The Government of the Russian Federation banned state purchases of foreign ventilators

Prime Minister RFMikhail Mishustin signed a decree banning state purchases of some types of devices for artificial ventilation of the lungs (IVL) of foreign production. The corresponding document was published on the official portal of legal acts on December 15, 2023.

We are talking about the following ventilators:

  • with nomenclature classification of medical devices 232870 (neonatal intensive care devices/for adults);
  • with nomenclature classification of medical devices 232890 (general-purpose intensive care devices).

Government bans public procurement of foreign-made ventilators

These types of medical equipment were excluded from the list of resolution No. 878, which regulates the application of the "second extra" rule, and are included in resolution No. 616, which regulates the ban on the purchase of imported products on the state order market, with the exception of a number of reservations.

The OKPD2 codes 32.50.21.121, 32.50.21.122 and 32.50.21.123 are indicated as a guideline, but it is stipulated that customers can focus on both NKMI and OKPD2 codes. In addition, the corresponding amendments were made to Resolution No. 2014 of December 3, 2020, which determines the minimum quotas for the purchase of domestic products under the 44-FZ.

According to the "second extra" rule, the customer must reject applications offering imported radio electronics if there is even one application offering similar Russian or Eurasian products, information about which should be included in the Register of Russian Radio Electronic Products or in the Register of Eurasian Industrial Products.

The Ministry of Industry and Trade believes that the ban on the purchase of foreign ventilators will support Russian manufacturers of medical equipment. In July 2023, after the appeal of a number of Russian charitable foundations, the department expressed its readiness to adjust its proposal, removing from the restrictions high-frequency, manual and pneumatic devices necessary for patients with a number of rare diseases.

Such data are contained in the draft government decree, which was developed by the Ministry of Industry and Trade in an attempt to ban state purchases of foreign ventilators.

The key domestic manufacturers of ventilators are JSC KRET of the state corporation Rostec and LLC Triton-Eletronics, which account for more than 35% of the supply of equipment, according to an explanatory note referred to by Vedomosti. This equipment is also produced by CJSC "Radian," LLC "Hirana +," LLC "Medprom," etc., a representative of the Ministry of Industry and Trade specified to the publication.

State orders of ventilators since the beginning of the year have reached 47.6 billion rubles

From January 1 to the beginning of August 2020, state purchases of artificial lung ventilation devices (IVL) in Russia amounted to about 47.6 billion rubles. Equipment for this amount was delivered to clinics and regional ministries of health under 3.9 thousand contracts.

Such statistics are provided by the Vademec portal with reference to Interfax Marker.ru. It is reported that during the pandemic - from April to July 2020 - state purchases of ventilators reached 29.8 billion rubles. This corresponds to an estimated one third of the supply of all medical equipment, which was measured at 98.8 billion rubles.

Despite tight delivery times and a shortage of medical products on the market, the share of improperly executed contracts amounted to 1%. Thus, out of 1.6 thousand emergency contracts for the purchase of ventilators, 58 contracts were completely terminated by agreement of the parties, 22 were partially terminated by agreement of the parties, and only three by decision of the customer.

State orders of ventilators since the beginning of 2020 exceeded 47 billion rubles

The largest supplier of ventilators was KRET, which in March and April 2020 signed contracts for the supply of Aventa-M ventilators for a total of 14.46 billion rubles. Half of the supply volume - almost 7.5 billion rubles - was provided by a centralized purchase by the Ministry of Industry and Trade of the Russian Federation of about 6.7 thousand. IVL.

In addition to the Ministry of Industry and Trade, the largest buyers of ventilators were the Directorate of the Single Customer of the Moscow Region (780 devices for 1.1 billion rubles), the Ministry of Health of the Stavropol Territory (312 devices for 581 million rubles), as well as the State Institution "Technical Support" of the Ministry of Health of the Republic of Bashkortostan (300 devices for 558 million rubles). The cost of the devices ranged from 1.1 million to 2.4 million rubles.

By the beginning of August 2020, the Rostec group continues to produce devices. By the beginning of June 2020, the state corporation and subsidiaries collected about half of the IVL from 6.7 thousand units ordered by the Ministry of Industry and Trade of the Russian Federation.[3]
