About creation of Expert advice on development of the information technology industry

For the purpose of development in the Russian Federation the information technology industries and ensuring its effective functioning at the expense of the organization of interaction of participants of the industry and the state

I ORDER:

1. Form Expert advice on development of the information technology industry (further – Council).

2. Approve the enclosed Regulations on Council and the structure of Council.

3. Appoint the Deputy Minister of Telecom and Mass Communications of the Russian Federation M.M. Shmulevich the chairman of the board.

4. I reserve control of performance of this Order.

Regulations on council

1. The expert advice on development of the information technology industry (further – Council) is the advisory body formed for the purpose of ensuring development in the Russian Federation of the information technology industry and approvals of actions of the Ministry of Telecom and Mass Communications of the Russian Federation, other federal public authorities, public authorities of territorial subjects of the Russian Federation, institutes of development of the Russian Federation, industry associations, companies and expert community of the information technology industry.

2. Council is created on the basis of point 6.4 of the Regulations on the Ministry of Telecom and Mass Communications of the Russian Federation approved by the order of the Government of the Russian Federation of June 2, 2008 No. 418 (The Russian Federation Code, 2008, No. 23, Article 2708; No. 42, Article 4825; No. 46, Article 5337; 2009, No. 3, Article 378; No. 6, Article 738; No. 33, Article 4088; 2010, No. 13, Article 1502; No. 26, Article 3350; No. 30, Article 4099; No. 31, Article 4251; 2011, No. 2, Article 338; No. 3, Article 542; No. 6, Article 888; No. 14, Article 1935; No. 21, Article 2965; No. 44, Article 6272; No. 49, Article 7283; 2012, No. 20, Article 2540).

3. The main objectives of Council are:

3.1. Ensuring agreed decisions and actions of the Ministry of Telecom and Mass Communications of the Russian Federation, other federal public authorities, public authorities of the territorial subjects of the Russian Federation, industry associations, companies and expert community of the information technology industry aimed at the development in the Russian Federation of the information technology industry.

3.2. Development of recommendations about development of the information technology industry.

3.3. Ensuring regular interaction of the Ministry of Telecom and Mass Communications of the Russian Federation with expert community of the information technology industry.

3.4. Participation by consultations and development of recommendations in:

• to preparation of suggestions for improvement of state policy and normative legal regulation in the field of functioning and development of the information technology industry;

• to preparation of the offers recommended for acceptance at meetings of Public council at the Ministry of Telecom and Mass Communications of the Russian Federation.

3.5. Development of offers on questions:

• determinations of the information technology industry in the Russian Federation, the factors influencing its development and metrics for its statistical and qualitative analysis;

• relevant measures of support of development of the information technology industry, including assistance to development of education, staffing and a technology entrepreneurship in information technology fields, improving competitiveness of the industry;

• implementations of state policy in the field of development and regulation of the information technology industry;

• ensuring efficiency of functioning and development of the information technology industry and also creating favorable conditions in Russia and abroad for activity of the domestic companies of the information technology industry and adjacent areas;

• information support and illumination of issues of development of the information technology industry;

• development of the international cooperation in the information technology industry, including adaptation of best practices and world experience of development of the information technology industry or implementation of specific projects in the industry.

3.6. Implementation of functions of expert evaluation:

• measures of the state support of development of the information technology industry;

• system projects in the information technology industry with the subsequent development of recommendations about measures of their support and development.

3.7. Development of recommendations about formation of positive image of the domestic information technology industry.

3.8. Development of recommendations about holding the actions necessary for achievement of practical results of interaction between all participants of development of the information technology industry.

4. Within implementation of the tasks assigned to it Council has the right:

4.1. Consider offers of federal public authorities, public authorities of territorial subjects of the Russian Federation, institutes of development of the Russian Federation, industry associations, companies and expert community of the information technology industry, the organizations and individual entrepreneurs without formation of legal entity and also citizens on the questions referred to competence of Council.

4.2. Organize interaction according to questions of competence of Council with the interested federal public authorities, public authorities of territorial subjects of the Russian Federation, local government authorities, scientific and educational institutions, the organizations and citizens, including to request from them in accordance with the established procedure information on the questions which are within the competence of Council.

4.3. Make the decisions considered as referral by the Ministry of Telecom and Mass Communications of the Russian Federation and other authorities of the Russian Federation within the competence.

4.4. Create the temporary and permanent working groups for timely and high-quality preparation of offers on the questions connected with the solution of the tasks assigned to Council.

4.5. Attract in need of experts and consultants to study of the questions submitted for consideration of Council.

5. Meetings of Council:

• will be organized by the Secretary of Council;

• are carried out mainly in presentia;

• are followed by collecting by the Secretary of Council of offers and expert opinions of members of council before meetings;

• are followed by discussion of results of meetings on e-mail;

• are supported by information mailing to members of council about results of consideration of the accepted recommendations of Council.

6. The chairman of the board is the Deputy Minister of Telecom and Mass Communications of the Russian Federation. Chairman of the board:

• performs the general management of activity of Council;

• distributes duties between members of council;

• approves the structures of the working groups of Council in case of their education;

• approves the work plan of Council (on the basis of proposals of members of council), regulations of work of Council, the agenda of meetings of Council;

• defines the structure of Council and its change.

The chairman of the board can have one deputy.

7. Secretary of Council:

• provides relevance of contact information of members of council;

• performs the organization of work on preparation of meetings of Council, prepares the agenda of a meeting of Council and creates the list of the persons invited to a meeting in coordination with the chairman of the board;

• provides preparation of the work plan of Council, performs collecting of materials on the questions which are subject to consideration at a meeting of Council;

• not later than in 15 working days prior to a meeting informs the members of council and persons invited to a meeting on the suggested agenda of a meeting, date, the place and time of its carrying out;

• carries out collecting and structuring the materials necessary for preparation of a meeting of Council provided to Council by the interested members of council within whose competence agenda questions, no later than 10 working days about day of holding a meeting of Council are;

• approves with the Chairman of the board the final agenda and the list of materials for mailing to members of council;

• sends the agenda and materials of a meeting of Council in 5 working days prior to the appointed date of a meeting;

• keeps the minutes of Council;

• sends to the copy of the minutes of Council to her members within 7 working days from the moment of its signing;

• reports to the chairman of the board on work of council in the next order and at the request of the chairman of the board;

• executes other obligations for order of the chairman of the board or his deputy.

8. In the absence of the secretary of Council of its power other member of council according to the solution of the chairman of the board executes.

9. Members of council:

• are present at meetings of Council, and at impossibility to be present at a meeting of Council beforehand inform on it the secretary of Council;

• make to the chairman of the board offers according to the plan of work of Council, to the agenda of meetings of Council and an order of discussion of questions at meetings of Council;

• represent to the responsible secretary of Council materials on the questions which are subject to consideration at a meeting of Council and also drafts of solutions of meetings of Council;

• propose candidacies of representatives of the interested federal public authorities and the organizations which are not a part of Council and also independent experts and other interested persons for participation in the enlarged meeting of Council, the working group;

• participate in discussion of the questions considered by Council and development of solutions on them;

• send at the request of the secretary of Council and for the solution in case of need to the secretary of Council the opinion on questions of the agenda of a meeting of Council or concerning results of a meeting of Council in writing.

10. The member of council in case of his absence at a meeting has the right to state the opinion on cases in point in writing which is disclosed at a meeting.

11. The meeting of Council is held according to the plan of its work.

In case of the questions requiring operational consideration emergency meetings of Council are held.

The meeting of Council is held by the chairman of the board, and in his absence on its order the vice-chairman of Council.

12. The main model of a meeting of Council – moderiruyemy the chairman of the board the discussion directed to collecting of opinions and development of consensus recommendations. The recommendations of Council are made out by the minutes of Council which are signed by the chairman of the board or the vice-chairman of Council holding this meeting and the secretary of Council.

13. The people who are not a part of Council in coordination with the chairman of the board can be invited to meetings of Council.

14. Organizational and technical and information and analytical ensuring activity of Council is performed by the Ministry of Telecom and Mass Communications of the Russian Federation and the secretary of Council. ____________
