2024: Recovery of 8 million rubles from the Perm Territory Development Corporation through the court for the incomplete reconstruction of the emergency building
The Arbitration Court of the Perm Territory in September 2024 ruled to recover ₽7,9 million from Perm Territory Development Corporation JSC (KRPK) in favor of Perm State Medical University (GMU). The resolution is associated with an unrealized project for the reconstruction of the emergency building of the university, which was supposed to be completed by 2023.
The trial was initiated by the Perm State Medical University in connection with the failure of the KRPK to fulfill its obligations under the investment agreement concluded in 2018. According to the terms of the agreement, the corporation was supposed to rebuild the two-story university building built in 1917, located at ul. Krisanova, 22, in a seven-story one, intended for a hostel and administrative premises.
The cost of the project was initially estimated at ₽79,8 million, and the implementation period was set for five years. However, in 2019, legal obstacles arose: the Perm City Council changed the zoning of the land plot, limiting the height of the development to six floors. The KRPK argued that this made the implementation of the treaty impossible.
The court did not accept the corporation's arguments, pointing out the absence of a direct ban on the construction of a seven-story hostel in new urban planning conditions. Moreover, it was found that the KRPK itself initiated a change in the urban planning plan, which led to restrictions on altitude.
In 2022, the KRPK notified the medical university of an increase in the cost of construction to ₽248,7 million, citing the unprofitability of the project, and proposed a joint financing option. Perm State Medical University, in turn, demanded through the court the payment of a penalty in the amount of ₽67,1 million.
The arbitration court found the required amount of the penalty disproportionate, since the university did not suffer significant property damage. As a result, the court decided to recover from the KRPK about 10% of the original cost of the project.
KRPK stated that during the five-year period allocated for the implementation of the investment agreement, significant macroeconomic and urban planning changes took place that made it impossible to implement the project in its original form. Representatives of the corporation said that they are studying the motivation part of the court decision.
