2023: Introduction of bankruptcy proceedings

At the end of May 2023, the Arbitration Court of the Novosibirsk Region declared the clinic of the Novosibirsk Research Institute of Traumatology and Orthopedics (NIITO) bankrupt and introduced bankruptcy proceedings against the medical institution. The company will no longer be able to continue its work.

According to the results of the observation, the interim manager of the clinic Tatyana Bolotova said that it was impossible to restore the solvency of the clinic. According to RBC, most of the creditors spoke in favor of introducing external management, as a result of which the medical organization could continue to work with the subsequent payment of debt obligations. At the same time, it is noted that in bankruptcy proceedings there may not be enough funds to pay off the entire amount of debt.

Novosibirsk NIITO declared bankrupt

The case is not quite typical for the introduction of a liquidation procedure: the clinic has high revenue indicators, over the past few years a fairly large amount of accounts payable has been repaid. There are few such organizations as the NIITO ANO Clinic in the Novosibirsk Region, and the issue is not just legal or economic, but also social, "Vladislav Boyarinova, a lawyer at the Sollars law firm, told the publication.

The basis for declaring the institution bankrupt was the applications of Medical Integrator LLC and Zdorovye LLC, which went to court in October 2021. Soon there was information that the clinic wants to apply for self-bankruptcy.

The NIITO Medical Center was established in 2000 by the Novosibirsk Research Institute of Traumatology and Orthopedics. Disagreements between institutions appeared in 2021, then and. about. Director of the Institute Andrei Korytkin said that the connection between institutions is weakening, the clinic is actually becoming an independent institution. Former director of the clinic Oksana Shelyakina noted that the status of the clinic as a non-profit autonomous institution does not allow initiating its return to the research institute.^[1]

2022: Seizure of property

In January 2022, the Arbitration Court of the Novosibirsk Region arrested the property of the bankrupt ANO "Clinic of Traumatology, Orthopedics and Neurosurgery NIITO" in the amount of 87.7 million rubles at the request of Rusfond"." Among the arrested property of the clinic, diagnostic, medical and surgical equipment, office equipment and simulators for rehabilitation are listed - a total of 324 units of office and medical equipment. The court also forbade the clinic to perform actions aimed at alienating property, "since these interim measures are commensurate with the stated requirements."

Medical equipment of the NIITO Clinic, which owes tens of millions, was arrested at the suit of Rusfond

The measure was taken as part of the bankruptcy case of ANO Clinic NIITO after Rusfond's petition to include in the register the company's claims a debt to the organization in the amount of 69.7 million rubles. The very application of the charitable foundation for seriously ill children, disabled people and orphans will be considered by the court on March 2, 2022.

As the press service of Rusfond clarifies, from January 1, 2013 to December 30, 2021, the charity transferred 222 926 767,87 rubles to the NIITO Clinic, the clinic provided services for 153 222 731 rubles. Rusfond also clarified the origin of this debt.

2021: Bankruptcy proceedings begin

In early December 2021, the Arbitration Court of the Novosibirsk Region introduced a monitoring procedure for the ANO "Clinic of Traumatology, Orthopedics and Neurosurgery of NIITO." The bankruptcy proceedings were initiated in response to a lawsuit previously filed by Medical Integrator, a company engaged in the wholesale of medical devices and pharmaceuticals.

The observation procedure should last until May 4, 2022. On this date, the judge appointed a regular hearing on the case, at which a member of the SRO AU "Continent" Tatyana Bolotova should listen. She was appointed interim manager.

The court declared bankrupt the clinic of the Novosibirsk NIITO due to debts

In August 2021, Medical Integrator and ANO Clinic NIITO entered into an amicable agreement. At that time, the debts of the medical institution amounted to 23.5 million rubles.

In October 2021, the Medical Integrator again appealed to the court with a statement declaring the NIITO clinic bankrupt. At the same time, the medical institution announced its intention to file an application with the court for its own bankruptcy. The case concerned a contract for the sale of equipment. Among the creditors, in addition to the Medical Integrator, two more companies were indicated - LogisticMed (debt - 24.9 million rubles under the supply agreement) and TekhinCom (debt 33.3 million rubles under the equipment purchase and sale agreement). In 2021, Tehinkom LLC filed three lawsuits against the NIITO clinic.
