Shoe deliveries to Russia are delayed for weeks due to problems with the labeling system

At the end of October 2020, deliveries of shoes and perfumes to Russia began to be greatly delayed due to problems with the system of mandatory labeling of these goods. So, the Zenden Group announced "constant" system failures.

According to Vedomosti, the speed of commodity flows was greatly slowed down: containers can remain at customs for up to a month, while earlier this did not take more than three days. Sometimes it happens that some goods do not have time to get to store shelves by the season. For example, this happened with a batch of children's sports shoes, and suppliers missed the beginning of the school year and suffered losses. As for perfumery, delays in deliveries can be up to two weeks.

Similar problems are observed   in the field of perfumery. Failures arise in  deliveries from  importers  to distributors,  and from  them   to retail networks. Due to  various equipment, retailers  cannot capitalize on time.

According to Ilya Dmitriev, director of the legal department of the large Gradient distributor, when connecting each supplier to the system, it must be configured, and it can take 3-4 days to eliminate errors. Such deadlines are unacceptable, for example, in the pre-New Year season of high demand.

According to data obtained using the MarkOffice system, about 83% of all ordered marking codes were put into circulation. These statistics confirm that participants in the turnover of footwear products not only test the introduced business processes, but also actively label products and put them into circulation.

According to ATOL, the most effective labeling among cities and regions is introduced To Moscow in and - Moscow region 16%, which is associated with a developed infrastructure, the concentration of a large number of manufacturers and retail enterprises in the region, trade as well as a higher awareness of business about labeling.

Violation of mandatory marking rules entails administrative and even criminal liability. According to Art. 15.12 Administrative Code, the sale, transportation and production of shoe products without appropriate marking entails a fine of 5 to 10 thousand rubles for an entrepreneur. Companies that violate the law will be fined from 50 to 300 thousand rubles. In all cases, unmarked footwear is subject to confiscation. Criminal liability occurs in cases where the value of unmarked goods exceeds 1.5 million rubles. According to Art. Part 1 of Art. 171.1 of the Criminal Code, the offender faces imprisonment of up to 3 years with a fine of 80 thousand rubles.

Footwear labeling and business: upcoming changes

On July 1, 2019, registration of participants in the turnover of shoe goods in the Honest Sign system (CRPT) began. As with tobacco, labeling will be introduced gradually in this market segment. Representatives of the fiscal data operator told TAdviser about the prospects for innovation and changes that the business expects in the near future on July 11, 2019 OFD.ru.

Shoes have already become the third category of goods (after fur and tobacco products), which are subject to mandatory labeling. Entrepreneurs need to register with the Honest Sign system (CRPT), since the circulation of unmarked shoe products will be banned from March 1, 2020.

From October 1, 2019, the CRPT will provide business with access to devices for registering the issue of marking codes - voluntary marking of shoes and the transfer of information to the monitoring system will begin. The cost of the marking code was approved by Decree of the Government of the Russian Federation No. 577 of May 8, 2019 and will be 50 kopecks excluding VAT. When entering into circulation, a means identifications in the form of a Data Matrix code will be applied to shoe products. Unlike tobacco products, the code can be applied not only to consumer packaging, but also to the product label, label of shoe goods or to the product itself.

When goods are transferred along the producer-distributor-retail chain, documents are exchanged between participants using electronic document management (EDO) systems. To avoid sending hundreds of codes in a single document, you can use aggregation of product identification codes into a shipping package and transfer to a shipping package code system. The transfer of retail sales information to the final buyer is carried out using the CCP when forming a cash check - the information is sent to the fiscal data operator, and he already transfers it to the CRPT, explained in OFD.ru.

After registration in the marking system, the CRPT from October 1, 2019 will begin to give entrepreneurs access to marking code emission registration devices. ATOL and "OFD Platform" prepared their systems for marking shoes

Starting in July 2019, the marking of shoe products will become mandatory. ATOL, CRPT and CRF Platform tested their systems for receiving, processing and transmitting two-dimensional barcodes in a cash check. The experiment showed the complete readiness of companies to work with next-generation identification codes, ATOL reported on December 25, 2018.

Changes in the labeling appeared as a result of the entry into force of Decree of the Government of the Russian Federation No. 620 of 30.05.2018, which obliges manufacturers and importers of shoes to apply Data Matrix codes on packaging or on a product label.

According to ATOL representatives, the marking allows you to record the transition of goods from owner to owner, which makes the market transparent for both participants and end consumers. Through such codes you can trace the entire path of each pair of shoes - from its production to purchase.

To prepare the market for change, the Center for the Development of Advanced Technologies (CRPT) initiated a pilot project. It was attended by several manufacturers of shoes, cash registers, the fiscal data operator and the operator of the product labeling system.

The experiment focused on the process cycle of verification, decryption and verification of the digital marking code at all stages of the supply chain. Information about each specific pair of shoes is successfully transmitted by ATOL cash register equipment through all electronic document management systems, both at the receipt and sale of goods.

Testing of the marking system in Zenden

According to August, another 12 participants in the pilot project are configuring the software and starting testing. Among them: "Moscow shoe factory" Paris Commune, "Analpa," "Yegoryevsk-Shoe," "Sportmaster," "Economica" and many others.

According to representatives of the CRPT, the marking of footwear products will make the accounting of goods transparent, will ensure uniform rules of work for all market participants, and, therefore, will create single competitive conditions for them. In addition, the transition to labeling will contribute to the emergence of a public control tool, when the buyer at any outlet can verify the legal origin of the products and see the entire path of the goods to the store on the smartphone screen.

Shoe labeling experiment

From June 1, 2018, an experiment on the labeling of shoe goods in order to combat their illegal trafficking will begin in Russia. The corresponding government decree No. 620 was adopted on May 30, 2018 and posted today on the website government.ru. The document indicates that the experiment will last until June 30, 2019.

The marking of shoes will make it possible to track and stop cases of illegal production, import and sale of shoe goods. This in turn will lead to the fact that all taxes and customs duties will be paid from goods, explained on the government website[2].

The results of the experiment will be evaluated in two stages - December 1, 2018 and May 1, 2019. They will help assess the effectiveness of the use of labeling, after which a decision will be made on its mandatory introduction in Russia. It is assumed that the marking of shoes will become mandatory from July 1, 2019.

The Ministry of Industry and Trade will coordinate and monitor the work of shoe sellers as part of the experiment. He will also participate in the development of requirements for the information system, which is due on July 1.

In addition, by the same date, the Ministry of Industry and Trade should develop and approve methodological recommendations and a schedule for the experiment. Guidance should indicate which identification means will be used for marking. Guidance should also clarify which codes and how these identification tools will be applied, how these codes will be generated and what technical means will be read.

The same guidelines should contain information on how the information system of the experiment will interact with the information systems of its participants, and how the participants will be registered in this system. Also, methodological guidelines will determine the composition of the information that should be contained in the information system of the experiment, and the procedure for their introduction into the system.

The experiment will also be attended by the Ministry of Finance, the Ministry of Digital Development, the Federal Security Service (FSB), the Federal Tax Service (FTS), the Federal Customs Service and the Federal Service for Supervision of Consumer Rights Protection and Human Welfare.

Participants of an experiment

For manufacturers, importers and sellers of shoes, the experiment will be voluntary. The operator of the information system, in which data on labeled goods will be stored, will be LLC Operator-CRPT free of charge. By June 1, the operator must develop requirements for the information system, encryption and security tools.
