Employees of the P department (industry) of the Economic Security Service of the FSB and the Main Investigation Department (GSU) of the TFR conducted searches at workplaces and in the apartments of the leadership of the Ministry of Energy with the seizure of documents and electronic media. According to the publication, searches were carried out as part of the criminal case initiated by the Main Investigative Directorate of the Investigative Committee under Part 4 of Art. 159 of the Criminal Code of Russia (fraud on an especially large scale). In addition, the searches were not authorized by the court, as they were issued as urgent investigative actions.

The investigation is engaged in episodes of theft as part of the financing of the development of the state information system of the fuel and energy complex (GIS Fuel and Energy Complex) under the state program "Energy Efficiency and Energy Development" for 2013-2015[1].

2019

The key purpose of the Fuel and Energy Complex GIS is to promptly provide the authorities and companies of the Fuel and Energy Complex with reliable information, analytics and forecasts on its basis, ensuring the development and implementation of effective management decisions at various levels.

Forsyth is developing the analytical subsystem of the GIS fuel and energy complex. The analytical subsystem allows you to automate the processes of storing, consolidating, classifying and structuring information in all areas of the fuel and energy complex, processing data on the state and forecast of the development of the industry, the processes of modeling and forecasting socio-economic phenomena in the field of the fuel and energy complex, the formation of analytical reporting, as well as the planning and monitoring of fuel and energy complex activities.

Analytical subsystem of GIS fuel and energy complex will be finalized on the basis of domestic software

The analytical subsystem of the state information system of the fuel and energy complex (GIS fuel and energy complex) will be finalized using exclusively domestic software. To realize this large-scale task, the Russian Energy Agency (REA) entered into an agreement with the Russian company Forsyth, which won the auction for the right to perform the corresponding work. Thus, Russian manufacturers have shown their readiness to provide software products that are not inferior in functionality to foreign counterparts.

Finalization of the analytical subsystem of the fuel and energy complex GIS is carried out in accordance with the course of the Government of the Russian Federation for import substitution of software and is designed to prevent possible sanctions risks in this sector. The analytical subsystem will automate the processes of storage, consolidation, classification and structuring of information in all areas of the fuel and energy complex, processing of data on the state and forecast of the development of the industry, the processes of modeling and forecasting of socio-economic phenomena in the field of the fuel and energy complex, the formation of analytical reporting, as well as the planning and monitoring of fuel and energy complex activities. The project will integrate the analytical subsystem into the structure of the GIS fuel and energy complex.

The action plan for the completion and commissioning of the fuel and energy complex GIS was approved by the Minister of Energy of the Russian Federation Alexander Novak in February 2018. According to Federal Law No. 382-FZ, the commissioning of the fuel and energy complex GIS should be carried out before January 1, 2020.

2017

REA Ministry of Energy cannot return 47 million for non-working storage

As CNews wrote in September 2017, the state contractor "Information Communications and Security Systems" (ISSB) continues to delay litigation for 15 months with the direct customer of the state information system of the fuel and energy complex of Russia (GIS fuel and energy complex), which is the Federal State Budgetary Institution "Russian Energy Agency" Ministry of Energy (REA). This froze for the project about 47 million rubles allocated by the state for storage for the GIS REA backup circuit[2]

Whether this storage was eventually assembled, CNews could not be found out. Theoretically, REA for this has an incomplete set of IBM equipment and about 24 million rubles. returned under the contract from the guarantor of the transaction with ISSB - AKB Derzhava.

The press service of the REA could not clarify the situation to CNews within two days. It was also not possible to contact ISSB for any comments - the company does not have an Internet site with contact information. The editors could not find new large-scale tenders of REA on the subject of storage for the GIS fuel and energy complex on the public procurement website.

What's wrong with storage

ISSB won the tender for the supply of the aforementioned storage facilities for GIS fuel and energy complex in October 2015. With a contract starting price of 80 million rubles. its offer amounted to 70.5 million rubles. In the final, Linkcom Service and Inline Group acted unsuccessfully as his rivals.

Note that the procedure passed with numerous slips. For this tender, the FAS received a total of seven complaints - from ISSB, Kaufman, Romanov and Partners, as well as Krafvey and Technoserv, which initially also claimed the contract. The participants appealed against the rejection of their applications (and initially the REA refused everyone at all), and also challenged the seemingly summed up procurement results - at the first, replayed later, Linkcom-service won the auction, almost without reducing the initial price.

The Accounts Chamber checked the GIS fuel and energy complex

The state information system of the fuel and energy complex of Russia (GIS Fuel and Energy Complex) was not commissioned in 2016, despite the money allocated to it and the work carried out, and budget spending was carried out in violation of the requirements of the legislation. Such conclusions were reached by the Accounts Chamber, having checked the implementation of the project in 2014-2016 [3]

As can be concluded from the report of the Director of the Department of the Accounts Chamber for expert analytical and control activities in the field of federal budget expenditures on fuel and energy systems, transport, road facilities Oleg Chernyavsky, the department tends to place all responsibility for the failure of the project on REA and the Ministry of Energy. The official never indicates the possibility of improper fulfillment of his obligations by the contractor of the agency.

List of claims against the state customer

The volume of budget allocations sent by the Ministry of Energy for the creation of GIS fuel and energy complex in the period of 2014-2016 amounted to 968.1 million, the report says. The informatization plans of the Ministry of Energy were approved in excess of the deadlines set by the Ministry of Communications, and these plans did not fully comply with the established forms. "In addition, the measures to create a GIS fuel and energy complex were not included in the Ministry of Energy's informatization plan for 2014, although they were financed," the Accounts Chamber said.

In 2014-2016, in the absence of approved informatization plans, the agency accepted obligations to create a GIS fuel and energy complex in the total amount of p862.3 million rubles. Due to poor-quality cost planning and deadlines at the end of 2014, a budget balance of p357 million (69% of the allocated volume) was formed. In 2015, the balance amounted to more than 10% of the annual volume.

"The planning of budget allocations for the operation of the GIS fuel and energy complex was carried out by the Ministry of Energy without taking into account the actual timing of its creation," officials said. As a result, the allocations for operation in the amount of p271.9 million provided for in the federal budget for 2016 were not used for the intended purpose and were redistributed in full at the end of the year. "

REA during the project did not ensure high-quality procurement procedures. Because of this, their participants filed numerous complaints with the FAS about violations of the provisions of the law "On the contract system." "Poor-quality preparation of auction documentation, as well as improper acceptance, led to the supply of equipment unsuitable for creating an information system," reads the conclusion of the Accounts Chamber. - For example, when accepting the storage system of the backup loop worth 70.5 million, its non-compliance with the declared requirements was not revealed. This discrepancy was revealed only during an additional examination. Absence of specified equipment does not allow to ensure full functioning of IE. To date, the bank guarantee has reimbursed the cost of acquiring the above equipment by only 24 million out of 70 million. "

Officials also believe that procurement planning was carried out without taking into account the actual timing of the implementation of measures. For example, the dates of the tender for the creation of the information protection subsystem did not take into account the degree of implementation of other measures to create the system. This led to an excess of the total deadline for the completion of work under the contract by 130 days.

The work on the GIS of the fuel and energy complex did not ensure the creation of all the necessary conditions for its operation. Thus, by order of the Government, a list of forms subject to approval by the Ministry of Energy for the provision of information by the entities of the fuel and energy system for their inclusion in this system has been determined. However, the Ministry of Energy does not properly organize this work. For more than three years after the signing of the Government decree on the forms of providing information to the GIS, the Ministry of Energy approved only 100 of 622 such forms.

In addition, REA did not provide the necessary number of system administrators and users. With the established indicator of 1.5 thousand people, 571-38% were actually prepared. "At the same time, the Ministry of Energy did not conduct verification of compliance with the terms of the Agreement directly at the agency," the conclusion said.

REA also violated the requirements of the instruction on the use of a single chart of accounts when reflecting certain facts of economic life in accounting. For example, accounting does not reflect intellectual property objects created as part of R&D to create the fuel and energy system. The agency did not make decisions on their assessment.

The launch of the GIS fuel and energy complex is overdue for a year and a half. Lanit and the Ministry of Energy exchanged claims for hundreds of millions

As it became known to CNews, a large-scale project to create the state information system of the fuel and energy complex of Russia (GIS fuel and energy complex) got out of the schedule for a year and a half. In accordance with the 600 million contract concluded in October 2014 between the Federal State Budgetary Institution "Russian Energy Agency" of the Ministry of Energy (REA) and Lanit, the work was to be accepted by the customer before October 1, 2015, but the[4] has not yet[5]

This is a system designed to automate the collection, processing, storage and dissemination of information on the state and forecast of the development of the fuel and energy complex of Russia.

The situation with the delay led to the fact that on January 19, 2017, REA filed a lawsuit with the Moscow Arbitration Court against Lanita to recover a penalty in the form of a penalty under the aforementioned agreement in the amount of p273.5 million.

The press service of Lanita told CNews that from the company's point of view, the reasons for the temporary delays were mainly in the organizational plane, so Lanit considers the requirements of the customer's statement of claim unfounded. Based on this, the company filed a counterclaim against REA. His amount is not disclosed in Lanit, but from day to day it will become public after the publication of the relevant documents by the court.

The first court meeting was held on March 27, 2017. According to the Lanita press service, according to its results, two lawsuits were combined into one case file, and new court hearings were scheduled for May 26, 2017.

In what state of GIS: comments by Lanita and the Ministry of Energy

Answering CNews questions about the state of the GIS fuel and energy project, the Ministry of Energy prepared an answer consolidated with Lanit in the Department of External Relations of the REA. It follows from it that the schedule for the contract determined 17 stages of the work. "Sixteen of them have been completed - acceptance certificates have been signed," the customer and the contractor assure.

Partners further report that when developing the system, it was decided to abandon the use of licensed software in favor of software developed on the basis of open source code. "This allowed to reduce the cost of support, ensured independence from foreign suppliers and the ability to provide technical support for the GIS fuel and energy complex software by domestic IT specialists," the letter says.

According to the parties, at the moment the development of the GIS fuel and energy complex and its pilot operation have been completed. Acceptance tests are underway, which are prescribed in stage 17: verification of all work performed for compliance with the state contract and related regulatory acts. Each SOW requirement is checked, each function is tested, customer comments are recorded and eliminated. The customer is scheduled to put the system into industrial operation in 2017.

Reasons for project delay

As part of the same consolidated comment, REA and Lanita claim that the project implementation time has increased, as there were difficulties that were not obvious at the stage of competitive procedures.

"It turned out that the existing regulatory framework requires significant processing and updating," the parties assure. - In particular, Government Order No. 2556-r dated December 26, 2013 does not reflect both the real needs of the Ministry of Energy for the information provided through the system and the ability of the entities to provide this information. This led to the need for additional work to update the regulatory framework and redesign the system. "

Also, according to partners, the increase in deadlines was affected by the difficulties in organizing joint work and in synchronizing the actions of a large number of participants in the process. "12 departments of the Ministry of Energy, dozens of fuel and energy complex entities - data suppliers and third-party organizations, each of which had its own opinion, worked on the project," the letter said. In addition, it was decided to extend the pilot operation of the fuel and energy complex GIS until December 2016, since REA and the Ministry of Energy considered the duration of the contracted pilot operation of the system insufficient. "

As a result, the acceptance certificates were not signed within the deadlines set by the schedule. "Therefore, REA, guided by Government Decree No. 1063 of November 25, 2013, calculated penalties and filed a lawsuit with the Moscow Arbitration Court, demanding that the amount obtained as a result of the calculation be recovered from Lanit, thereby expressing claims only to the terms of work," the letter with REA's remark ends.

2015

Project Progress

On November 23, 2015, it became known about the likely postponement of the acceptance/delivery dates of the GIS fuel and energy complex, which Lanit was to transfer to the state customer by October 1, 2015. Presumably, the work will be completed in December 2015, but the commissioning of the system may be postponed if the Ministry of Energy considers it necessary to carry out its own acceptance of GIS, as required by the decree of the Government of the Russian Federation[6].

According to CNews, Lanit was unable to complete the design work on time. Under the terms of the agreement, by October 1, 2015 the system should be ready, but on November 23, 2015 it was not transferred to the customer - the Federal State Budgetary Institution "Russian Energy Agency" (REA) of the Ministry of Energy.

Viktor Serebryakov, Director of the Lanita Integrated Projects Department, explained to CNews the reasons for the postponement of the contract:

- A survey of the existing regulatory framework in the context of the future work of the GIS FEC revealed that it requires significant revision and updating. In particular, Government Order No. 2556-r of December 26, 2013 does not reflect both the current information needs of the Ministry and the ability of the entities to provide this information. This led to the need for additional work. In addition, REA expanded the volume of experimental operation, both in the composition of subjects and the nomenclature of information collected, and in its duration. I am sure that increasing the volume of pilot operation and stepwise commissioning is a good solution that will help make the process of transition of all fuel and energy complex subjects to a new system more systematic and productive.

Roman Shcherbov confirmed what was said:

- Under the contract, Lanit must prepare draft orders regulating the procedure for collecting forms of information in the GIS fuel and energy complex. The Ministry of Energy will have to approve them and send them for registration to the Ministry of Justice.

According to Serebryakov, being in experimental operation, the system collects data from the "pilot" subjects of the fuel and energy complex of Russia, enshrined in federal law No. 382-FZ of December 3, 2011. For subsequent maintenance and operation of the system on the basis of REA, the Ministry of Energy forms an organizational and staff structure.

Serebryakov stated:

- GIS is ready to collect data from thousands of industry companies, implemented all forms of providing information in accordance with the current Government Order No. 2556-r dated December 26, 2013, which is more than 600 forms. This amount of information collected simultaneously is a unique solution for the industry. There is an analytical repository, and the ability to flexibly build reporting on existing data is also provided.

According to the contractor, the project used open source software, which, according to developers, will reduce the cost of support, ensure independence from foreign suppliers and make it possible to provide technical support to the complex by Russian IT specialists.

Project Plans

The pilot operation of part of the GIS segments of the fuel and energy complex is scheduled for mid-2015. The integration segment was planned to be commissioned in October 2015, industry segments - before the end of 2015.

According to CNewsRoman Shcherbov, director of the GIS fuel and energy project at the REA of the Ministry of Energy, the final composition of the participants in the planned pilot implementation of the GIS fuel and energy complex and pilot operation of the system on October 17, 2014 was not determined, but by this date a number of electro-energy and vertically integrated oil companies announced their desire to participate in the pilot project.

2014

Creation of FEC GIS working model

In December 2014, about a month after the conclusion of the agreement with REA, Lanit already announced the creation of a working model of GIS fuel and energy complex, which will allow testing the main functions and algorithms of data processing, technological solutions for various components of the system.

The model contains blocks of regulatory reference information, data collection and loading tools, internal and external integration, an information portal, and analytical reports.

Lanita says that after the model is approved by the customer on its basis and using tested technological solutions, a full-featured version of the system will be developed, which, when entering production mode, will allow collecting and processing data from 700-800 different sources with a total volume of more than 1Tb per year.

The system simulation was preceded by a survey of data collection, processing and provision processes, an analysis of the state of information flows, the needs of the main users of information, clarification of the composition of the functions of the system and an analysis of existing automation tools. Draft regulations governing the creation and use of the system, private technical tasks for the development of its individual segments were prepared and handed over to the customer, Lanita added.

Auction

The initial (maximum) price of the lot was set at 700 million rubles. The maximum price was requested by Krok (665 million rubles), the minimum - R-Style (590 million rubles). "Lanit" was forced to do the work for 607 million rubles, University of Oil and Gas named after I.M. Gubkin (the company "Forecast" spoke with him in a consortium) - for 630 million rubles, "Informzaschita" - for 645 million rubles.

According to the results of the consideration of applications on October 16, 2014, Lanit won:

  • the application of the I. M. Gubkin University of Oil and Gas was recognized as inconsistent with the law on the contract system due to the fact that documents were submitted from two organizations (the university does not have the licenses necessary for the work).
  • Crock was refused due to the lack of a specific contract term in the application.
  • R-Style scored 56.57 points and offered the best price, ahead of Lanit in terms of "qualification of labor resources (managers and key specialists) offered for work," but the assessment of the experience of R-Style was 3 points lower.
  • Informzaschita lost to competitors according to the criteria for assessing qualifications, experience and reputation.

Contractor Selection

In November 2014, the REA of the Ministry of Energy, following the results of an open competition, signed an agreement with Lanit for the implementation of research and development work to create a GIS fuel and energy complex.

In addition to Lanit, the following companies also participated in the competition: R-Style, Krok, Informzaschita and the Russian State University of Oil and Gas named after I.M. Gubkin.

The university's application was found not to comply with the law on the contract system due to the fact that the documents were submitted from two organizations, while the university itself does not have the licenses necessary to carry out the work. Crock was denied the tender for the reason that its application did not specify a specific term for the performance of the contract. After evaluating the documentation of the remaining applicants, Lanit received the highest rating - 58.47 points.

The results of the competition were the subject of two proceedings in the Moscow administration of the Federal Antimonopoly Service, which ended in the rejection of complaints of R-Style and RSU oil and gas named after I. M. Gubkin. The decisions of the FAS confirmed that the competition was held in accordance with the law, and the competition commission of the REA did not commit any violations when choosing the winner.

2011: Preparation

On December 3, 2011, the Federal Law on the GIS of the fuel and energy complex was adopted, and in the period from 2012 to 2014, a number of regulatory legal acts were approved that regulate the main stages of its creation and implementation.

The Ministry of Energy formed a commission on the creation and commissioning of GIS fuel and energy complex, which included representatives of the apparatus of the Government of the Russian Federation, federal executive bodies and interested organizations.

The main work on the creation and implementation of the GIS fuel and energy complex in 2014-2015 is implemented on the basis of the REA of the Ministry of Energy in accordance with the subsidy allocated from the federal budget.

On July 30, 2014, a meeting of the commission on the creation and commissioning of GIS fuel and energy complex was held at the Ministry of Energy, following which the plan for the creation of GIS fuel and energy complex, which provides for the commissioning of the system in October 2015, was approved by the REA.
