So, under Part 4 of Art. 128.1 of the Criminal Code of the Russian Federation guilty face a fine of up to 3 million rubles or in the amount of income for a period of up to three years. As an alternative, up to 400 hours of compulsory work is provided.
Earlier on Monday, the Ministry of Internal Affairs issued a warning that not only administrative responsibility, but also criminal liability could threaten to post fake information regarding the coronavirus. The ministry urged citizens to be attentive to the information published on the Internet and instant messengers, to focus on official sources.
At the same time, the Ministry of Internal Affairs has repeatedly refuted various information about the coronavirus, which regularly appears on the Internet. So, in the Krasnoyarsk Territory, the Kursk region and some other regions, fake news was spread that during the raid events the police would fine parents whose children would be alone in public places. In the Lipetsk region, through messengers, inaccurate information was sent that the traffic police blocked all entrances to Lipetsk in connection with a two-week quarantine. On March 20, the head of the state center for informing Russians about the situation with the coronavirus, Alexei Goreslavsky, said that the center detects five to six campaigns every day to spread false information about infection on the Internet, and about 50 messages are detected a day, which can be called fakes. According to him, in many cases these are thoughtless reposts in publics, communities and, much more often, in messenger groups.

Art. 237 of the Criminal Code of the Russian Federation (concealment of information about circumstances that create a danger to the life or health of people) does not apply to all citizens, but only to the so-called "special subject," that is, persons clearly named in the rule of law. These are persons obliged to provide the population and bodies authorized to take measures to eliminate such a danger with the information indicated (part 1 of article 237 of the Criminal Code of the Russian Federation) or persons holding a state position of the Russian Federation or a state position of a constituent entity of the Russian Federation, as well as the head of local self-government bodies (part 2 of article 237 of the Criminal Code of the Russian Federation). And the norm itself is not about the dissemination of false information (including the virus), but about the concealment of vital information.
Thus, the norm of Art. 237 of the Criminal Code of the Russian Federation is rather aimed at protecting the population from "hushing up" real numbers, which is what fake news imposes on us. And not at all on the application of punishment for each joke or picture.
As for Part 4 of Art. 128.1. The Criminal Code of the Russian Federation (slander that a person suffers from a disease that poses a danger to others), then for its application it is necessary to spread slander against a particular person. It is not possible to bring to justice for slander a person who will only doubt the official figures, diagnoses and symptoms, albeit publicly.
But no matter how illusory the criminal liability for jokes and works of small prose is, I would ask everyone to be more attentive to what we send to the information environment.
What for one can only be speculation and personal opinion, in the lips of followers, will be overgrown with false testimony and statistical data and will go for a walk in the light absolutely independently of the author.

Electronic sick leave will help in quarantine due to coronavirus
The unfavorable epidemiological situation in Russia, caused by the threat of the spread of coronavirus infection, pushes workers and their employers to switch to a new procedure for issuing and filling out sick leave, namely, in electronic form. An electronic certificate of incapacity for work has the same legal significance as a paper one.
Registration of an electronic hospital greatly simplifies the process of stabilizing the spread of infection, because everything happens remotely: citizens who arrived from abroad, sick or in contact with sick people do not need to visit a medical organization.
What is quarantine, and how is it different from the usual sick leave?
The registration of a certificate of incapacity for work under quarantine is somewhat different from the algorithm for issuing ordinary sick leave (with a cold or flu, for example). A potential carrier of the virus and people in contact with it are sent to the so-called self-isolation, which lasts two weeks (14 calendar days).
Mandatory quarantine is announced for Russian citizens who have returned from certain countries where the epidemiological situation is out of control, and those who have come into contact with them, including those living together with potential carriers of the virus.
However, the issuance of such sick leave is provided only for officially employed people, that is, registered in the state under an employment contract. Individual entrepreneurs, self-employed, employees under civil law contracts and freelancers will not be paid for quarantine.
Mechanism for registration of electronic quarantine sick leave
An electronic certificate of incapacity for work is issued in the personal account of the Social Insurance Fund (hereinafter referred to as the FSS). Relatives can also request the document if the applicant himself is not registered in the LoC. The Government of the Russian Federation approved the rules for registration in the resolution of March 18, 2020 No. 294. The rules are valid from March 20 to July 1, 2020.
To obtain an electronic sick leave under quarantine, the employee needs:

- the next stage - within one day, the FSS will process the application and transfer the information to one of the medical organizations;
- the next working day after receiving information from the FSS, the medical organization draws up an electronic certificate of incapacity for work - immediately for 14 calendar days. In case of full-time registration by a doctor of a sick leave (when calling him to his house), the information on the issuance (formation) of an electronic sick leave must be submitted by the medical organization to the FSS no later than the next working day;
- The FSS requests information about the employee from the employer within one working day. The employee can independently inform the employer of the identifier of the electronic hospital;
- within two days, the employer provides documents to the FSS;
- The FSS pays temporary disability benefits to the employee.
Benefits are paid first in the first 7 calendar days, then a second time - after 14 calendar days.
What is required of the employer?
There are general requirements for working with electronic sick leave, regardless of why this document is drawn up: for ARVI or due to quarantine. Both the medical institution and the employer must be connected to the electronic document flow with the FSS.
The employer must have technical means for working with electronic sick leave. To do this, it is easiest to use special services for submitting reports, the functionality of which includes working with electronic certificates of incapacity for work.
Mishustin instructed to involve prisoners in the production of medical masks

Is the coronavirus force majeure?

Due to the spread of the coronavirus and the adoption of preventive measures by states, many market participants are powerless in fulfilling a number of obligations under contracts and incur not only losses associated with partial suspension of activities, but also fines for default [21]
In the field of procurement, according to Article 111 of the Federal Law of April 5, 2013 No. 44-FZ "On the contract system in the field of procurement of goods, works, services to meet state and municipal needs," the Government of the Russian Federation has the right to determine the specifics of a specific purchase, and also has the right to determine additional conditions for the execution of the contract that are not related to its subject matter. The Russian government plans to recognize the virus as a COVID-2019 force majeure circumstance in the execution of state contracts.
In our opinion, the spread of coronavirus can be recognized as a force majeure circumstance, since this phenomenon is extraordinary (does not relate to life risk and cannot be taken into account under any circumstances) and inadvertent (does not depend on the will of business participants, does not relate to business risks). However, it should be borne in mind that the burden of proving the circumstances that are the basis for exemption from liability (including force majeure circumstances) lies with the debtor (paragraph 5 of the Resolution of the Plenum of the Supreme Court of the Russian Federation of March 24, 2016 No. 7).

Their goal: to ensure timely closure of offices in different countries, monitor the fulfillment of their contractual obligations and try to prevent significant damage.

One cannot but admit that in Russia the resolution of such disputes in court will depend entirely on many political aspects.
Foreign trade contracts
The Chamber of Commerce and Industry of the Russian Federation, which is actually engaged in issuing certificates of force majeure for foreign trade contracts, recognizes epidemics as such.
At the same time, as the head of the Chamber of Commerce and Industry Sergei Katyrin noted, the chamber testifies as force majeure not to the coronavirus epidemic itself COVID-2019 in China, but to those restrictive or other special measures that the government takes on the territory of Russia to prevent the spread of the epidemic, if because of them the Russian company cannot fulfill its contractual obligations to a foreign partner[22]
As many large manufacturers note, often foreign suppliers themselves recognize the current situation as force majeure and send appropriate notifications.
Government contracts
According to the Kommersant newspaper, in terms of the execution of state contracts, the problems caused by the coronavirus can also be recognized as force majeure.
For the most part, these are precisely delays in execution caused by a breakdown in the timing of foreign trade transactions.
Unfortunately, the executors of state contracts are the weak side on which almost all responsibility for any violations falls.
Whatever possibilities for extending and/or changing the deadlines for the execution of state contracts are now declared in the press, the only thing that can really protect the contractor from penalties is a notification from the customer about the recognition of the situation as a force majeure circumstance or an additional agreement on changing the deadlines for the fulfillment of obligations.
Contractual relationship
As for the bulk of contracts - classical internal contracts concluded on the basis of the principles of freedom of the contract and equality of the parties, the conditions for force majeure in nikh¸ are perhaps one of the most standard.
And a rare lawyer can boast of the practice of real application of such terms of the contract. Moreover, let's be honest: not every force majeure prescribed by the parties will be recognized as such by the court.
The presence or absence of force majeure circumstances in each case is established by the court based on a comprehensive assessment of the situation.
According to established practice, in order to recognize a circumstance as insurmountable force, it is necessary that it be of an extraordinary and unavoidable nature under these conditions.
At the time of the introduction of an emergency (if any), it will not be difficult to prove this. Unfortunately, it is obvious that the time of emergency will not cover all the downtime of production facilities, organizations providing services, carriers, hotels.
In this case, the issue of successful resolution of the case will depend entirely on the evidence base that the lawyer will collect.
Other ways
In addition to the classic condition of force majeure, civil law offers us the opportunity to refuse to fulfill the contract due to a significant change in circumstances (Article 451 of the Civil Code of the Russian Federation) and due to the impossibility of its execution (Article 416, 417 OF THE CIVIL CODE OF THE RUSSIAN FEDERATION). And each norm assumes its own amount of proof.
Regarding a significant change in circumstances, it should be canceled that in 2014 the positions of theorists and practitioners (read - courts) significantly diverged in terms of the interpretation of this norm. Thus, Russian courts everywhere refused to terminate the contract with reference to this norm due to a significant change in the exchange rate dollar and the euro.
In fact, each of the described norms can be applied both for disputes from state contracts and for resolving conflicts from ordinary contractual relations.
How to form a line of judicial defense will be determined by the lawyer after studying all the documents in the case. At the same time, it is better to start pre-trial and claim work now, when it is obvious that the timely fulfillment of obligations is in jeopardy.
The successful use of one of these tools will allow the customer or buyer to demand a refund of the advance payment, minus the actual costs incurred by the contractor.
The contractor (seller), in turn, will be able to prove that the delay in execution is allowed without guilt on his part, which will exclude the application of contractual sanctions against him.
Consumer contracts
Among the entire volume of contractual relations, I would like to single out a separate pool of obligations: consumer contracts. Unfortunately, due to the relatively low cost of services and work under such contracts, consumers rarely seek the protection of violated rights from lawyers.
Unscrupulous entrepreneurs, in turn, calmly use this, refusing to return the advance paid. Moreover, even the initiated litigation may not provide the consumer with legal payments: it is not uncommon for the debtor to have neither property nor money at the time of collection.
However, even in the case of a small amount of the disputed amount, it would be reasonable to seek professional advice. During the consultation, the lawyer will help the consumer form his position to communicate with the counterparty and prepare a written claim.
