2023: Expert Council under the Ministry of Digital Industry received powers to include PAC in the register of domestic software

On June 1, 2023, the Ministry of Digital Science announced the signing of an order empowering the expert council on software to include hardware and software systems (PAC) in the register of domestic software.

The Expert Council is an advisory body formed in order to conduct an examination of applications for the inclusion of information about software or PAC in the unified register of Russian programs for electronic computers and databases. The inclusion of PAC in the register is necessary so that developers and manufacturers of such products can apply for the same tax benefits as the creators of domestic software.

It is noted that the expert council in its activities is guided by the Constitution of the Russian Federation, federal laws, decrees and orders of the president, decrees and orders of the government, as well as regulatory legal acts of the Ministry of Digital Science and decisions of the Eurasian Economic Commission. The minimum number of board members is ten, including the chairman. This, in particular, can be representatives of scientific and educational organizations, as well as associations (unions), whose members are Russian organizations engaged in the development and implementation of software or PAC.

The expert council considers applications from market participants within 15 working days from the date of their registration with the Ministry of Digital Industry. The resolution instructs the department to approve the classifier of hardware and software systems. Decisions on the inclusion of products in the register of domestic software are made by a simple majority of votes of the meeting participants. In case of equality of votes, the vote of the chairman at the meeting of the expert council is decisive. The developed conclusion should contain conclusions on the compliance or non-compliance of the software and PAC with the established requirements.[1]

2021: The expert council under the Government of the Russian Federation includes the heads of Rostelecom and Yandex

In December 2021, Prime Minister Mikhail Mishustin signed a decree approving the provision on the Expert Council under the Government of the Russian Federation. It included 23 people, including Yandex CEO Elena Bunina and Rostelecom President Mikhail Oseevsky.

According to the document, the council is an advisory body that is created to ensure interaction with the expert community. The curator of the body's work has been determined by the deputy chairman of the government - the head of the government apparatus (by the end of December 2021, this is Dmitry Grigorenko).

The Council was headed by the former rector of the Higher School of Economics Yaroslav Kuzminov. In November 2021, he asked to give the council the right of an information initiative - the right to initiate data collection and surveys. Mikhail Mishustin said at the same time that the Russian Government expects to continue working with experts on strategic initiatives for socio-economic development.

The main tasks of the Expert Council are to ensure the participation of the expert community in the preparation and implementation of decisions of the authorities, as well as ensuring public control over the activities of federal authorities. This is an advisory body, its decisions are advisory in nature. Members of the expert council carry out their activities on a voluntary basis.

In March 2021, a department of expertise and planning appeared in the structure of the government apparatus, headed by Vitaly Zlobin. As stated in the Cabinet, the department should "bring work with experts, industry associations, legislative bodies and the public to a qualitatively new level." Kommersant noted that in this way the government expects to reboot the system of work with the public, business and lawmakers, and the expert council, presumably, will become one of the main tools of work.[2][3]
