The decision to create a unified information system in the field of public procurement (EIS) was made within the framework of the implementation of 44 FZ "On the contract system in the field of procurement of goods, works, services to meet state and municipal needs," which entered into force on January 1, 2014. One of the goals of the creation of the UIS is to increase the transparency of procurement.

The EIS replaced the official portal of public procurement of zakupki.gov.ru, on the basis of which it was created. 2022: Treasury strengthens protection of public procurement portal against DDoS attacks for 875 million rubles

In April 2022, the Federal Treasury announced a tender worth about 875 million rubles to strengthen the protection of the public procurement portal from DDoS attacks. The result of this project, as stated in its documentation, should be "ensuring uninterrupted placement of information, interaction with regional InformSystems and minimizing the cost of restoring the performance of the Unified Information System in the event of failures."

Kommersant drew attention to this public procurement. Anna Katamadze, Deputy Head of the Federal Treasury, admits that as a result, the public procurement portal will be available only to suppliers and customers.

In April 2022, the Federal Treasury announced a tender worth about 875 million rubles to strengthen the protection of the public procurement portal from DDoS attacks.

Experts interviewed by the newspaper believe that such a measure will not help from external threats and contradicts the legislation under which public procurement should be published openly. However, due to the sharp increase in the number and intensity of hacker attacks, government agencies will soon increase investments in cybersecurity. This is also necessary to ensure uninterrupted placement of information, interaction with regional InformSystems and minimizing the cost of restoring the EIS operability in the event of failures.

The growth of public sector investments in security will be associated not only with the fact that the number of attacks has increased significantly, but also with the fact that foreign protective equipment, if not turned into "bricks," then lost a significant share of efficiency, said Pavel Korostelev, head of the Security Code product promotion department. There were "a sufficient number" of foreign products in defense against DDoS attacks, so in relation to new contracts it is more correct to talk not only about growth, but also about import substitution, the Informzaschitas agree.

According to Ivan Begtin, director of the Information Culture NGO, to protect DDoS attacks, you can not spend 875 million rubles, but simply close the resource for foreign IP addresses.^[2]

Previously, the Federal Treasury used the leased capacities of Goznak for its work, which, according to Kommersant, cost the budget about 1 billion rubles a year.

According to the publication, the change of the data center made it possible to transfer server applications to open source, expanded the capabilities of Treasury programmers to develop their own applications and saved them from binding to the brand, ensuring savings in the procurement of the servers themselves due to a wider offer.

All this has formed new requirements for productivity, security and scaling of the EIS and data center, for which we have been preparing for almost one year, "Anna Katamadze, deputy head of the Treasury, who oversees the management of the EIS and public procurement, told the newspaper.

The new system is said to have increased the Federal Treasury's current productivity by more than 25%. According to Kommersant, the volume of migration amounted to about 1.4 petabytes of data - de facto this is the entire volume of EIS archives for all years. At the same time, the move was completed in almost one week, mainly on weekends: the service had to "turn off" individual EIS units when changing the virtual machines supporting them (there are more than 700 of them) only for two working days.^[3]

Plan for modernization of the EIS, including in terms of integration with the Independent Registrar GIS

It is planned to modernize such functions as maintaining schedules, a register of contracts, a single register of procurement participants, as well as updating a mobile application - the changes will affect almost all EIS subsystems.

At the same time, the indication in the procurement plan and the placement on the Internet of information on procurement within the framework of the state defense order is unacceptable due to the fact that, according to the directives of the government of the Russian Federation and the board of the military-industrial complex of the Russian Federation, the information provided for by the law on state defense orders is not subject to placement in open sources on the Internet, the authors of the initiative remind.

Launch of pilot and call center EAT

On July 1, 2018, the specialized organization RT-Design Technologies of the Rostec state corporation launched a pilot project of the Birch Unified Trade Aggregator (EAT). At the same time, the EAT call center began to work.

The launch of the project will allow public procurement of a small volume (100-400 thousand rubles) for state and municipal needs in a simplified form online. As expected, its use will save state funds and time for registration according to standard procurement procedures for serial goods, for example, paper and office equipment.

The implementation of the pilot project in accordance with the order of the Government of the Russian Federation involves the use of EAT on a voluntary basis from July 1, 2018. The system will become mandatory from November 1, 2018 when providing public procurement for federal executive bodies. On October 20, 2017, Rostec State Corporation announced that its subsidiary, RT-Design Technologies, had signed another contract for the development of a unified information system (EIS) in the field of procurement for 2017-2018, which will be carried out in 3 stages. The value of the contract concluded with the Center for Ensuring the Activities of the Treasury of Russia is 511.5 million rubles.^[6]

Rostec notes that the team of specialists of the state corporation, who has accumulated significant experience in creating an information and analytical system for monitoring and controlling the procurement of drugs (IAS), will focus on the key work inherent in the general contractor and necessary to continue the reform, increase transparency and efficiency of the state order. In particular, this is the development of the catalog of goods and services as the main tool for structuring procurement information in order to analyze actual purchase prices and characteristics of purchased products, rationing, forecasting demand, determining initial maximum prices, monitoring purchases at inflated prices.

In addition, the RT-Design Technologies team will perform work in coordination with the customer of individual technical assignments for the system, including detailed requirements for all its future functionality, descriptions of automated business processes, applied technologies, work on the development of working documentation for the system, control over the implementation of work on software development, commissioning and trial operation of the system. In terms of software development, on the basis of the private technical assignment prepared by RT-Design Technologies and working documentation, external executors will be involved.

In general, the contract for the development of the EIS is divided into three logical stages.

First stage

The first stage is devoted to the most important improvements related to the coming into force regulatory acts, technological work to ensure system redundancy, technological modernization and documentation of the system in terms of ensuring compliance with the requirements of the regulator in the field of information security.

The functional development of the system is also envisaged, in particular, work on the formation of a structured universal transfer document confirming the execution of the contract, the implementation of the provisions of Government Decree No. 615 (procurement procedures for capital repairs in apartment buildings) in terms of maintaining a register of contracts for capital repairs, the formation and placement of information in the register of unscrupulous contractors.

The implementation of the first stage (until the end of 2017) is entrusted to the company "LANIT technology," which has many years of competence in this type of work. The amount of the contract with her is about 115 million rubles. At subsequent stages, the developers of the EIS software will be determined at competitions.

Second stage

The tasks of the second stage include work on:

• the development of the functionality of the catalog of goods, works and services and its use in procurement, * the implementation in test mode of the procedure for signing and including in the register of contracts an electronic certificate of work performed,
• the development of the analytical system taking into account the expansion of the composition of information generated in the UIS in a structured form,
• creating a mobile application for searching for purchases placed in the UIS,
• ensuring the possibility of electronic exchange with the Federal Tax Service to obtain information from the Unified Register of Small and Medium-Sized Businesses.

Third stage

The third stage is scheduled for the largest amount of work requiring the design of business processes. In particular, it is planned to translate all procedures into electronic form: if as of October 2017 only an electronic auction was implemented, then in 2018 the bill provides for the transfer of all (more than 14 types) purchases into electronic form and ensuring integration with electronic platforms.

The list of works of the third stage also includes:

• development of electronic contract designer,
• generation of customer reports on the volume of purchases from small businesses and socially oriented non-profit organizations,
• creation of a single register of subcontracts.

As part of the contract, a reserve will be made for a full-scale transfer of the EIS to free software (SPO). Since the UIS is a highly loaded system, processes large amounts of data and contains a large number of automated business processes, replacement will take place carefully, with mandatory testing of technologies on less critical UIS components and subsequent replication to the entire system. Therefore, the complete transfer of the EIS to the SPO is considered as a task that extends beyond the framework of 2018, Rostec reported.

The public procurement system turned out to be "Rostec" out of touch. "Lanit" was called to help again

Rostec, in February 2017, appointed by the government as the sole executor of state contracts with the Federal Treasury for the development and operation of a unified information system in the field of procurement (EIS), decided to share its functions with the structures of Lanita, which is well acquainted with this system.

In the Rostec circuit, as the state corporation reported earlier, its subsidiary, RT-design technologies, should be engaged in integrated maintenance of the EIS. At the end of June 2017, the Treasury concluded two state contracts with her for services for the operation of the EIS and work on the development of the system.

The state contract for services for the operation of the UIS is designed for execution in two stages - from July 1 to September 30, 2017 and from October 1 to December 31, 2017^[7]. Its amount is 175 million rubles.

In turn, the contract for the development of the EIS with RT-Design Technologies is designed for a period until the end of 2017^[8]. Its volume is 200.2 million rubles. The main part of the work includes the refinement of various functions of the system. It is also necessary to develop software for new functions: for example, to be able to purchase services for the overhaul of apartment buildings, maintaining catalogs of goods and services to meet state and municipal needs.

Rostec attracted Lanita companies as subcontractors for the operation and development of EIS in the field of procurement

In parallel with the conclusion of contracts with the Treasury, RT-Design Technologies also placed purchases of services and work on the operation and development of the EIS, defining them as the only executors of the Lanita structure - Onlanta and LANIT technology.

The contract for operation with Onlanta in the amount of 58.3 million rubles should be concluded for a period from July 1 to August 31, 2017, follows from the procurement documentation^[9]. The contract for the development of the RT-design technologies system is planned to be concluded with LANITS Technology with a period until the end of 2017 and a price of 199.7 million rubles^[10].

Lanit carried out the development and launch of the system. At the beginning of 2015, the Federal Treasury concluded a state contract with the company^[11] in the amount of 525 million rubles. for the implementation of work on the creation, development and maintenance of application software system. Later, in September, another contract was signed with the company^[12] for the implementation of work on the development of the system in the amount of 143 million rubles.

In 2016, Onlanta was engaged in technical support of the EIS. She also won the competition for the operation of the system in the first half of 2017.

Earlier, serious complaints arose about the functioning of the EIS regarding failures and incorrect operation of the system. At the beginning of 2017, the situation turned out to be especially critical: due to failures in the system, trading for billions of rubles hung (more about this in the blocks below). Against this background, Moscow Mayor Sergei Sobyanin proposed allowing cities of federal significance - Moscow, St. Petersburg and Sevastopol - as well as the constituent entities of the Russian Federation with a public procurement volume of more than 100 billion rubles a year to use their own Internet portals in this area.

Earlier, when First Deputy Prime Minister Igor Shuvalov convinced President Vladimir Putin of the advisability of transferring the procurement system to Rostec, he noted that in order to transfer all purchases to electronic form, a "significant revision of the functionality" of the EIS is needed, and RT-design technologies have technical resources and highly qualified specialists^[13].

Rostec told TAdviser that the subcontractors Onlanta and LANIT Technology have been working with the system since 2009 in terms of design and creation, and since 2011 they have also been responsible for its operation and development. Thanks to long-term work on the project, Onlanta and LANIT Technology have professional expertise in terms of, for example, regulatory and legal support, many years of experience in automating procurement activities, creating and operating highly loaded state information systems.

The involvement of the Lanita structure in the implementation of tasks to develop the current functionality of the EIS and ensure its stable operation at this stage is an understandable and transparent step. In addition, the involvement of contractors familiar with the operation of the system will eliminate the risks of EIS failure during its large-scale modernization, Rostec believes.

The task of "RT-design technologies" is slightly wider: in addition to maintenance, this is also the modernization of the existing system, the state corporation added. The company explained to TAdviser that for this, RT-design technologies specialists will undertake the creation and development of a single catalog of works and services as the main tool for structuring procurement information. Users of the new system will be able to compare prices, perform this procedure promptly without entering and analyzing a huge amount of data, and automatically receive a warning at all stages about possible deviations in price or quality.

This is important for analyzing actual purchase prices and procurement characteristics, rationing, forecasting demand, determining initial maximum prices, monitoring purchases at inflated prices. All procurement participants, including regulatory authorities, will be able to automatically analyze arrays of information in real time and receive recommendations on prices. The regulatory authorities will have an additional preventive control tool in the field of public procurement, explained in Rostec.

Combining the efforts of RT-design technologies and Lanit will help to fulfill the task as efficiently as possible, the state corporation is confident.

Rostec notes that the state corporation represented by RT-design technologies does not set itself the goal of making a profit from the development of EIS. At the moment, only 6% of the total contract will go to pay off the operating costs of the company. This is a long-term project and the key profit from it is planned to be obtained in the long term following the sale of additional services (for example, obtaining certificates) as part of the catalog after its launch.

The government appointed Rostec the only contractor for the development and operation of the public procurement system

On February 20, 2017, Rostec announced that the Russian government had decided to choose the state corporation as the sole executor of state contracts with the Federal Treasury for the development and operation of EIS in the field of procurement in 2017-2018. In the Rostec circuit, RT-design technologies will be engaged in integrated maintenance of the system.

The government's decision was made in accordance with the instructions of President Vladimir Putin and is aimed at improving the EIS in order to actually reduce prices and ensure fair competition in the field of procurement, Rostec said in a statement.

The EIS development project is based on a number of key elements: the creation of reference books (classifiers), product catalogs, databases of weighted average prices, and an analytical system. The implementation of the project should provide an end-to-end process from system procurement planning to the conclusion of contracts, noted in Rostec.

At the stage of procurement planning, the automatic formation of directories of classifiers and catalogs for all commodity groups, the formation of transparent competitive pricing and assessment of the results of work and services will be carried out. At all stages of the EIS, an automatic warning function will be provided about possible deviations in price and quality indicators.

The advantage of this approach in relation to the existing one in Rostec is the ability to automatically analyze large amounts of information in real time with the formation of preliminary recommendations on prices for all procurement participants, including control and supervisory authorities.

This will allow state customers to ensure not only a comparison of starting prices, a reduction in the number of routine operations for manual input and analysis of large amounts of data, the adoption of timely and balanced decisions, but also to ensure a reduction in the corruption component and a real reduction in prices. The regulatory authorities, in turn, will receive an additional preventive tool to prevent violations in the field of procurement, - noted in Rostec.

At the time of the government decision, Rostec, within the framework of working groups with the Treasury, began to develop a system project for the development of EIS functionality. Work with the EIS will be carried out by domestic developers based on Russian open source software, Rostec said.

Due to failures in the public procurement system, trading for billions of rubles hovered

In January 2017, with the entry into force of amendments to the 44-FZ on the contract system, customers throughout Russia who fall under this law faced problems with posting procurement information in the federal procurement EIS. Due to failures in the system, for example, problems arose with the placement of procurement schedules in the EIS, and tenders cannot be held without their publication. For violation of the rules for posting data in the EIS, customers face fines.

The Federal Treasury, which is responsible for the operation of the EIS, in January recognized the presence of technical problems and publicly apologized to customers for mass cases of inability to post procurement data. However, it was not possible to quickly eliminate the problems at the beginning of February.

On February 2, 2017, the head of the Moscow Department for Competitive Policy, Gennady Degtev, during an open discussion about the EIS of procurement, said that more than 1.5 thousand contracts were sent by Moscow customers for registration with the EIS, but they "hung" in the system due to technical problems. He noted that technical failures in the federal system do not allow city customers to timely purchase the necessary goods, works and services to fulfill social obligations. The annual total volume of Moscow purchases is about 500 billion rubles - 10% of all purchases of the Russian Federation, Degtev noted.

Sergei Gabestro, general director of the National Association of Procurement Institutes (NAIZ), believes that legally significant procurement actions can be carried out at disparate regional sites. He proposes to assign the EIS of procurement to the role of a center where downloaded data will be available to everyone, instead of a center for collecting files, as it is now.

Changes to the law on the contract system have increased the number of organizations that are required to "contract" in the EIS, which makes the system and the load on it huge. The current model is unrealizable in the near future, Gabestro believes.

Over the past few years, systems have not just slowed down, it is not developing anywhere, says Ilya Dimitrov, executive director of the non-profit organization Association of Electronic Trading Platforms. This carries risks for customers, social, and business. Ivan Yastreb, deputy head of the ONF project "For Fair Purchases," noted that activists of his organization said back in 2015 that a single system was not ready for launch in 2016. Earlier, at the end of January, a positive resolution of President Vladimir Putin received the initiative of Igor Shuvalov to appoint "RT-design technologies" ("daughter" of "Rostec") the only contractor for servicing the EIS of public procurement. Experts interviewed by TAdviser support this idea. Sergey Gabestro from NAIZ noted that there is a similar international practice, for example, in Korea, Germany, France and others, when the government has a large corporation partner. This will not immediately solve the problem with the EIS, which is, but should be in the future, he believes. It is necessary to transfer the system to the corporation and "raise a partner," Gabestro told TAdviser.

Alexander Gorbatko from DIT Moscow agrees with Gabestro's opinion. In his opinion, it will take some time before the team starts working, which will understand how the system works now and why it does not work as it should. Perhaps a lot of time will pass, he said. The state needs a partner that is financially stable and developing for 3-5 years in advance. Such a partner as Rostec - why not, Gorbatko noted in a TAdviser conversation.

Gennady Degtev told TAdviser that his department will support any contractor who creates a system that works smoothly. What a solution is needed for this is within the competence of the government, he added.

Sobyanin proposed to use regional public procurement systems instead of EIS

Unified procurement system launched with multiple flaws

In January 2016, the organization of the All-Russian Popular Front (ONF) monitored the work of the EIS in the field of procurement, which, at the direction of Dmitry Medvedev, was supposed to work in full force since the beginning of the year, and reported on the detected multiple flaws in the system.

Among the problems that users face when working with the system is that the search and filtering system does not work, the contract register on the updated site does not contain a search by performer (contractor), which makes it difficult to monitor contracts concluded with a specific supplier. Many partitions do not function, some contain only test records, do not display data, in some partitions the server issues an error.

Considering that even when testing basic external functions, we are faced with so many shortcomings, it can be assumed that the internal mechanisms of the EIS are in an even more deplorable state, they say in the ONF.

The development and launch of the system was carried out by Lanit. At the beginning of 2015, the Federal Treasury concluded a state contract with the company^[20] 525 million rubles. for the implementation of work on the creation, development and maintenance of application software system. Later, in September, another contract was signed with the company^[21] implementation of work on the development of the system in the amount of 143 million rubles.

The Federal Treasury and Lanit did not comment on the problems in the work of the EIS at the time of publication of the material. The Ministry of Economic Development told TAdviser that all the comments presented are being worked out with technical specialists, and the necessary measures will be taken as soon as possible.

On January 19, 2016, the Ministry of Economic Development of Russia held the first meeting with representatives of interested authorities, organizations, electronic platforms, experts operating the EIS on the functioning and improvement of the quality of the EIS. Acceptance of the work was carried out by an interdepartmental commission with the participation of the Ministry of Economic Development, the Federal Antimonopoly Service, the Ministry of Communications, the Ministry of Finance and the Federal Treasury. 2015

Medvedev approved the launch date for a unified procurement system

In January 2015 , Prime Minister Dmitry Medvedev signed a decree on the procedure and timing for the commissioning of a unified information system in the field of procurement. In accordance with the document, the Federal Treasury must ensure the commissioning of the system no later than January 1, 2016, and by May 1, 2015 - approve the composition of the interdepartmental commission on the creation of a system in the field of procurement and the provision on this commission.

The document also defines that the list of subsystems (components, modules) of the UIS in the field of procurement is determined in the technical documentation on the basis of functional requirements for this system, which are established by the Ministry of Economic Development.

Earlier, the Ministry of Economic Development and Trade told TAdviser that, according to the department "from a systematic understanding of the law," the system should have been put into operation with such an expectation that purchases for 2016 could be planned with its use. That is, the final commissioning of the system was expected for the 4th quarter of 2015.

The TA for the creation of the EIS under the state contract, which the Ministry of Economic Development concluded with the HSE research center, was developed in 2013, and during 2014 it passed an additional 2 stages of revision, the department told TAdviser.

The improvements were related to the amendments to the law of 44FZ, which were adopted in December 2013 and June 2014, as well as to the adopted by-laws that specify the issues of planning, rationing, justification of procurement. In July 2014, the final edition of the SOW appeared. In parallel with the revision of the SOW, the financial and economic justification of the cost of this project was being worked out, and as of November 2014, the Treasury was working on the preparation of documentation for the conclusion of a contract for the creation of an EIS.

Unified information system will eliminate "abnormally" stable connections in the procurement process

The ability to track "abnormally" stable connections between the supplier and the customer, as well as price deviations, will allow the Unified Procurement Information System, which will replace the official website www.zakupki.gov.ru. This was announced by the head of the department for the development of the contract system of the Ministry of Economic Development of the Russian Federation Maxim Chemerisov in December 2015.

The agency proposes to translate all competitive procedures into electronic form. "This will be a breakthrough step," M. Chemerisov is sure, noting that in this case all bidding processes will become as public as possible.

2014

According to Sergei Guralnikov, the use of the software and hardware complex of the official website of the Russian Federation when creating the UIS will reduce the time and reduce the cost of implementing the project.

"This approach, as I see it, will ensure the implementation of the main priority of creating and the phased launch of the functionality of the new system without unnecessary shocks for both customers and suppliers," Guralnikov said.

In his opinion, this will also ensure the maximum continuity of the functionality that was already created earlier, and the possibility of using new technological tools to improve it.

Guralnikov also explained that at present the budget procurement process at the technological level is scattered. Customers are forced to work in multiple information systems, transferring data from one to another, as well as duplicating it. The absence of uniform directories, classifiers in budget and procurement systems, according to the official, requires additional labor costs to ensure the consistency of this data in various systems.

Speaking about the scale of the system, Guralnikov said that the EIS will be an information platform for the work of about 1.5 million participants - customer organizations and suppliers.

"We plan that about 5 million notifications will be published in the EIS during the year," the official said. "In this regard, additional work is to be done together with the Ministry of Telecom and Mass Communications on the backup of UIS data when using the e-government infrastructure."

The Treasury is confident that the innovations implemented in the EIS will make it possible to obtain a single cycle of electronic procurement, reducing the time and financial costs of all participants in electronic interaction: "This will undoubtedly increase the transparency and availability of information on public procurement, expand opportunities for analytics and search, lead to a decrease in the cost of government contracts, will expand the contingent of participants."

Work on the creation of the system began back in 2013. In the fall of 2013, the Ministry of Economic Development announced that the EIS would be created by 2015, and later, in December, they said that the phased introduction of the system would begin only in 2016. At the same time, officials reported that in March-April 2014, the Ministry of Economic Development will announce a tender and conclude a contract for the creation of an EIS.
