The investigation had questions for Tikhonov regarding the activities that took place during his time as director of the REA. The investigating authorities also report the detention of two vice-presidents of Lanit in this case.
The investigation established involvement in the theft of at least 603 million rubles of the former director of FSBI REA Anatoly Tikhonov, his adviser Roman Ryzhkov, as well as vice-presidents of Lanit JSC Vladimir Makarov and Viktor Serebryakov. These persons are detained, the UK said in a statement. |
At the same time, they say in the UK, Anatoly Tikhonov tried to hide, using various methods of conspiracy, repeatedly changing the used cars and temporary locations in Moscow. Tikhonov was discovered during a search in his apartment together with officers of the FSB of Russia and the GUEBiPK of the Ministry of Internal Affairs of Russia.
Searches were carried out on the places of work and residence of the defendants, documents and objects of importance to the case were seized.
Tikhonov, Makarov, Serebryakov and Ryzhkov were charged with committing a crime under Part 4 of Art. 159 of the Criminal Code (fraud), the UK said.

According to the Kommersant newspaper, citing a source in law enforcement agencies, the criminal case under Part 4 of Art. 159 of the Criminal Code in the structures of the Ministry of Energy, the investigator for especially important cases of the Main Investigation Department of the Investigative Committee of Russia Maxim Bakun opened on March 10, 2020. Initially, an investigation was conducted against a group of unidentified heads of the ministry and its members[2].
According to the investigation, the newspaper writes, we are talking about embezzlement in the framework of the state program "Energy Efficiency and Energy Development" approved in 2014 for 2013-2015, which provides for the financing of measures for the development of GIS fuel and energy complex entrusted to the Federal State Budgetary Institution REA. The agency received subsidies totaling 968 million rubles from the ministry to finance this activity. According to the GSU TFR and the FSB, some of them were subsequently stolen, the Kommersant article says.
As part of the implementation of the program to create a GIS fuel and energy complex, the newspaper said with reference to the investigation materials, it was envisaged to conclude a number of state contracts for research and development and the supply of the necessary equipment for the functioning of the system. No later than October 2014, when Tikhonov headed the FSBI REA, officials, knowing about the allocation of subsidies to the agency, decided to "take advantage of this situation for the purpose of illegal self-enrichment by committing fraudulent actions." To commit them, the investigation believes, employees of both the FSBI itself and commercial organizations were used, "who agreed to take part in the thefts."
Extension of detention
On November 6, 2020, the Basmanny District Court extended Anatoly Tikhonov's preventive measure in the form of detention until February 8, 2021. This TAdviser reported in the press service of the court.

Anatoly Tikhonov and the vice-presidents of Lanit were not released from the pre-trial detention center, despite the efforts of famous lawyers
In December 2020, lawyers Anatoly Tikhonov, his adviser Roman Ryzhkov and vice-presidents of Lanit Vladimir Makarov and Viktor Serebryakov in the Moscow City Court made an attempt to rescue their clients from the pre-trial detention center and get them to change preventive measures to softer ones. All of them are involved in one criminal case on the theft of funds allocated by the Ministry of Energy of Russia from the budget, and earlier the Basmanny court extended their detention until February 8, 2021, while the investigation is underway.
One of Tikhonov's defenders is the famous lawyer Igor Kopenkin. He specializes in the protection of the rights of entrepreneurs and participation in economic criminal cases, protecting both those involved and victims. In 2015, he received the title of Honorary Lawyer of Russia.
At different times, Kopenkin successfully represented the interests of the leaders and employees of Adamas, ONEXIM Group, RusAl, BATO, RESO, Ukhtaneftegazgeologia, according to his biography on the website of the Yukov & Partners Bar Association. Also, for example, judging by media reports, he acted as the defender of one of the employees of the FSB "M" department, who were investigating corruption in the FSIN[3].
The name of the second lawyer, who filed an appeal in December, is not given in the published decision.
From the document[4] it follows that the defense considers the decision of the court to extend the period of detention of its client illegal and unreasonable, and adopted in the absence of factual and legal grounds. According to one of the lawyers, Anatoly Tikhonov, the court formally assessed the complexity of the criminal case and the severity of the act imputed to his client. He also pointed out that the reference to the gravity of the imputed act can be justified only at the initial stage of the criminal proceedings.
The second defender of Tikhonov believes that in the materials of the petition of the investigation to extend the period of detention of the accused and the court, when making the corresponding decision, the presumption of innocence was violated. He also argued that the investigation did not provide any evidence of the substantiated involvement of his client in the crime. The same lawyer believes that the decision of the Basmanny District Court contradicts the practice of the European Court of Human Rights, as well as the positions of the Constitutional and Supreme Courts of the Russian Federation.
Appeals, however, were dismissed. When deciding on the extension of the period of detention, the court of first instance carefully examined the evidence presented by the parties, listened to the participants in the trial, took into account the volume of procedural and investigative actions that must be carried out in the case, as well as all known data on the identity of the accused, indicated in the decision of the appellate court. The decision of the court of first instance is based on factual circumstances.
One of Viktor Serebryakov's lawyers, Valentin Bytensky, also has extensive experience. One of the clients in his practice was Fatima Misikova, a defendant in the case of the well-known in criminal circles Zakharia Kalashov (Shakro Molodoy)[5].
As in the case of Anatoly Tikhonov, the published document[6], based on the results of the meeting, provides the defense's position on the illegality and unreasonability of the decision of the Basmanny Court to extend its client's stay in the pre-trial detention center. The gravity of the crime in which Serebryakov is accused is not a legal basis for his detention, one of the lawyers argued.
The complainant also claims that during Serebryakov's detention, no investigative action was taken against him, despite the fact that the defence filed an application for his interrogation.
And lawyer Bytensky in his complaint, citing explanations of the decision of the plenum of the Supreme Court, indicated that due to the fact that Serebryakov exercised the authority to manage a commercial organization, his client is prohibited by law from choosing a preventive measure in the form of detention. The defender believes that the court did not substantiate the position that it was impossible to apply a milder preventive measure to Serebryakov, the specific factual circumstances of this were not given.
As in the case of Tikhonov, the Moscow City Court considered that the Basmanny court took the right decision to extend the period of detention. The petition of the investigator and the necessary materials confirming the arguments set forth in the petition were submitted to the court hearing, according to the decision of the Moscow City Court. And the head of the investigative department present at the meeting noted that the court checked Serebryakov's involvement in the commission of the crime charged with him, which is confirmed by the testimony of the persons questioned in the case, the protocols of investigative and procedural actions. The crime of which Serebryakov is accused does not belong to acts committed in the field of entrepreneurial activity, he also pointed out.
Decisions following the consideration of appeals by two other defendants in the case - Roman Ryzhkov and Vladimir Makarov - Moscow were not published on the court portal as of mid-January 2021. The Moscow City Court clarified to TAdviser that in their case the court also upheld the decisions of the Basmanny Court to extend the period of detention until February 8, 2021.

Extension of SIZO until May
On February 4, 2021, the Basmanny court, at the request of the investigation, extended the term of detention in the pre-trial detention center to Anatoly Tikhonov, his adviser Roman Ryzhkov, as well as vice-presidents of Lanit Vladimir Makarov and Viktor Serebryakov. The newspaper Kommersant , citing sources in law enforcement agencies, writes that Maxim Bakun, a senior investigator of the Main Investigative Directorate of the Investigative Committee for Especially Important Cases, who was known for a number[7], filed another petition to extend the terms of detention for the defendants in this case[8]
Also, according to the newspaper, Valery Kovalenko, Tikhonov's common-law wife, who is not officially connected with the Ministry of Energy, was released under house arrest, but is also accused under Art. 159, part 4 of the Criminal Code of the Russian Federation in the case of embezzlement of money allocated by the Federal State Budgetary Institution REA of the Ministry of Energy of Russia from the budget of the Russian.
Kommersant connects her commutation of punishment with the testimony that Kovalenko began to give, helping to identify a number of schemes for embezzlement of funds and their withdrawal abroad. Earlier, in October 2020, Valeria Kovalenko's lawyer disputed her detention in a pre-trial detention center, but to no avail.
According to Kommersant, during the investigation, the defendants did not find the stolen money, but established the presence of expensive real estate in Russia and abroad, issued for relatives of Anatoly Tikhonov. In addition, the investigation reached a number of channels through which funds went abroad.
Period 2019-2020. surpassed all past times in the number of arrested celebrities in the IT industry. Dismissal from the post of Deputy Minister of Energy
Russian Energy Minister Nikolai Shulginov approved the distribution of powers, as well as the list of his deputies, the Ministry of Energy reported on February 8, 2021. Anastasia Bondarenko, Evgeny Grabchak, Pavel Snikkars, Pavel Sorokin and Anatoly Yanovsky retained their posts .
The list did not include Deputy Ministers Anton Inyutsyn and Anatoly Tikhonov, who is under investigation in the fraud case. Proposals were made to the government to relieve Inyutsyn and Tikhonov from their posts[9].
The ministry's report notes that Shulginov approved the distribution of duties between his deputies, taking into account the new structure of the ministry, adopted at the end of 2020. Since January 1, in accordance with government decisions, the structure of the Ministry of Energy has been optimized and the number of its employees has decreased by 5%.
Three departments were abolished, which were headed by Inyutsyn, Tikhonov and Snikkars. Their functionality was distributed to other departments. The departments of refining, production and transportation of oil and gas, as well as the coal and peat industries and international cooperation were also merged.
The powers of Anatoly Tikhonov in the field of digitalization were divided between Sorokin and Grabchak. Additionally, Grabchak received Inyutsyn's functions regarding the regulation of project activities, and Tikhonov's duties in the field of financial and property relations were transferred to Yanovsky.
Anatoly Tikhonov and other defendants in the criminal case extended the term in jail until August
At the end of April 2021, the Basmanny court, at the request of the investigation, extended until August 8 the period of detention of Anatoly Tikhonov and three other defendants in this criminal case - Tikhonov's adviser Roman Ryzhkov and Lanit vice-presidents Vladimir Makarov and Viktor Serebryakov. Lawyers have previously tried to achieve a change in their client's preventive measure to a softer one. For example, house arrest or prohibition of certain actions. But so far these efforts have not been crowned with success.
Another attempt was made in early April: lawyers jointly filed appeals against the court's earlier decision to extend their client's period of detention in a pre-trial detention center. From Moscow the decision of the Moscow City Court published in the court database following their consideration, it follows that Anatoly Tikhonov, Roman Ryzhkov, Vladimir Makarov and Viktor Serebryakov deny their involvement in the crimes in which they are accused.
Igor Kopenkin, Tikhonov's lawyer, believes that when deciding on the detention of his client in jail, the court took the position of the prosecution, violating the presumption of innocence, follows from the published appeal decision.
Taking into account the new extension of the term of detention in the pre-trial detention center, the accused, who were detained in September 2020, will spend almost a year in custody while the case is under investigation, if the defense fails to achieve a change in their preventive measure to a milder one.
