Dmitry Kichko, vice president of Borlas for consulting, believes that such a price list should be valid for a certain period, taking into account the cycles of software purchases. In turn, the executive director of the Association of Software Product Developers (ARPP) "Domestic Software" Renat Lashin says that the new initiative "definitely requires further study, taking into account the many models and features of the distribution of domestic solutions." Market participants do not exclude that after the introduction of a single price list, software prices will increase, becoming closer to the maximum.[1]

2022

Approved rules for the use of software on significant objects of critical information infrastructure

Putin forbade state-owned companies to use information security systems of unfriendly countries

2021: Ministry of Digital Development wants to check all applications for public procurement of foreign software

2020

2019: Bill on the independence of Russian developments based on third-party software

In such an agreement, the parties are obliged to provide for the procedure for exercising the exclusive right to the created independent copyright object after the termination of the agreement.

At the request of the copyright holder, audiovisual displays of such a program and a description of the program containing features of its operation may be included in the materials of the application for state registration of a computer program.

2018

State corporations obliged to switch to Russian software by 2022

On December 17, 2018, it became known about the requirements of the Russian authorities regarding the transition of the largest state-owned companies to domestic software. By 2022, Russian they should have more than half of the software.

According to him, in the segments of antivirus and accounting solutions, more than half of the market is occupied by Russian products. At the same time, their presence in the segments of office software, database management and ERP systems is measured at less than 20%.

A source at Aeroflot told Vedomosti that not all organizations are ready for such changes. According to him, urgent import substitution can negatively affect the company's income and reduce its competitiveness.

The government approved the centralization of procurement of office software and information security solutions for federal authorities

According to the document, federal executive bodies must ensure the transition by January 1, 2020 to maintaining budget accounting using software provided to them based on the results of purchases provided for by this resolution.

By 2020, work should be carried out to ensure the compatibility of the software of information systems of federal executive bodies with office software and software in the field of information security of at least 2 different copyright holders.

Also, until 2020, the deadlines for the implementation of measures to transfer federal executive bodies to the use of domestic office software have been extended.

Procurement of domestic office software for government agencies decided to centralize

Centralization of office software purchases has already been discussed earlier. So, in October 2017, at a meeting with the Deputy Prime Minister, the Ministry of Finance and the Ministry of Communications was instructed to work out and submit proposals for organizing centralized procurement of office software for the needs of federal executive bodies and state extra-budgetary funds.

At a meeting of the commission, Medvedev also proposed improving the rules for maintaining the register of domestic software.

Government purchases of software from the EAEU countries are allowed

Discussions on the prohibition of purchases of foreign antiviruses for government agencies

2015

How to justify the impossibility of abandoning foreign software

The Government Decree defines the rules for preparing a justification for the impossibility of complying with the ban on the admission of foreign software for public procurement, as well as requirements for the content of such a justification.

The justification is prepared by the customer in the implementation of procurement software in the following cases:

  • in the register of Russian programs there is no information on software corresponding to the same software class as the software planned for purchase;

  • software, information about which is included in the register and which corresponds to the same class of software as the software planned for purchase, according to its functional, technical and (or) operational characteristics does not meet the requirements established by the customer for the software planned for purchase.

The justification should contain requirements for the necessary characteristics of the software, and an indication of the characteristics for which the analogue contained in the register does not correspond to them.

Justification shall be prepared and approved by the Customer as per as of the date of placement of the procurement notice in unified information system in the field of procurement. Then it should be posted on the public procurement website (simultaneously with the placement of a notice of procurement).

It is probably up to the expert council to check the adequacy of the selected justifications (this issue is under discussion as of November 2015).

Government Decree on Restrictions on Public Procurement of Foreign Software (published November 20, 2015)

According to the decree, from January 1, 2016, customers are required to limit software purchases for state and municipal needs with software included in the register of Russian software.

An expert council will form and update the register. Its composition was approved on December 31, 2015.

The number of representatives of federal executive bodies cannot exceed 40 percent of the total number of members of the expert council. At least 50 percent of the total number of members of the expert council is formed on the proposals of associations of Russian software developers, the resolution says.

You can buy foreign software if there is no domestic software in the register with the necessary functional, technical and operational characteristics.

The customer will have to justify the need for compliance of the software product with certain characteristics.

The rules for determining the requirements for the purchased software (as well as for development, support, technical support services, etc.) in the Ministry of Telecom and Mass Communications should be developed together with the interested federal authorities. A document containing proposals on this topic should be submitted in February 2016 to the Ministry of Finance, and then to the Government.

In January 2016, the Ministry of Telecom and Mass Communications approved a program classifier containing an indication of the characteristics by which the compliance of the software with a certain class is determined, as well as the rules for applying the classifier.

The register operator under the contract with the Ministry of Telecom and Mass Communications will be an organization endowed with the right to receive a mandatory copy of software in accordance with the Federal Law "On a mandatory copy of documents." In the current version of the law, the Integrated Research Institute is responsible for the software.

In an explanatory note to the draft resolution (which was developed by the Ministry of Communications in February and throughout 2015 was discussed in federal departments) it was indicated that the document was prepared in order to protect the domestic market of the Russian Federation, the development of the national economy, support Russian organizations operating in the field of IT, taking into account, among other things, restrictions on the use of foreign software by certain Russian organizations established by a number of foreign copyright holders in connection with the sanctions imposed by the United States and some other countries.

Recommendations of the Security Council to use Russian software in the fuel and energy complex

In the fall of 2015, documents were sent to all large oil and gas companies from the Security Council of the Russian Federation, according to which they must report on how they carry out import substitution work . Import substitution plan approved geoinformation systems

On September 1, 2015, Prime Minister Dmitry Medvedev approved an action plan for 2015-2020 to implement the "Fundamentals of State Policy in the Field of Using the Results of Space Activities in the Interests of Modernizing the Economy of the Russian Federation and Developing Its Regions for the Period until 2030." Ministry of Finance and FAS against restriction of public procurement of foreign software

In June 2015 , the Ministry of Finance and the Federal Antimonopoly Service spoke out[12] the proposed restrictions on public procurement of foreign software . The Ministry of Finance believed that it was necessary to leave government agencies the opportunity to purchase foreign software products in order to "finalize, expand or renew licenses for the software they already use." Otherwise, the ministry believed, the implementation of the resolution will require additional funds from the federal budget.

In turn, the FAS believed that the measures taken could lead to abuse: in order to bypass restrictions and purchase foreign software, government agencies in tenders will specifically indicate such functions that the Russian one does not have. The FAS also proposed to consolidate in the decree that products from the register of domestic software should be distributed in Russia at uniform prices in order to prevent their growth.
