Vendors are required to start supplying devices with Russian software from July 1, 2020, said Anatoly Golomolzin, deputy head of the Federal Antimonopoly Service (FAS), at a working meeting with vendors and retailers.
As Vedomosti writes with reference to two participants in this meeting, the FAS intends to abandon the phasing in the mandatory preinstallation of domestic applications and programs for some types of devices and extend the requirements for it from July 1, 2020 to all types of devices at once, including computers, tablets and Smart TV, and not just smartphones, as previously proposed.
The issue of the phased introduction of requirements has not yet been finally resolved, the FAS press service reports the words of Anatoly Golomolzin. Interdepartmental disagreements about the government decree with the timing of the start of pre-installation are minimal, he says, the FAS plans to send the document to the Ministry of Economic Development and the Ministry of Justice in the near future and submit it to the government by the end of March 2020.
As the Kommersant newspaper reminds, business representatives previously warned that device manufacturers would not have time to implement the requirements of the law by July 1, 2020, including due to quarantine, which was introduced at Chinese factories in connection with the spread of the new coronavirus.

FAS clarified the terms and rules for preinstalling Russian software for smartphones, computers and TVs
On January 22, 2020, the Federal Antimonopoly Service (FAS) held a meeting of the working group at the FAS Russia Expert Council on Information Technologies, which determined for what equipment, how and when the pre-installation of domestic software for smartphones, tablets, computers and TVs should be provided.
According to the FAS plan, the law will be implemented in several stages. From July 1, 2020, pre-installation of Russian software will become mandatory for smartphones, from 2021 - for tablets, from 2022 - for computers, from 2023 - for Smart TV.
It follows from the service's message that the list of applications for smartphones should include antivirus programs, navigators, search engines, public service access programs and payment systems. A similar set, with the exception of payment systems, is offered for tablets. At the same time, for all the same tablets, as well as computers and smart TVs, it should be possible to install applications for audiovisual services and software for watching TV programs of the I and II multiplex.
It is expected that the final draft of the initiative will be sent to members of the FAS information technology working group by the end of January 2020, and in March the document will be submitted for consideration to the government.
According to Kommersant, in 2020, domestic cards and searches will become mandatory on smartphones, from 2021 - antivirus, public services application, instant messengers and social networks, and from 2023 - the national payment system "Mir." The requirements will not apply to equipment manufactured before July 1, 2020, the newspaper indicates.

The final conclusion, whether the new law creates obstacles to trade, will be made by the Eurasian Economic Commission. By December 23, 2019, it collects and summarizes the opinions of the union members.
Anatoly Sheludyakov, head of the EAEU Digital Transformation Competence Center at the Analytical Center, says that the new law does not prohibit the establishment of foreign programs, including those originating from the EAEU states. The purpose of the amendments is to give Russian consumers the opportunity to use the devices immediately after purchase, he said. Putin signs controversial law to pre-install Russian software on smartphones
On December 2, 2019, the bill on the pre-installation of Russian software was signed by Russian President Vladimir Putin. At the same time, Dmitry Zhelvitsky, chief analyst at RUSSOFT, told TAdviser that although there are companies in the country that suffer from pre-installation of foreign software on gadgets, they could hardly only speed up the adoption of the bill on their own.
In the first reading, the bill was adopted by the State Duma on November 5, 2019. After this event, the Association trade of Companies and Producers, household and computer equipment RATEK which opposed the bill, said that before the adoption, the bill was not agreed with business.
The bill was submitted to the State Duma in July 2019 by a group of deputies headed by Sergei Zhigarev. Prior to that, Zhigarev had already submitted bills to the State Duma on the topic of mandatory pre-installation of Russian software for smartphones, but these documents were withdrawn to them.
Speaking with TAdviser about those points that were important to take into account when adopting the bill, President of NP RUSSOFTValentin Makarov drew attention to the fact that from the point of view of the functionality of the device, it is necessary that the applications of Russian and foreign manufacturers are removable.

From the point of view of regulation, in his opinion, it is important that foreign applications that collect personal and other sensitive data for which the state has imposed restrictions comply with the law. If we talk about compliance with the rules of competition between Russian applications, then it should be noted that the use of the register is fraught with the problems that manifested themselves during the operation of the register of domestic software. These problems were associated with attempts by some Russian companies to slow down the entry into the register of applications of their competitors. TAdviser also appealed to the Ministry of Digital Development, the Federal Antimonopoly Service and Rospotrebnadzor with a request to talk about an initiative similar to the bill - the requirements for smartphones developed in June 2019 for the presence of pre-installed domestic applications, as well as for ensuring the ability to completely remove any pre-installed applications in addition to the devices necessary for functioning. However, the Ministry of Digital Development and Rospotrebnadzor did not provide TAdviser with comments.
Elena Zaeva, Head of the Communications and Information Technology Regulation Department of the Federal Antimonopoly Service of Russia, drew TAdviser's attention to the fact that measures providing for the pre-installation of domestic applications on subscriber devices and ensuring the complete remoteness of applications that do not affect the performance of devices are provided for by the roadmap for the development of competition.

The bill on the pre-installation of Russian software for smartphones and PCs caused discord in the business environment and the State Duma
Despite the fact that the bill on the pre-installation of Russian software for smartphones, computers and Smart TV was adopted by the State Duma in the first reading, the controversy around it in November 2019 flared up with renewed vigor. The document raises many questions from both market players and some participants in legislative activity.
Suppliers point to many ambiguities in the draft law, say it has not been discussed with them and are being asked to finally do so. And some deputies believe that in its current form, the law rather limits the choice of the user than gives freedom, and propose amendments.
Thus, the Communist Party faction, which during the first reading of the bill opposed its adoption, prepared a package of amendments for it. Deputy, member of the State Duma Committee on Health Protection and the Communist Party faction Alexei Kurinny explained to TAdviser their essence. As conceived by the authors, foreign vendors should install Russian software on some gadgets, and foreign software on some. When selling gadgets in retail outlets, the client would first be offered a device with Russian software, and only then - with foreign software. Such a scheme, Kurinny believes, would provide the user with the freedom to choose software.
Also, the idea of the Communist Party of the Russian Federation provides that all pre-installed Russian software, unlike foreign software, would be free for the user. Accordingly, only that free Russian software would fall into the register of software for pre-installation on gadgets.

However, the amendments actually prepared by the faction, judging by the text they got acquainted with TAdviser, did not contain all those key points of the idea of the Communist Party of the Russian Federation, which Alexey Kurinny spoke about. They only noted that all Russian software preinstalled on gadgets would, unlike foreign software, be free for the user.
But the idea of the amendments of the Communist Party of the Russian Federation did not find approval from Russian software developers. Thus, the Association "ARPP Domestic Software TAdviser said that in the wording in which the amendments were proposed to the committee that developed the bill, they referred to determining the procedure for installing software on devices, which, without deep study and expert assessment, could devalue the original idea and create considerable implementation difficulties.
According to Vladimir Rubanov, a member of the board of NP RUSSOFT, managing director of Rosplatforma, the Communist Party amendments made no sense at all.
Since, subsequently, if the user revised his choice, it would be more difficult for him to get the software that he wants than in the case of the scenario that the bill suggests. The authors also insist in the letter that the developers of the bill consult with the professional community regarding it and note that this was not done earlier.
In addition, according to Vedomosti, the authors of the letter point to a number of ambiguities in the bill. So, for example, they note, the document does not prescribe who exactly will have to pre-install the software - the manufacturer or seller, or they are both, and who will bear administrative responsibility for failure to comply with this requirement.
State Duma deputy, chairman of the economic policy committee and co-author of the bill, Sergei Zhigarev, told Vedomosti that he had familiarized himself with the text of the letter. The State Duma has not yet given an official response to the letter.
In turn, software developers, along with the positive sides of the bill, see a number of difficulties in the actions that the government should take in relation to it.
According to TAdviser in the Association of ARPP "Domestic Software," the initiative itself, laid down in the bill, can have a positive effect.
For many Russian software developers, the path to the consumer through the devices sold is now closed and completely opaque. However, the user himself should also not suffer, which is what the bill provides for: after buying the device, as before, he decides for himself whether to use the pre-installed software or remove, disable, install a new one. In this sense, there can be no restrictions. |
At the same time, the Association noted that Russian companies are subject to Russian laws, and noted that this fact is important for users in terms of storing and protecting personal data.
The government will have a difficult task - to develop a procedure for the operation of this law, such that all participants benefit from its application, and the market has become more competitive for software developers, the Association noted. |
It is noteworthy that the authors of the bill themselves, generally positively assessing its idea, are still not fully satisfied with it - they indicated to TAdviser that some changes should be made to the document.
So, according to Sergei Zhigarev, the products of Russian developers should be freely included in the register of applications for installation so that the implementation of the law on software pre-installation can be completed in full. The manufacturers of gadgets sold in Russia - Huawei, Nokia, Ericsson, Apple, Google, as well as VK (formerly Mail.ru Group) did not provide comments on TAdviser's appeal regarding the bill. 2018: Ministry of Telecom and Mass Communications proposes to oblige computer importers to install Russian antiviruses
On August 20, 2018, it became known about the proposal of the Ministry of Communications to introduce a mandatory pre-installation of domestic antivirus software on computers imported into Russia. Market participants see this initiative as a danger to the market.

According to cybersecurity expert Kirill Kerzenbaum, the forced installation of Russian products is unlikely to help ensure national security, and the lack of competition will affect the quality of antiviruses.
The very idea of forcibly preinstalling antiviruses is good. However, the choice of a specific solution rather contradicts the basic ideas of the free market, the WTO and those initiatives that the state professes in other segments, for example, prohibiting manufacturers of mobile devices to pre-install specific applications or prohibit their removal, he said. |
The head of the antivirus manufacturer ESET in Russia and SNGDenis Mateev called the situation "not very healthy" when a person is not allowed to choose a product to meet their needs. According to him, the requirement to install Russian antiviruses on imported computers can lead to a decrease in the quality of antiviruses and the level of user security.
