprehensive picture of the state of the environment. Software is used to identify, analyze, and automate security solutions for multi-tier and unified networks that include servers, devices, storage, networks, security, applications, and users.

After the transaction is completed, AccelOps solutions will be released under the name FortiSIEM and included in Fortinet's adaptive network security system. This should increase the effectiveness of monitoring the status of client protection from Fortinet and other vendors. Thus, the strategy of complex segmentation of networks should be implemented in full - from the IoT to the cloud. The results of the security correlation and analysis begin to flow directly into the adaptive network security system, which will provide automated threat prevention.

It is announced that Fortinet Adaptive Network Security will be enhanced with the following components:

  • Next Gen SIEM from AccelOps
  • Global Threat Collection Services from FortiGuard Labs and third-party vendors.

Once a subscription is purchased, enterprise customers can protect their distributed networks with an orderly, consistent response and up-to-date threat data.

The functions implemented by AccelOps - the Security Operations Center (SoC) and the Network Operations Center (NoC) - will be used by Managed Security Service Provider (MSSP) and Fortinet Support Services. In particular, it is planned to develop a new subscription service - FortiCare 360 °. This new service will provide customers with automated auditing of the security and performance of client security infrastructures, and will provide advice on preventing unplanned service interruptions and troubleshooting issues that may have a negative impact on performance and service delivery.

By the time of the transaction, the company AccelOps serves hundreds of customers in various areas. In particular, the company's funds are widely used in the corporate and government segments, as well as in the MSSP segment. The acquisition of this company contributes to the expansion of Fortinet's market and the entry into the SIEM market, which has a capacity of $2 billion. USA. According to the forecast of Gartner, the volume of this market by 2019 will grow to $2.9 billion. USA.

Ken Xie, Founder, Chairman and CEO of Fortinet:

"Sixty percent of security breaches that caused data breaches began with network penetration and hidden threat activity. Threats remained undetected because of ineffective threat monitoring and correlation of security events. In addition, the complexity of big data security is due to the fact that multivendor, distributed enterprise networks are not merged into a single system, and the volume and complexity of threats are growing steadily. With the acquisition of AccelOps, Fortinet can expand adaptive network security by combining security monitoring and in-depth analysis of data from multiple vendors. These measures will increase the efficiency of automated protection of all areas of the network - from the IoT to the cloud. "

Partha Bhattacharya, founder and technical director of AccelOps:

"Fortinet and AccelOps share the belief that it is necessary to provide comprehensive protection that covers IT infrastructure in its entirety. We have always sought to develop tools that make security management and compliance as simple and efficient as possible. By interacting between AccelOps and Fortinet's advanced adaptive network security, our customers can take full advantage of a scalable, proven solution. It also provides security, performance, and compliance analysis, as well as management of all types of network environments that include multi-vendor tools. "

2015: Revenue growth by a third

On January 28, 2016, Fortinet announced the results of its activities in 2015. The company's revenue grew by a third, but profit tripled.

For the 12-month reporting period ended December 31, 2015, Fortinet sales slightly exceeded $1 billion compared to $770.4 million a year earlier. Net profit during this time fell to $8 million from $25.3 million.

It also follows from the Fortinet report that in 2015 the volume of customer orders (an important indicator by which investors can judge future income) of the company amounted to $1.23 billion, which is 37% more than a year ago. The volume of cash, cash equivalents and investments in the accounts of the American manufacturer reached $1.16 billion against $991.7 million by the end of 2014.

Commenting on Fortinet's financial statements, the company's founder and CEO, Ken Xie, noted the following:

File:Aquote1.png
Few have been able to achieve growth similar to that demonstrated by Fortinet, as we have made a lot of technological progress and are quickly earning from attracting customers and expanding our strategy. As cybersecurity remains at the top of the list of corporate IT priorities, Fortinet is in a good position to grow and increase its market share in 2016 and beyond.
File:Aquote2.png

Meanwhile, competitors warn of a decrease in demand for information security (IS) solutions. As the head of FireEye David DeWalt reported, results of work of his company disappoint because of changes of nature of threats and consumer habits of clients against the background of IB-agreements between the USA and China.
