Ministry of Digital Development is preparing a mechanism to counter the sale of rights to Russian software abroad

The Ministry of Digital Development will work out the issue of creating mechanisms for countering and responding in the event of the sale of rights to software products included in the register of domestic software to a foreign Julian. This follows from a letter (available to TAdviser) by Deputy Minister of Digital Development Maxim Parshin, sent at the end of March to RUSSOFT, APKIT, ARPP "Domestic Software" and the Center for Import Substitution Competencies in ICT, from which operational feedback on this initiative is expected.

In particular, it is proposed to consider the introduction of a procedure for notifying the Ministry of Digital Development on the transfer of exclusive rights to software outside the Russian Federation, as well as to empower the department and the expert council on software under the Ministry of Digital Development with powers providing for the approval of transactions, as a result of which exclusive rights to software are transferred from the register of domestic software.

Such control is proposed to be extended not to all software from the registry, but only to the one that is key to ensuring security at critical information infrastructure (CII) facilities.

The document developed by the ministry involves the introduction of requirements for the localization of software manufacturers. In addition, the draft resolution assigns the copyright holder responsibility for the implementation of rights to the software, including the obligation to provide technical support and warranty service. The changes also affected the procedure for considering documents for the inclusion of products in the register. The project provides for the involvement of specialized expert organizations in the processing of applications. The head of BASEALT, Alexei Smirnov, confirmed to the newspaper that the separation of criteria for public procurement and VAT was supported by the expert council on software under Ministry of Digital Development. If such a differentiated approach is eventually adopted, then when submitting an application to the register, the company will be able to choose a registration path with tougher or softer criteria, depending on whether it claims to participate in public procurement, said Renat Lashin, executive director of the Domestic Software Association.

The Ministry of Telecom and Mass Communications of Russia checks the register of domestic software

On September 25, 2018, it became known that by the end of September 2018, the Ministry of Digital Development, Communications and Mass Media (Ministry of Telecom and Mass Communications) should complete the verification of the register of domestic software. This is the first audit of the register since its formation in 2016.

As reported, according to the results of the audit, the number of participants may decrease. The reduction, firstly, will occur due to the exclusion of already non-existent companies or the irrelevance of the product. Secondly, the companies themselves are also asked to exclude them from the register, for example, due to the refusal to develop software previously included in the list.

According to government decree No. 1236, the Ministry of Telecom and Mass Communications was supposed to check the relevance of the register at least once a calendar year. But, according to Ilya Massukh, a member of the Expert Council on Russian Software at the Ministry of Telecom and Mass Communications and director of the Competence Center for Import Substitution in ICT, for various reasons, the current audit is the first since the creation of the list. According to another IT market participant, the Ministry of Telecom and Mass Communications changed several curators of the register, for some time "it was not up to him." Initially, the Deputy Minister of Communications and Mass Media of the Aleksei Sokolov was responsible for the register in the ministry, then this function was transferred to another deputy minister, Mikhail Evraev. After the latter left the Ministry of Telecom and Mass Communications, the duties returned to Sokolov.

However, the general director of the Speech Technology Center (CRT) Dmitry Dyrmovsky (also a member of the Expert Council) does not agree that the check was associated with a change of personalities.

Procurement of software for budget accounting

The purchased software for budget accounting must provide automation of the functions required for accounting in accordance with Russian law. The register of Russian software has been replenished with 645 new software products

As part of the fifth face-to-face meeting at the Ministry of Communications and Mass Media of the Russian Federation, the expert council on Russian software in September 2016 voted to include 645 new products in the unified register of Russian software, that is, 1823 software products have already been included in the register of Russian software.

Developer's revelations: "There are few chances to immediately get into the register of Russian software"

The company, "Elar" specializing in the creation, equipment and filling of electronic archives and other IT services, spoke about the "pitfalls" faced in the process of submitting and considering an application for entering the register of Russian software. Who and why are not allowed into the register of domestic software

In August 2016, the Ministry of Telecom and Mass Communications published a series of orders refusing to include software products in the unified register of Russian software. In 12 such documents, issued at different times from February to May, there are about 230 products. Among the most famous companies and products in the lists are "CROC" with a corporate EDMS, a subsidiary of AIt Group of Companies "Logic of Business" with several solutions in the field of electronic document management, a solution for monitoring the media "Medialogia," a number of products of MSVSFER of the "National Center for Support and Development," WorksPad of the "iT" "Corporate Mobility Laboratory," office applications package "IvolgaPRO" and others.

The reasons for the refusals to enter all these programs in the register of the Ministry of Telecom and Mass Communications do not explain. Igor Nikulin, director of the information technology department of CROC, told TAdviser that the company plans to wait for official notification and continue interaction with colleagues from the Ministry of Communications: "We are interested in publishing the maximum number of our software developments in the register, because the breadth of choice and healthy competition in the interests of the customers themselves."

In turn, MSVSFER solutions that are not included in the register are based on Red Hat products. Earlier, members of the Expert Council on Russian Software under the Ministry of Telecom and Mass Communications, which makes decisions on the inclusion of software in the register, agreed not to let products into it, including those with open source, if their key property is not based on domestic technologies^[21].

As for the IvolgaPRO product, earlier the media wrote^[22] Media^[23] about the connection of this product with the products of the Latvian company Ascensio CIA (OnlyOfice brand). The company "New Communication Technologies" - the developer of "OriolePRO" - told TAdviser that the decision of the Ministry of Telecom and Mass Communications was not clear to them. The company did not receive written justifications for the refusal and can "only guess" what caused it. Perhaps the point is the imperfection of the mechanism for including software in the register: "the mechanism for including software in the register is very closed and opaque," said Lev Bannov, general director of the company. Some of the products could be on the refused lists due to incorrectly executed or submitted documents or some other organizational reasons. Bars Group explained to TAdviser that the reasons why this decision was on the list of refuseniks for inclusion in the register are exclusively organizational in nature.

Initially, when collecting information for the formation of the registry, clear rules for submitting data were not formulated, so experts submitted information through personal accounts. After the Ministry of Telecom and Mass Communications published the official instructions, according to its recommendations, the same information was submitted from the Bars Group corporate account, the Bars Group explains. - As a result, confusion arose, and one of the decisions already included in the register was duplicated in the list of those who were refused. At the moment, 65 decisions of Bars Group are registered in the register.

IBM and EMC Platform Wrappers Removed from Registry

On June 8, 2016, it became known about the removal from the Register of domestic software supervised by the Ministry of Telecom and Mass Communications of a number of software products on the fact of their foreign origin^[24].

There were no official messages from the department about the removal of software from the registry, but an analysis of previous and current lists of Registry programs indicates the absence of the listed products in it.

According to the source of the CNews publication, the software in question was included in the Register by mistake and oversight. He stressed that the responsible expert who gives a preliminary opinion on the compliance of the software with the criteria of "purebred," in each of the four cases was his own. That is, there is no talk of anyone's systemic malicious connivance.

The expert believes that the Ministry of Telecom and Mass Communications, issuing an order to add products to the register (apparently, we are talking about a "tranche" when decisions at IBM were included in the lists), was aware of what was happening, but mechanically completed the formal process.

Russoft criticizes the Ministry of Telecom and Mass Communications for the imperfection of the procedures for including software in the register

On April 11, 2016, it became known about the negative attitude of the non-profit partnership (NP) Russoft to the procedures accompanying the inclusion of software in the register of Russian software. In their imperfection, NP "Russoft" accused the Ministry of Telecom and Mass Communications^[25].

According to NP Russoft, the procedure by which the expert council under the Ministry of Telecom and Mass Communications determines the compliance of software for inclusion in the register of Russian software is used for competition.

President of NP Russoft Valentin Makarov wrote a letter to Dmitry Chernov, Director of the High Technology Development Department of the Ministry of Telecom and Mass Communications, "with proposals to improve the quality and objectivity of the examination of software products" for inclusion in the register of domestic software.

84 new products, including Abbyy software, MyOffice, Dr. Web, Docsvision

On February 18, the Ministry of Telecom and Mass Communications, chaired by Minister Nikolai Nikiforov, held a face-to-face meeting of the expert council on Russian software. According to its results, 84 new products were included in the register of domestic software.

The list included products from such developers as Cognitive Technologies, Dr. Web, Bars Group, New Cloud Technologies, Forecast, 1C-Bitrix, Docsvision, 1C, Alt Linux, etc. For the products of the last two mentioned developers , the number of positions for inclusion in the register has been reduced, a source close to the expert council told TAdviser.

The following classes of software products are now presented in the register of Russian software: operating systems, organization process management systems, DBMSs, cloud and distribution computing tools, virtualization and DSS tools, server and connectivity software, search engines, monitoring and management systems, information security tools, office applications, system for collecting, storing, processing, analyzing, modeling and visualizing data arrays, project management systems, research, development, design and implementation, linguistic software.

Among the products included in the registry are "1C-Bitrix: Site Management" (several versions), "1C-Bitrix24" ABBYY FineReader ABBYY Lingvo ABBYY Comparator,,,,,,, Dr.Web Desktop Security Suite Dr.Web Katana Prognoz Platform system,,,,,,, Docsvision, "1C: ERP Enterprise Management 8" "1C: Accounting 8" "1C: Retail 8" Alt "MyOffice Mail" Digital Design: Secure Mobility Bars Housing and Communal Services Linux BARC.Monitoring - Education CDesctop, Alt Linux 7.0 Centaur, etc.

For some applications, a decision was made to refuse to be included in the register. A TAdviser source says that in many cases this happened even before the applications were submitted for consideration by the expert council, mainly due to the inconsistency of the electronic signature with which the applications are signed.

Another TAdviser source close to the expert council notes that some of the products faced a refusal due to the fact that the developers did not provide the software product itself with documents so that it could be viewed, and in some cases due to the fact that the ultimate beneficiaries of the software are not Russian persons.

The register of domestic software will not work in any way

By mid-February 2016, the government's procurement mechanism for domestic software in government agencies remains inoperative: the Ministry of Telecom and Mass Communications did not publish the necessary by-laws to regulate the procurement of foreign software on time, and the register itself contains only 3 software products.

In the two-month period from the moment of signing the government decree on restricting the purchase of foreign software in government agencies, that is, until January 16, the Ministry of Telecom and Mass Communications had to approve the provision on the expert council, which decides on the inclusion of software in the register of domestic software, as well as a classifier of programs and databases containing the characteristics of the software according to which it belongs to a certain class of software. In addition, the rules for the formation and maintenance of the register approved by the decree state that the Ministry of Telecom and Mass Communications must appoint the official website of the register of domestic software and the operator company, which will be responsible for maintaining the register. The election of this company must be carried out in accordance with the requirements of the law on public procurement.

In early December 2015, the Ministry of Telecom and Mass Communications published on the regulation.gov.ru portal a draft order to determine the official website of the register operator, as well as a draft software classifier. Both documents as of February 18 were never registered and published. The Kommersant newspaper, citing its sources, writes^[26], that the necessary papers were sent for registration to the Ministry of Justice with violations, and therefore were not registered, and now the Ministry of^[27] Communications is correcting the mistakes made in them.

The interlocutors of the newspaper note that without by-laws, the register launched at reestr.minsvyaz.ru is not a legal register. In addition, in the absence of a provision on the expert council, the current expert council is also not legal, sources say.

At the same time, the presence in the register of only a few software products in the expert council is somewhat different. The registry website lists dozens of registered applications for inclusion in it. One of the members of the expert council , Alexei Smirnov, general director of Alt Linux, told TAdviser that, firstly, it takes some time from the moment the application is registered to the receipt of the product by the assessment of the Ministry of Communications and subsequent transfer of it for examination by the expert council. According to Smirnov, a new "batch" of products has already been submitted to the council for examination, but decision-making on them has stalled. The decision of the expert council for each product is made on the basis of the results of the voting of the council members, which is carried out in absentia, and if in the case of the first three products it passed very quickly, then with the second list for some reason it is not possible to quickly collect all the votes, Smirnov said in a conversation with TAdviser.

Alexey Smirnov says that the collection of votes on the second list of products continues and the expert council plans to hold a face-to-face meeting to consider a number of organizational issues and resolve the issue of product expertise.

On February 17^[28], Minister of Communications and Mass Media Nikolai Nikiforov, on the air of the Russia 24 TV channel. According to him, it is planned to approve about 50 applications for the inclusion of software and consider about 50 more applications.

The first products in the register of Russian software

On February 1, 2016, Minister of Communications Nikolai Nikiforov signed an order to include the first three software products in the unified register of Russian software. One of them was the Red Database database management system from Red Software, developed on the basis of Firebird open source software . It is used in more than 30 public authorities and state organizations, in more than 150 banks. The largest client of Red Database in the public sector is the FSSP.

The decision to include products in the register was made during an absentee meeting of the Expert Council on Russian Software, which includes representatives of federal executive bodies, institutions of innovative development, as well as associations of Russian software developers. Decisions of the council are made by a simple majority of votes of its members. According to the results of the voting, these software products were recognized as meeting the requirements established by the fifth paragraph of the rules for the formation of the register.

EMC Documentum Claims Registry Entry

On June 29, 2015, Russian President Vladimir Putin signed Federal Law No. 188 (download PDF) developed by the Ministry of Telecom and Mass Communications on the creation of a single register of Russian software.

The law comes into force on January 1, 2016.
