Started accepting applications for IT deferment from military service

IT specialists can apply for a deferral from military service in the army in the autumn draft using the State Public services portal. Acceptance of applications started on July 24, 2024 will end on August 6.

The process of granting a deferral from military service to IT professionals has clear criteria. It can be claimed by male citizens of Russia aged 18 to 30 years, working under an employment contract. Candidates must have a higher education in the specialty from the approved list and work in accredited IT companies for at least 11 months during the year preceding the start date of the draft.

The requirement for experience does not apply to those who got a job within a year after graduation. The Ministry of Digital Development, Communications and Mass Media of Russia is obliged to transfer information about candidates for deferment to the Ministry of Defense of the Russian Federation until August 31, 2024. The final decision on each specialist will be made by a special commission from October 1 to December 31, 2024.

The State Duma refused to postpone mobilization for fathers with many children

The bill on granting deferment to fathers with many children did not receive the support of the majority of deputies. 90 parliamentarians voted for its adoption, mainly from the factions of the Communist Party and Fair Russia. Deputies from United Russia opposed this initiative.

First Deputy Chairman of the Defense Committee Andrei Krasov said that the primary task of a man is to protect the family, society and the state, and only then provide for the family. Nina Ostanina, in turn, expressed her intention to prepare a new version of the bill for consideration during the autumn session in 2024.

Acceptance of applications for IT deferment from military service will take place from January 22 to February 6

Employees of IT companies from January 22 to February 6, 2024 will be able through Public services to apply for a deferral from military service in the army as part of the spring draft of 2024. The Ministry of Digital Development announced this on January 18, 2024.

The employer will see the applications in his personal account on the portal and, if the employee's data is correct, will confirm them. If an employee does not have a personal account or does not send his data, then the organization will be able to add it to the list on its own.

What else you need to know

  • the company will need to check the data of employees, confirm them and send lists to the Ministry of Digital Development by February 10 through Public services

Criteria for inclusion of specialists in the lists:

  • Russian citizenship, male
  • age - from 18 to 30 years
  • work under the employment contract, normal working day
  • higher education in the specialty from the list
  • work in accredited IT companies for at least 11 months during the year preceding the start date of the draft. The company must be accredited by February 10, 2024

The requirement for the period of work in an accredited IT company is not presented if a specialist got a job within a year after graduation.

The age of deferment from military service for IT specialists in Russia has been raised to 30 years

On January 1, 2024, a decree of Russian President Vladimir Putin came into force on raising the age of deferral from military service for IT specialists in Russia from 27 to 30 years.

As RIA Novosti reminds, in order to receive a deferral from military service, an IT specialist must be a citizen of the Russian Federation, work under an employment contract in an IT company for at least 11 months, and also have a higher education in a specialty from the list of those subject to the deferral. Otherwise, the employer must ensure that the specialist has taken a job within a year of graduation.

On January 1, 2024, a law on raising the draft age to 30 years came into force in Russia

In August 2024, the Ministry of Digital Development   of the Russian Federation announced that it was preparing an increase to 30 years in the age of deferral from conscription for IT specialists due to an increase in the draft age from January 1, 2024, and exemption from conscription for military service for employees of accredited IT companies is valid from 18 to 27 years.

Changes to the decree are planned to be made before the start of the spring draft of 2024, since the law on raising the upper limit of the draft age will come into force on January 1, 2024, explained the head of the Ministry of Digital Development Maksut Shadayev.

According to Kommersant, cases of violations are recorded in Russia when employees of IT companies are forcibly drafted into the army, despite the postponement. Experts interviewed by the newspaper believe that the only way to avoid problems with conscription if there is an IT delay is not to change jobs until the end of the ongoing conscription. Also, experts advise, when changing jobs, to adjust the date of transition to a new company so that the new employer has time to submit documents for deferral within the terms stipulated by the current legislation. According to them, the safest periods of work change in the IT sphere are January 1 - February 19 and July 17 - August 11.[1]

Russian IT specialists are called up for military service, despite the current delay

In mid-October 2023, it became known that cases of conscription of employees of IT companies for military service in the army became more frequent in Russia, despite the delay provided for by law. At the same time, the greatest risks are observed when changing jobs.

According to the Kommersant newspaper, the facts of the delivery of subpoenas to IT specialists were recorded during the spring and autumn conscription of 2023. Errors arise due to "incorrect operation of the state system, to which documents were transferred by specialists of the human resources department, as well as bureaucratic delays." In particular, a case was noted when an employee of one of the Russian IT companies moved to another organization, but the new employer did not add him to the list of employees in time to grant a deferral. As a result, the employee received a summons, he arrived at the military registration and enlistment office and provided the draft commission with a certificate from a new place of work. However, "the commission decided to call a citizen to service. On the same day he was sent to the assembly point, and then to the military unit, where he is now. "

The Ministry of Industry and Trade is asking for a deferral from the army for employees of all electronic enterprises with government orders

At the end of August 2023, the Association of Developers and Manufacturers of Electronics (ARPE) sent a letter to the Minister of Industry and Trade Denis Manturov, in which it asked to extend the deferral from conscription to all enterprises producing radio electronics for the state. Such a measure, according to the authors of the appeal, will help avoid the breakdown of government orders "in the context of a radical change in supply chains and an acute personnel shortage."

As the head of the ARPE Ivan Pokrovsky told CNews, by the beginning of September 2023, a deferral is provided for the register of Ministry of Digital Development IT companies and the register of the defense industry and trade ministry. It applies to narrow lists of organizations and does not cover most of the industry's enterprises, because many electronic industry companies are at the third or fourth level of cooperation in the chain of DOZ performers, the ARPE said.

The ARPE added that by the beginning of September 2023, the list of the most important specialties for the industry, which would be subject to the provision of a deferral, was not approved. At the same time, the Ministry of Industry and Trade sent a specific list of defense industry employees who will receive a deferral from the spring draft for military service in 2023 to the Ministry of Defense back in March 2023.

The Ministry of Industry and Trade told the publication that by the beginning of September 2023, the deferral from military conscription applies to leaders, specialists and workers who work in defense industry organizations and participate in the fulfillment of GOZ tasks. Now the ministry, on the basis of these two conditions, is forming a list of organizations whose employees are given the right to defer from conscription for mobilization. Also included in the lists were students who entered into an employment contract with defense industry organizations, while still studying.[3]

Putin raised the age of deferral from military service for IT specialists to 30 years

The President Russia Vladimir Putin signed a decree that raised the age limit for deferral from military service for IT specialists from 27 to 30 years. The corresponding document on the official portal of legal acts was published on September 4, 2023. The decree comes into force on January 1, 2024.

In August 2023, Putin signed a law to increase the draft age from 27 to 30 years (the lower age limit for conscription - 18 years - has not changed). Following this, the head of the Ministry of Digital Science Maksut Shadayev said that the department is developing amendments that accordingly increase the age of deferral for IT specialists. Then he said that changes are expected before the spring draft of 2024.

The head of the State Duma Defense Committee, Andrei Kartapolov, explained the refusal to raise the lower bar by the fact that "a lot of guys want to go to serve at the age of 18." According to the deputy, "this is the right of a citizen, so we have expanded the rights, but they have not been reduced in any way." In the autumn call of 2023, the age criteria remain the same - from 18 to 27 years.

To receive a deferral, an IT specialist must be a citizen of Russia of draft age, work under an employment contract in an accredited company for at least 11 months before the start date of the draft. At the same time, if an IT specialist got a job within a year after graduation, there are no requirements for his experience.

As previously reported, by August 11, 2023, accredited IT companies had to transfer to the Ministry of Digital Development of the lists of their employees for deferral from the autumn draft, which were to be sent to the Ministry of Defense by August 31, 2023. Deferral from conscription was granted to IT professionals during the spring and autumn conscription of 2022, as well as the spring conscription in 2023.

IT professionals without higher education in Russia will receive a deferral from military service

In early August 2023, it became known that Ministry of Digital Development he had applied Government of the Russian Federation to the proposal to provide a deferral from military service to IT specialists who have only secondary specialized education.

According to the Izvestia newspaper, the department also proposes to expand the list of university specialties for which a deferral from the army is provided. The Ministry of Digital Development speaks of incoming appeals from "the largest domestic IT companies" who complain about the lack of specialists in the market.

By the beginning of August 2023, the deferral from military service is valid only for IT employees with higher education. The government approved the corresponding procedure in March 2022, and in September of the same year, the Ministry of Digital Development distributed a list of priority specialties that fit the criteria for exemption from military service. The list includes approximately 200 IT and related specialties, "without which the development of solutions is impossible." However, in the current geopolitical environment and in the context of the ongoing digital transformation of enterprises, there is a need to expand this list.

The agency emphasizes that there are significant technical specialties that were not previously included in the list. At the same time, those who have mastered them have great IT competencies and perform critical functions in their companies. The issue of expanding the list of specialties is under consideration by the Ministry of Defense. If the defense structure supports it, the government will instruct to make appropriate changes to the postponement decree.

To receive a deferral, IT specialists must have Russian citizenship, age from 18 to 27 years, work under an employment contract in an IT company for at least 11 months from the date of the start of the next draft (the company itself must be accredited by August 11, 2023).[4]

The Ministry of Digital Development Industry begins to accept applications from IT specialists for a delay from the spring draft

On January 19, 2023, the Ministry of Digital Development of the Russian Federation announced the acceptance of applications for a deferral from the spring draft to the army for IT specialists. As noted in the department, the rules for submitting applications for deferment from military service have been changed - now an employee of an IT company will be able to fill out information about himself.

From January 23 to February 6, 2023, IT specialists will be able to independently fill out an application for a deferral from the spring draft into the army through Public services
  • Key criteria to be met by specialists:
  • Russian citizenship, male sex;
  • age - from 18 to 27 years;
  • work under the employment contract;
  • normal working hours;
  • higher education in the specialty from the list of those subject to deferral
  • work in accredited IT companies for at least 11 months between April 1, 2022 and March 31, 2023. The company must be accredited by February 9, 2023. If the employee's experience is less than 11 months, the employer must make sure that he has taken a job within a year after graduation.

The Ministry of Digital Development clarified that employees need to have time to submit applications from January 23 to February 6, 2023 through the State Public services portal, and the employer will see them in his personal account on the portal.

After that, companies by February 9, 2023 will have to check the data of employees, confirm them and send lists to the Ministry of Digital Development through Public services. There can be multiple lists from one organization.

The Ministry of Digital Development is preparing a package of measures to return IT specialists who left Russia

On January 11, 2023, it became known about the measures that the Ministry of Digital Development is preparing to return the IT specialists who left Russia. They are planned to be adopted in the near future, writes Kommersant.

Among the proposals is a guaranteed reservation from conscription into the army. Market participants consider the most important measure to document the consolidation of armor, which has been declared since the spring of 2022.

Among possible measures, partial payment of "reverse relocation" is also being discussed, an increase in personal income tax from 13 to 30% for those who work from abroad, Alexei Smirnov, head of the board of directors of BASEALT, told the newspaper.

At the same time, the Ministry of Digital Development said that the department has a negative attitude towards proposals to ban remote work abroad or introduce barrage taxes, since this "will not help either the industry or the specialists themselves."

According to Smirnov, about 100,000 IT specialists work outside Russia by January 2023. In the event of an increase in personal income tax, either they quit, or the companies themselves will begin to open offices in other countries and re-register employees, he warned.

Ivan Pokrovsky, executive director of the Association of Developers and Manufacturers of Electronics (ARPE), says that by January 11, 2023, the deferral from the army to IT specialists and employees of the military-industrial complex is still not legally fixed, so formally military registration and enlistment offices can still call such workers. According to Alexander Karpukhin, partner of Five Stones Consulting, "internal agreements between departments may change at any time," therefore, amendments to the Federal Law "On Mobilization Training and Mobilization in the Russian Federation" or a special decree of the President of the Russian Federation are needed.

Pokrovsky told the publication that in mid-December 2022, ARPE discussed the possibility of protecting key industry employees from conscription.[5]

2022

In Russia, 256 thousand specialists from the field of information technology received a delay from partial mobilization. These data were announced during the discussion of the bill on granting deferment to fathers with many children in the State Duma at the end of July 2024.

Deputy Nina Ostanina cited statistics according to which, in addition to IT specialists, 170 thousand banking employees also received a delay. According to the Ministry of Defense of the Russian Federation, 834,224 people received the right to deferment. In addition to IT specialists, we are talking about employees:

  • banking system - 170 thousand (20.4%),
  • energy companies - 103.1 thousand (12.4%),
  • agriculture - 54.5 thousand (6.5%),
  • media - 43.7 thousand (5.2%),
  • other areas - 206.9 thousand (24.8%).

According to Art. 18 of the Law "On Mobilization Training and Mobilization," they also have the right to:

  • unfit for health;
  • caring for sick close relatives or guardians of a minor sibling unless there are other people who are required to do so;
  • citizens who depend on four or more children under 16 years of age, as well as raising one or more children of the same age without a mother;
  • men whose wives are at least 22 weeks pregnant and who have children under the age of 16;
  • single mothers with four or more children under eight;
  • State Duma deputies and members of the Federation Council.

Also, students of full-time and part-time education, who for the first time receive secondary vocational and higher education, received a delay from partial mobilization.

Acceptance of applications for an additional list of IT specialists from the Ministry of Digital Development

On November 21, 2022, the Ministry of Digital Development announced that the department was accepting applications for an additional list of IT specialists for a deferral from conscription. Applications are accepted until November 23, 2022.

The ministry drew attention to the fact that the acceptance of applications for deferment from military service as part of the autumn draft has long been completed, but requests from IT companies with a request to grant deferment to employees continue to arrive.

In this regard, the Ministry of Digital Development decided to create an additional list for the Ministry of Defense, while the final decision on the postponement remains with the defense department.

If the list was submitted, the employee meets the criteria, but the delay was still not given. The employee himself must send the sos@digital.gov.ru to the mail:

  • FULL NAME;
  • Company name;
  • The number of the application on the Public services;
  • The essence of the problem;
  • Mobile phone for communication;
  • Photo of the agenda (mandatory, without it, the application is not considered).

Initially, applications for deferment from service as part of the autumn draft were accepted from August 2 to 11. The autumn draft began in Russia on November 1, 2022, it will last until December 31. It is planned to draft 120 thousand people into the army. In 2022, the draft began a month later than usual.

On November 16, 2022, the application service for a deferral from mobilization was closed. According to the head of the Ministry of Digital Development Maksut Shadayev, about 5 thousand specialists who received summons used the right to postpone. In addition, 65 erroneously mobilized specialists were returned from military units.[7]

The agency explained what to do for IT specialists who meet all the criteria, but did not receive a delay or made a mistake when filling out the application.

IT companies in August, using a special service on the Public services portal, could apply for a deferral from the army for their employees as part of the autumn draft. Some of the specialists may have received a refusal to grant a deferral due to errors in the documents or for other reasons.

The Ministry of Digital Development in the official Telegram channel told what to do if the IT specialist meets all the criteria, but did not receive a deferment[8]this case, the IT specialist must send a message to help@digital.gov.ru, indicating the name of the company, the name of the company and the number of the application that the company submitted through the Public services.

If the company has filled out an application for a deferral from military service with an error, you need to send a message to the error@digital.gov.ru 's mail, indicating the name of the person in whose data the mistake was made, the name of the company and the number of the application.

If the company forgot to submit documents for a deferral or previous options did not work, you must write to the sos@digital.gov.ru, indicating the name, application number - if any, the name of the company.

The Ministry of Digital Science will send all the submitted applications to the Ministry of Digital Development. The department recalled that the decision to be included in the list for a deferral from the army remains with them.

The agency also noted that only appeals for urgent service should be sent to these addresses. Issues related to partial mobilization are no longer considered in connection with its completion[9].

Close online service for IT applications to defer mobilization

On November 10, 2022, the Ministry of Digital Development announced the imminent closure of the online service for submitting applications for IT specialists for a deferral from mobilization. The corresponding form on the State Public services portal will be closed on November 16, 2022.

According to the head of the Ministry of Digital Development Maksut Shadayev, from the end of September to the beginning of November 2022:

  • 65 wrongly mobilized IT specialists after the intervention of the Ministry of Defense returned from military units;
  • A few more cases remain, according to which the department by November 10, 2022 manually understands;
  • About 5 thousand specialists who received summons exercised the right to deferment;
  • More than 50% of all requests were received in the first week since the launch of the service on Public services.

Online service for submitting applications for IT specialists for a delay from mobilization will be closed on November 16

As part of this service, the employee himself can apply for a deferral, but it was necessary to attach to him a form of confirmation of his compliance with the necessary requirements, signed by the electronic signature of the general director of the organization. After filling out the form, you need to send the document through the launched service on Public services. It must be signed by the general director, otherwise a refusal will come.

In addition, we need information about military registration (type of document, its series and number, military rank and position, etc.), information about higher education (name of the university, specialty, series and number of diploma and other documents).

Defense Minister Sergei Shoigu on October 28, 2022 reported on the completion of mobilization measures. At the same time, the military registration and enlistment offices continued to recruit at the expense of volunteers and contractors.

In early November 2022, the president Russia Vladimir Putin confirmed the completion of partial mobilization in Russia. Russian the leader added that 260 thousand people from partially mobilized do not participate in hostilities, but are trained, on this mobilization is completed.[10]

The percentage of deferrals from partial IT mobilization was 0.5%

The share of refusals from the total number of applications for deferral to employees of IT and telecom companies does not exceed 0.5%. This was reported to the Ministry of Digital Development of the Russian Federation on October 18, 2022.

As noted in the department, a delay could be denied if the specialty in the diploma is not from the list approved by the Ministry of Digital Development, and the position is not related to functions that are critical for the company's activities.

The share of refusals to issue deferrals to IT specialists was 0.5%

The press service of the ministry noted that the Ministry of Digital Development notified specialists through the State Public services portal who did not receive the right to deferment.

Employees of accredited IT companies, telecom operators and media, who have higher education and work full time, can receive the right to deferment from partial mobilization. Employees of IT companies can apply for exemption from mobilization through the State Public services portal.

If an employee of an accredited IT company who meets the deferral requirements has already received a summons, then he needs to take with him an additional person to present:

  • Original or certified copy of the employment contract with the employer;
  • Diploma of professional higher education;
  • Extract from the register of state accreditation of the employer in the field of IT, certified by the general director of the company or an authorized person;
  • A certificate from the place of work signed by the general director or an authorized person that the employee is involved in the development, development, implementation, maintenance and operation of IT solutions or in ensuring the functioning of the information infrastructure.

The same requirements apply to employees of telecom and media operators.[13]

The minister explained that employees applying for a delay will have to fill out this form on their own, since it is required to provide a lot of data, which may not be available even in the personnel department. Self-filling will speed up the process.

The form must be accompanied by an extract signed by the general director, which confirms that the employee works in an accredited IT company or telecom operator and meets the remaining criteria for obtaining the right to deferment, such as full employment, participation in product development and development processes, higher profile (related to IT) education, etc.

If someone in the company has a power of attorney that allows signing documents for the general director, such a person can probably sign an extract for him, the minister said.

Also on September 26, the Ministry of Digital Development approved and published a document with a recommended list of specialties received in universities with which you can be exempted from partial mobilization. It is the same for both IT and telecom companies, because specialties often intersect there. Earlier, a list of 75 IT specialties from forms for deferral from military service, adopted as one of the measures to support the IT industry, was approved. It is quite narrow and does not suit everyone, the minister admitted. But in the case of the new list of specialties - to receive a delay from partial mobilization - the recommended list has become wider. The agency received a large number of proposals from the IT industry. The list includes everything that can relate to IT.

The list is such as to preserve the core of specialists, although everyone understands that the functioning of the company depends not only on the developers, the minister admits. However, this is what was agreed with the Ministry of Defense.

In addition, as you know, many IT specialists do not have specialized higher education, and there are those who do not have higher education at all. Such employees will not be able to count on a delay from partial mobilization, the minister said. "Crust" on retraining is also not considered. It is the higher profile education that is needed.

It follows from the words of the minister that everything related to the required criteria for education is not the decision of the Ministry of Digital Development - so they considered it expedient in the Ministry of Defense.

Individual entrepreneurs and self-employed in the IT sector will also not be able to be put under a delay, the minister said. This moment could not be reconciled. It is very difficult to confirm the profile of individual entrepreneurs and self-employed, Shadayev explained.

The collected lists of applicants for the delay will then be submitted to the Ministry of Defense. There are no restrictions on the date of submission of applications, Maksut Shadayev specified. Lists can be submitted indefinitely until the flow of those employees who are eligible for deferment runs out.

Recall that earlier the process of accreditation of IT companies was temporarily stopped due to a change in requirements. The Ministry of Digital Development is doing everything possible to restart accreditation as quickly as possible - in a week or two. And, importantly, in the new accreditation procedure there is a concept of software and hardware systems: if a company participates in their development, and not just software, it will also be able to obtain accreditation.

Chip and electronics makers ask for staff deferment from mobilisation

As part of the spring call, IT companies filed applications for 8.7 thousand specialists, but about 1 thousand of them did not meet the requirements of the Ministry of Defense. As a result, almost 7.7 thousand people received the right to deferment. Most of them are young people aged 23-24 years with a working experience of 1-2 years.

Among the regions, the leaders in terms of the number of IT specialists who received a delay were: Moscow, Moscow region, St. Petersburg, the Republic of Tatarstan, as well as Novosibirsk and Samara regions.

The Ministry of Digital Development will cancel the deferral from the army for part of IT specialists

The rules for obtaining a deferment from military service for representatives of the IT industry entered into force

These rules determine the categories of citizens of the Russian Federation from among those working in accredited organizations operating in the field of information technology (hereinafter referred to as accredited organizations) who are granted the right to receive a deferral from military service, and the procedure for granting this right.

2. The right to receive a deferral from military service in accordance with the Decree of the President of the Russian Federation of March 2, 2022 No. 83 "On measures to ensure the accelerated development of the information technology industry in the Russian Federation" (hereinafter referred to as the deferral from military service) is granted to citizens of the Russian Federation Federations working in accredited organizations under an employment contract on the conditions of normal working hours of at least 11 months during the year, preceding the start date of the next draft, having higher education in specialties and areas of training according to the list according to the appendix, or without presenting requirements for the specified period of work when concluding an employment contract with an accredited organization no later than one year from the date of graduation from an educational organization of higher education, graduation from a scientific organization (hereinafter referred to as citizens).

3. Lists of citizens are formed and sent by accredited organizations in electronic form using the federal state - information - system "Unified portal of state and municipal services (functions)" to the Ministry of Digital Development, Communications and Mass Media of the Russian Federation no later than 50 calendar days before the start of the next draft for military service. " The lists of citizens indicate the surname, first name and patronymic (if any) citizens, year and place of their birth, insurance number of individual personal account, name of educational organization of higher education (scientific organization), the date of graduation, the name of the received specialty (direction of training) of higher education, the number of the diploma of education, the place of work, the individual taxpayer number of the accredited organization, the place of residence and the military commissariat of the municipality (municipalities), in which the citizen is registered with the military. Lists of citizens with personal data are sent taking into account the requirements of Article 88 of the Labor Code of the Russian Federation and the Federal Law "On Personal Data."

4. A deferral from conscription is provided to citizens by draft commissions on the basis of a Ministry of Digital Development of the Russian Federation sent to the Ministry of Defense of the Russian Federation no later than 30 calendar days before the start of the next conscription of the list of citizens.

5. Accredited organizations in which citizens who have received a deferral from military service work are obliged to inform the relevant military commissariat of their dismissal from their post within 2 weeks.

The government clarified which IT specialists will receive a reprieve from the army amid a special operation in Ukraine

At the end of March 2022, Prime Minister Mikhail Mishustin signed a decree approving the rules for granting deferment from military service for specialists from domestic companies working in the field of information technology.

We are talking about young people under the age of 27 who have a higher education and work in IT companies for at least one year. In addition, the rules apply to specialists with less than one year of experience, but provided that they graduated from the university a year before their appointment to the post.

Students of some university specialties can also apply for a deferral. The list includes more than 60 areas, including mathematics, applied computer science, cartography and geoinformatics, radio engineering, electronics and nanoelectronics, robotics, aircraft engineering and shipbuilding.

Companies that want to receive a deferral for their young specialists must form a list of them and send them to the Ministry of Digital Development no later than May 1, 2022. Then the department will send a generalized list to the Ministry of Defense, and it will form the final lists and send them to the military registration and enlistment offices for a deferral.
