Detention

As TAdviser found out, Yuriy Datsenko was detained by law enforcement agencies. This publication was reported by two of his acquaintances. The detention is confirmed by data from the file cabinet of courts of general jurisdiction of Moscow: it contains a record that on September 19, the Cheryomushkinsky District Court issued a decision to satisfy the petition for the election of Y.N. Datsenko as a preventive measure in the form of house arrest[4].

It also contains a note dated September 24 about the appeal received in connection with the chosen preventive measure. As of September 30, the complaint has not yet been considered.

Part 4 of Art. 159 of the Criminal Code of the Russian Federation (fraud committed by an organized group or on an especially large scale). The circumstances of the case are not given in the file cabinet.

In the WhatsApp messenger, Yuriy Datsenko was last online on September 16. When placed under house arrest, as a rule, the court imposes restrictions on the use of communications.

The last place of work of Yuri Datsenko in open sources is the "Russian Export Center," the position is the senior managing director for the implementation and development of the project "One Window"[5] TAdviser has submitted a request and is awaiting comment from that organization in connection with the employee's detention.

House arrest extension

On October 25, at the request of the investigation in the Cheryomushkinsky District Court of Moscow, Yuri Datsenko extended the preventive measure. The court told TAdviser that he was extended his detention under house arrest until November 19.

Shortly before that, on October 22, the Moscow City Court considered the appeal of Yuriy Datsenko against placing him under house arrest, which took place in September, according to information in the database of courts of general jurisdiction in Moscow. It is possible that the extension of house arrest will be appealed.

Receipt of a criminal case in court. New defendants

As TAdviser discovered, the Koptevsky District Court of Moscow on October 28, 2024 received a criminal case against Yuriy Datsenko, who was detained in September. From the card in the database of courts of general jurisdiction of Moscow it follows that two more people are involved with him in this case - Izraztsov D.M. and Tomin S.N. In relation to all three persons, the card contains the same part of the article - part 4 of Art. 159 of the Criminal Code of the Russian Federation (fraud committed by an organized group or on an especially large scale)[6]

Yuriy Datsenko was detained in September and has been under house arrest ever since

Yuriy Datsenko previously tried to challenge the measure of restraint chosen for him and achieve a change in house arrest to prohibit certain actions by filing an appeal. From the published appeal decision of the Moscow City Court on this complaint of October 22, it follows that the criminal case refers to the commission of a crime "as part of an organized group, all the accomplices of which have not yet been established"[7].

The criminal case in connection with which Yuriy Datsenko was detained was initiated on October 26, 2023 on the grounds of crimes under Part 4 of Art. 159 of the Criminal Code of the Russian Federation against unidentified persons. On the same day, Izraztsov and Tomin were detained, and at first in their case it was about part 3 of article 159 of the Criminal Code of the Russian Federation (fraud committed by a person using his official position, as well as on a large scale)[8]. From that moment on, they were kept under house arrest, the term of which was extended, and in April 2024 the preventive measure was changed to a ban on certain actions.

From the court decisions on their appeals it follows that Izraztsov D.M. worked as deputy head of the economic support department at the Scientific Center for Legal Information at the Ministry of Justice (NCPI). According to TAdviser, he was a colleague of Yuriy Datsenko in this organization and quit there a couple of months earlier than Yuriy Datsenko himself. And Tomin in the appeals decisions of the Moscow City Court is indicated as an individual entrepreneur.

From the same published court documents it follows that the victim in the case is an organization. Which organization is not specified. But according to a TAdviser source close to the NCPI, we are talking about the NCPI, and one of its state contracts appears in the case - to modernize the institution's access control system (MCDS). The price of the state contract, according to the interlocutor of TAdviser, amounted to 599 thousand rubles and included work on dismantling the old system, supplying new equipment, installing and configuring it. Tomina's company became the executor of the state contract, offering the best conditions in accordance with the 44-FZ.

Earlier, satisfying the petition to extend the term of detention of Izraztsov and Tomin under house arrest, the court in the decision indicated that as of December 2023, the investigating authorities had yet to: conduct an inspection of the scene of the incident and the actually installed equipment, appoint a commercial forensic examination, continue measures to identify other witnesses and, if established, interrogate them, check Tomin, Izraztsov and other persons for involvement in other episodes of criminal activity.

Change in preventive measure

On November 18, 2024, Yuriy Datsenko told TAdviser that the other day he had changed the measure of restraint from house arrest to a ban on certain actions.

2025

The beginning of the trial. A criminal case was initiated over the purchase of 599 thousand rubles

In the Koptevsky District Court of Moscow, consideration began on the merits of a criminal case on fraud (part 4 of article 159 of the Criminal Code of the Russian Federation), initiated against Yuri Datsenko, Dmitry Izraztsov and Sergei Tomin. In the court session on January 23, which was visited by the TAdviser correspondent, there was an interrogation of the representative of the injured party - Dmitry Gubar, leading legal adviser of the procurement department of the administrative department of the Scientific Center for Legal Information under the Ministry of Justice (NCPI). Although he did not work in the specified organization during the events described in the criminal case, he nevertheless presented the situation in court on the basis of company documents.

The building of the Koptevsky District Court, where the hearing in the case of Datsenko, Izraztsov and Tomin is taking place

He told the court that in 2021, in terms of the financial and economic activities of the NCPI under the Ministry of Justice of the Russian Federation, there was a modernization of the access control system (MCDS), which was supposed to be organized by Yuri Datsenko, as at that time the director of the NCPI, and Dmitry Izraztsov, as the head of the logistics and transport support department of the same organization.

To select the contractor for the modernization of the MCDS, Dmitry Izraztsov sent requests for price information on the cost of these works to Galiot LLC, Fartex LLC, SB Sector LLC, individual entrepreneur Dmitry Mogile and some others. Of all the commercial proposals presented, the proposal of Galiot LLC, whose director was Sergey Tomin, was chosen. The company offered to perform work for 599 thousand rubles. At the same time, it was decided to make a purchase by direct contract, and not in a competitive way, since the procurement law (No. 44-FZ) allows for a purchase from a single supplier at a price below 600 thousand rubles.

As a result, in August 2021, NCPI signed an agreement with Galiot LLC to carry out work on the modernization of MCDS in the amount of 599 thousand rubles with a deadline of 15 working days.

At the same time, the source of funding was funds from activities that bring income to the NCPI, said Dmitry Gubar. This purchase was not posted on the official public procurement portal, so it is not possible to find it there and study the terms of reference and the terms of the contract.

Within the appointed period, the parties to the contract signed an act of acceptance of the work performed. According to him, the quality of the work performed met the requirements of the contract. According to the representative of the NCPI, the system is still working, and its modernization was not carried out after. That is, the work under the concluded contract was completed in full, and the money for it was paid to Galiot LLC in a timely manner.

Moreover, according to Dmitry Gubar, the act did not provide for the transfer of any equipment - only the comprehensive performance of work. During the interrogation, answering questions from lawyers and the judge, he could not explain who, in fact, supplied the equipment, and even suggested that he was "found in the trash." According to the representative of the NCPI, the specification to the contract includes only the provision of one service - the performance of work on the modernization of the MCDS for the above amount.

The prosecutor read out the materials of the preliminary investigation, on which the same Dmitry Gubar had previously stated that the annex of the agreement contained a specific list of work carried out, which should have included the dismantling of old equipment and the installation of Kodos readers, as well as electromagnetic locks and control buttons, controllers, detectors, uninterruptible power supplies, video recorder, PC with the appropriate software. Moreover, clause 3.1 of the contract contained the phrase that "the Contractor undertakes to provide the materials and equipment necessary for the work."

About two years after the execution of the contract, in October 2023, with the filing of the NCPI, a criminal investigation was launched, within the framework of which an examination of the work performed was carried out. It, in particular, indicated the approximate cost of equipment installed during the work on the execution of the contract. This happened after Yuriy Datsenko left his post at the NCPI in November 2022. By this time, Dmitry Izraztsov was also dismissed from his post in the same organization.

The cost of equipment and its installation, according to experts hired by the preliminary investigation, is 299,313 rubles, which the investigation interprets as evidence of an overestimation of the contract price.

Dmitry Gubar told the court that the investigative actions of the injured party became known when the inspection of the scene was initiated, the examination of the work performed - at the end of 2023.

The investigation believes that as a result, these persons caused property damage to the NCPI in the amount of 599 thousand rubles, which the victims ask to recover from the accused in a civil suit filed in the criminal case, Dmitry Gubar announced in court.

At the same time, the plaintiff's representative recognizes the installation and high-quality operation of the equipment at the moment. He also noted that after the work carried out in 2021, the modernization of the MCDS was no longer carried out.

Dmitry Gubar also voiced the version of the preliminary investigation that in fact the work on the modernization of the MCDS was carried out by the employees of the NCPI on their own. However, there was no evidence of such activity in this court session - at further meetings it is supposed to hear the testimony of witnesses Pleshkov and Churbanov, who at that time were employees of the NCPI. And after the presentation of evidence is completed by the prosecution, the turn will come to present the evidence of the defense.

TAdviser will continue to monitor the progress of this criminal case. The next hearing in the case is scheduled for February 4.

The court softened the measure of restraint on recognizance not to leave

On February 4, the Koptevsky District Court of Moscow continued to consider the criminal case of Yuri Datsenko, Dmitry Izraztsov and Sergei Tomin. This time, in a meeting attended by a TAdviser correspondent, the court interrogated two more witnesses - Oleg Altunin and Galina Radina, and also softened Yuri Datsenko's preventive measure.

The court softened Yuri Datsenko's preventive measure for recognizance not to leave

Oleg Altunin at the time of the conclusion of the contract, against the background of which the criminal case subsequently unfolded, was a colleague of Yuri Datsenko: he worked at the Scientific Center for Legal Information under the Ministry of Justice (NCPI). He did not participate in the preparation of the disputed contract, but the investigation attracted him as an expert who assessed the quality of the preparation of the contract according to documents for compliance with the requirements of the procurement law No. 44-FZ.

The witness confirmed that in accordance with the methodological recommendations of the Ministry of Economic Development to determine the cost of work, the NCPI sent five letters to the MCDS suppliers with a request for a commercial proposal, which was prepared by Dmitry Izraztsov. Three responses were received from various organizations, which corresponded to the guidelines for determining the initial maximum contract price.

As a result, the NCPI concluded an agreement at a minimum price of 599 thousand rubles from those submitted by suppliers. The correctness of the contract before its final signing was checked by the procurement department, deputy director for economics and head of the economics department.

Witness Galina Radina at the time of the events described worked at the NCPI as deputy head of the logistics department and was subordinate to Dmitry Izraztsov. She showed that although she envisioned the certificate of work performed under the contract, her duties did not include either the preparation of the contract or the acceptance of the contractor's results.

To check the performance of work at the enterprise, a acceptance commission was created, which was supposed to check the operability of the system. Although Galina Radina was not a member of this commission, she confirmed that the act said that no shortcomings were revealed during the acceptance of the work, and the work itself was completed on time. It only cheated the results of the activities of this commission, fully trusting them, to register the corresponding system as the fixed assets of the enterprise. The witness also confirmed that the system itself is installed and working.

In addition, the lawyer of Yuri Datsenko, in connection with the need for his client to attend various conferences in the country, petitioned to soften the preventive measure for a recognizance not to leave. The judge agreed with the arguments of the defense lawyer and granted the petition. Prior to this, we recall that a preventive measure was established for Yuriy Datsenko in the form of a ban on certain actions.

The court has scheduled the next hearing for February 21, during which it is also expected to hear testimony from witnesses in the case. TAdviser will continue to monitor developments.
