As Denis Koksharov, chairman of the Conscript Bar Association, explained, the first notification is informational in nature, and the agenda itself is contained by link in electronic form with the digital signature of the military commissar.

The lawyer added that the question arises here about the legality of sending such summons, because the register of summons is not yet working in Russia. Nevertheless, the law at the same time provides for the sending of these electronic subpoenas, through notifications to Moscow "Public services," but the main form of receiving subpoenas remains in paper form.

According to Koksharov, so far there have been no cases of bringing conscripts to justice for failing to appear on an electronic agenda. Nevertheless, he recommended not to ignore such notifications, but to appear at the military registration and enlistment office in order to avoid possible problems. If necessary, the legality of the summons can be challenged in court or the prosecutor's office.

The head of the Duma committee, Andrei Kartapolov, said earlier that the creation of a single electronic register of military personnel and the introduction of a system of electronic subpoenas will be completed by 2025. Until that moment, paper summons will remain the main form of summons to the military registration and enlistment office.

According to the General Staff of the RF Armed Forces, during the spring draft of 2024, it is planned to send about 150 thousand people to military service who are not part of the reserve. The draft age was previously raised from 27 to 30 years.[1]

There is no exact date for the final transition from a system of paper subpoenas to electronic by December 21, 2023, but Putin's order contains a date by which those responsible (Defense Minister Sergei Shoigu and Minister of Ministry of Digital Development Maksut Shadayev) will have to report on the work done. Banks also want clarification about customer requests for restructuring or refinancing of loans.

The exact timing of the launch of the register will be determined after the adoption of the law, he added. Maksut Shadayev stressed that the creation of a single register of military personnel will reduce to zero the number of problem cases with employees entitled to a deferral from the army

The Ministry of Digital Development of Digital Science of the Russian Federation noted that in the fall of 2022, the imperfection of the military registration and conscription system was revealed - for example, when employees of an IT company who had the right to postpone received summons, when for some reason they were not found in the lists in the military registration and enlistment offices, and the "lists themselves descended painfully long." In this regard, according to Shadayev, it became clear about the need to improve the system.

Russia adopted a law on electronic subpoenas for military prisoners

On April 11, 2023, the State Duma adopted in the third (final) reading amendments to the legislation, which introduce the possibility of notifying conscripts in electronic form, a unified register of military prisoners and a restriction on traveling abroad for dodgers.

According to one of the adopted amendments, those liable for military service will be able to receive summons both through their personal account on the State Public services portal and at the MPSC. At the same time, the new scheme will be built on the basis of the already working system of Public services. The electronic agenda will be considered handed over from the moment of its placement in the personal account of a citizen on Public services. The legal force of subpoenas handed over to any of the listed paths will be the same.

Adopted a bill on electronic subpoenas

If the agenda, executed in writing or in electronic form, is not served, then it is considered in any case served after seven days from the date of its placement in the register of subpoenas, the amendments say.

The bill requires to appear on the agenda within 20 calendar days from the day indicated in it. Within a day after the delivery of the agenda, a warning is sent about coercive measures in case of failure to appear.

The amendments also provide that a citizen subject to conscription, who received the agenda of the military commissariat after the date of appearance indicated in it, is obliged to report this within two weeks from the date of receipt of the agenda, personally appearing at the military commissariat, or through the State Public services portal.

Another innovation is a single register of military prisoners. It will contain personal data of such persons, personal and passport data of a military liable person, TIN and SNILS number, place of registration and place of actual stay, information about the presence of foreign citizenship or residence permit, information about the place of work, education and state of health.[5]
