History

2023: New defendants  and details appeared in the criminal case on the state contract of the Ministry of Defense with the "daughter" of Depo Computers

Until May 24, 2023, it is expected to complete the preliminary investigation in the criminal case on the state contract of Antey LLC, the subsidiary of Depot Electronics (operates on the market under the Depo Computers brand), p. Ministry of Defence Russia This follows from the decision of the Basmanny Court, published in the database of courts Moscow following the meeting held at the end of March 2023[2]

The case was initiated back in August 2018 by the Investigative Department of the Ministry of Internal Affairs of Russia on the grounds of a crime under Part 4 of Art. 159 of the Criminal Code of the Russian Federation, on the fact of embezzlement of budget funds during the supply of external memory devices to Antey LLC under a state contract with the Russian Ministry of Defense.

The state contract for the supply, which interested law enforcement agencies, was concluded in 2016. The Kommersant newspaper wrote that, according to the investigation, during the implementation of the contract, violations were committed, expressed in overestimation of the cost, as well as "non-compliance with the conditions for the country of production of one of the items of the equipment produced[3].

One of the first arrested in the criminal case was Alexei Irisov, at that time - the general director of Depot Electronics. According to the database of legal entities Kontur.Fokus, "he owns a small share in the company - 1% in the authorized capital. His lawyer in 2018 stated that the contract with the Ministry of Defense "was executed in a timely manner and in full, no claims were received from the state customer[4].

And in July 2022, it became known about the absentee arrest of the key owner of Depot Electronics, businessman Sergei Eskin. He was put on the international wanted list, follows from the published court documents[5].

Now, along with Alexei Irisov, the database of Moscow courts lists new persons involved in this case[6]: M.A. Balabanov, A.A. Voranovsky, Gorshkov A.A., Koveshnikov M.V., Kochepasov S.A., Lebedinets A.V., Orlov A.V. A.M. Solovyov

All of them and Alexei Irisov pass under Art. 159, part 4 of the Criminal Code of the Russian Federation (fraud committed by an organized group or on an especially large scale). They were charged in March and April 2022, and the charge in the final version - in February and March 2023, follows from the published appeal decision of the Basmanny Court[7].

TAdviser sent a request to Depo Computers, but at the time of publication of the material, the company could not clarify to TAdviser who is who from the list above, and whether there are current employees of the company among them.

The surnames and initials of the names and patronymics of a number of persons from the list coincide with similar data of persons who previously appeared in open sources as related to Depo Computers. For example, the company had a director of the department for work with government agencies named M.A. Balabanov, and a man named M.V. Koveshnikov since 2019 was listed as the general director in the company LLC "Dick," where at that time the founder was Sergey Eskin. In early 2021, this company was liquidated.

A person named S.A. Kochepasov appears as an applicant for a number of previously obtained certificates of conformity for various products of trading Depo and DEPO Computers brands. In the same capacity, the applicant for certificates for Depo products with name A.V. Lebedinets is also present in public databases.

Alexey Orlov, present in the list, is a lawyer who, according to the investigation, provided legal advice to employees of Depot Electronics LLC and Antey LLC. The court document published in the Moscow court database of August 2022 briefly summarizes the version of the investigation about its role in this story:

Orlov A.V. maintains contact "with the organizer of the criminal group, who disappeared from the investigation authorities, informing him about the progress of the investigation of the criminal case," said at the same time in the petition of the investigator, voiced in court.

And at the end of March 2023, the Basmanny Court, in particular, considered the case at the request of the investigation to establish a certain period for familiarizing the accused with the materials of the criminal case. Their volume is 165 volumes plus material evidence and other materials attached to the protocols of investigative actions, as well as 4 volumes of additional materials.

The defendants began familiarizing themselves with the case materials in April and May 2022. Now all of them have set a deadline until April 7, 2023.

The court believes that enough time was allocated to familiarize themselves with the case materials, including because "the accused worked for a long time in senior positions in a commercial organization. The performance of duties in this area was associated with significant document flow, study, processing and analysis of a large amount of service documentation. " And Alexey Orlov "has the status of a lawyer, that is, has professional knowledge in the field of jurisprudence[9] of[10].

DEPO CEO Sergei Eskin calls his company engineering - "this is not only a system integrator or IT service provider, it is an effective IT manager who can satisfy literally any business task: from the production of equipment for unique needs to IT management as an outsourcer"[22]

In this concept of engineering, according to Eskin, the main difference between DEPO Computers and most Russian system integrators: "In projects, we use 80% of what we ourselves produce, due to our own production, we give the customer the best prices and optimal, without excess, functionality."

This transformation is not the first carried out by Sergey Eskin. The business from which DEPO arose was created in the 1990s. as the distribution company Diline (part of the IBS holding), and its own PCs were launched on the market in the early 2000s. The company finally abandoned the distribution business during the crisis period 2008-2009.

"When we created Diline, we focused on the Merysell experience when we started manufacturing computers - equal to Dell. Now we are building an engineering company and IBM is an example for us, "says Eskin.

"But that doesn't mean we'll sell the PC business," he adds. "The principle that we adhere to is to help solve customer problems, and not just sell certain products to him."


Despite comparing its business model with IBM, DEPO considers HP to be the main competitor in Russia. "They, unlike IBM, have a well-built partner channel," says Eskin.

DEPO plans to compete with HP at the expense of lower prices for its products and services. "In servers, the difference with HP is on average 25%, in projects - 35-40%," said the CEO of DEPO. "This is achieved due to the fact that we do not offer redundant solutions."

For 2011, DEPO supplied 80% of standard products and 20% of unique ones. "After 2 years, we aim to make this ratio 50 to 50, and after 5 years - 20 to 80," the company says.

The number of employees in 2011 was 600 people: 200 sales specialists, 200 plant employees, 200 engineers and office employees, of which 30 were product managers, 20 were employees of the research center.

2010: Reduced revenue and increased profitability

By reducing PC shipments, DEPO reduced revenue several times to $170 million in 2010. But business profitability increased - from 7% in 2007 to 25% in 2010.

Depo Computers branch from IBS

On September 4, IBS Group Holding officially announced the sale of its PC and server assembly business - DEPO Computers. 100% of DEPO's shares were bought out by its management. "The amount of a possible transaction, according to our approximate estimates, may amount to about $60-70 million (taking into account a debt of $30 million)," says Maxim Klyagin, an analyst at Finam Management Management. "Despite the current unfavorable market conditions for PCs and equipment (against the background of falling demand, there is a significant, about 30%, decline in sales), the long-term prospects of the PC assembler can be assessed as quite attractive."

A top executive at another computer assembler also rates Depo's position as "pretty strong."

"Probably, in the context of the crisis, IBS could not find a buyer from the outside, ready to take a chance and acquire a company with a strong brand on the one hand, and large loan debts on the other," he argues on condition of anonymity. - We are talking, rather, about a formal change of owners, who were found "in the near circle." Today, DEPO's positions are quite strong, they are present both in Moscow and in the regions, they poured well into them in order to keep them, but, apparently, the source has dried up. "

Recall that as of March 31, 2009, VTB Capital analysts estimated the total debt of the entire IBS Group at $68 million.
