2016: A fine of $18 million for unfair marketing
In July, 2016 it became known that Acclarent will be fined several million dollars for unfair marketing.
The company advertized one of the devices as the device for drug intake. At the same time this equipment was not approved by Management on control of the market of food and medicines (FDA).
It is about market promotion of the Relieva Stratus MicroFlow device as the independent device of delivery of steroid medicines implanted into a frontal bosom. The American regulator approved this product only as the device which allows "open" bosoms.
Charge of unfair marketing was brought against the being CEO of Acclarent William Facteau and the vice president for sales to this company Patrick Fabian. According to the investigation, the specified top managers, applying methods of dishonest advertizing, tried to increase revenue of the company to increase its attractiveness for potential buyers, including for Johnson & Johnson which as a result and purchased Acclarent in 2010.
In July, 2016 the court found William Fakto and Patrick Fabian guilty of unfair marketing. The penalty in the amount of $18 million was imposed on all company Acclarent. Acclarent agreed to this compensation.[1]
2010: Johnson & Johnson buys Acclarent for $785 million
In 2010 Johnson & Johnson purchased Acclarent for $785 million then the last was integrated with other subsidiary company Johnson & Johnson — Ethicon (specializes in hearing aids).
