Availability in the Onlanta cloud

Companies from the SMB segment have access to corporate email based on the Russian Communigate Pro platform, deployed in the Onlanta public cloud (part of the LANIT group). Anna Butenko and StalkerSoft JSC have begun active negotiations on a comprehensive settlement of relations and establishing constructive interaction in the interests of clients and partners using the CommuniGate Pro communication platform, the TAdviser said in a statement.

In the near future, the basic principles and parameters of further interaction will be determined, for which it is planned to conclude relevant settlement agreements.

Since with the recognition of Anna Butenko as the sole legal owner of CommuniGate Pro, StalkerSoft lost the right to sell this product, its sales were suspended after July 10. Sublicensee partners were notified of this, through which licenses for the right to use the CommuniGate Pro product are directly provided to end customers, Vladimir Bugrov told TAdviser.

The development and refinement of the product in the interests of Russian customers has also been suspended. According to Vladimir Bugrov, by a court decision, a number of persons, some of whom are developers of CommuniGate Pro, currently do not have the legal basis for work on changing and distributing the specified product.

While the issue of the rights to the product was decided by the Moscow City Court, in parallel, as of August 2023, a criminal case on copyright infringement was being considered in the Khoroshevsky Court of Moscow. The defendants in this case in the database are Alexander Malyshev and Maria Trishina, who worked at different times as general directors of StalkerSoft, as well as its technical director Dmitry Akindinov. According to the Kommersant newspaper, a criminal case on copyright infringement of CommuniGate Pro owners was initiated in February 2021 at the request of Anna Butenko, who is the victim in the case^[2] the^[3].

Staltersoft has lost the right to release the CommuniGate Pro server. It passed to the daughter of the late product creator

According to CNews, in the proceedings in question, the plaintiffs were Dmitry Akindinov and Roman Prokhorov, high-ranking technical specialists of Stalkersoft, who worked together with the author of the first version of CommuniGate Pro Vladimir Butenko. The defendants are Staltersoft JSC itself, Anna Butenko (daughter of Vladimir Butenko, who died in 2018 at the age of 57) and the Federal Intellectual Property Service (Rospatent).

The essence of the claim is "recognition by co-authors of computer programs, recognition by co-owners of a computer program, an obligation to amend the register of computer programs and information about the program, recovery of unjust enrichment." The fact is that Staltersoft JSC ceased to formally belong to Vladimir Butenko in 2013. Until his death, however, he was the sole beneficiary of society. After the death of the entrepreneur, Anna Butenko tried to negotiate with the management of Stalkersoft on an acceptable division of business income, but these attempts did not lead to anything.

According to the court order, Anna Butenko was recognized as the copyright holder of the computer program "CommuniGate Pto v 6.2" under registration number 2020661864 of October 1, 2020. In addition, the court ordered the Federal Intellectual Property Service to make appropriate changes to the information state on the registration of the program in terms of indicating the copyright holder. A similar solution, as noted by CNews, concerns the CommuniGate Pgo v 6.3 program ON.
